Heuerman said he does not believe the Champaign County Sheriff’s office will play a large role in the rollout of the new requirement because it is unlikely that deputies will regularly encounter people whose sole crime they are committing is failing to register their regulated firearms. The statute does not require deputies go door to door to check if people have assault-style weapons guns in their home, the sheriff said. When deputies do come into contact with individuals who are possessing a gun unlawfully, it is typically because that person is using it recklessly or threateningly. In the latter instance, HB 5471 could serve as another means of prosecution for the Champaign County State’s Attorney’s office, he said. In a scenario in which a deputy encounters a person who has neglected to register their firearm, and they are not possessing or wielding it in any other unlawful way, Heuerman said he does not see a criminal arrest likely taking place in those circumstances, but rather a conversation taking place in which that person is reminded they are registered to their firearm with ISP. But if deputies were to make contact with that person who has failed to register their assault-style firearm in subsequent encounters, then the sheriff’s office could escalate their involvement in making an arrest and report for the State’s Attorney’s office to follow up on. “I don’t want to suggest people don’t do it, that’s not what I’m saying. The law is the law,” Heuerman said. “But I just don’t think the frequency is going to be there where we’re running into people violating the statute intentionally without maliciously using that weapon in some way.”)
