— Illinois 5th worst state in US, Chicago 3rd worst city for fraudulent odometer rollback on used cars. DD: There were more than enough facts to make the Chicago Car Exchange (CCE) suspicious of the 1968 Dodge Charger R/T’s claimed mileage that CCE sold me, and therefore, CEE should have verified its claimed milage. The court left out many of those facts in its written decision. SEE: https://law.justia.com/cases/federal/appellate-courts/F3/110/481/526770/  I argued this case before Chief Judge Posner. Further, CCE refused to offer to pay me the car’s loss in value because of the odometer discrepancy or the thousands of dollars of improvements that I had made to the car. The odometer exemption decision was rendered moot when the BIG THREE had Congress modify the Federal Odometer Act. I appealed the rest of the decision to the Supreme Court, but Supreme Court refused to hear it. According to Google AI: “Diersen v. Chicago Car Exchange was a federal appeals court case that established that the National Highway Traffic Safety Administration (NHTSA) did not have the authority to exempt vehicles ten years or older from the Odometer Act’s disclosure requirements. Case Summary  Plaintiff: David Diersen, who bought a 1968 Dodge Charger from Chicago Car Exchange (CCE). Defendant: Chicago Car Exchange (CCE), an automobile dealership. Allegation: Diersen claimed CCE violated the federal Odometer Act by providing an inaccurate odometer reading and intended to defraud him. The Odometer Act allows purchasers to sue for triple actual damages or $1500. Initial Ruling: The district court ruled for CCE, citing a 1988 NHTSA regulation that exempted vehicles ten years or older from the Act’s requirements. Appeals Court Ruling: The Seventh Circuit Court of Appeals reversed, stating the NHTSA regulation was invalid as it lacked statutory authority. The court noted that Congress did not exempt any vehicle class in the Odometer Act, which aims to protect all purchasers from odometer tampering. Outcome: While finding the regulation invalid, the appeals court upheld the summary judgment for CCE because Diersen did not provide enough evidence that the dealership intended to defraud him, a required element for a claim under the Odometer Act. The court distinguished “mere negligence” from “intent to defraud” and noted that CCE had no reason to question the car’s original seller’s sworn statement. CCE had also offered Diersen a full refund, which he declined.”
