discrimination is the least profitable type of discrimination for workers. In other
words, the potential amount of damages available to age discrimination victims
is far lower than the amount of damages that are available to victims of other
types of discrimination. This reality has terrible consequences for combating
the problem, and surely contributes to the epidemic nature of age
discrimination in America. Title VII of the Civil Rights Act of 1964 provides
victims of discrimination based on race, sex, religion, color and national
origin with a full menu of damages, including monetary, compensatory (i.e.
damages for emotional distress), and punitive damages. Federal courts always
award attorney fees to prevailing plaintiffs in Title VII cases. Not so the Age
Discrimination in Employment Act of 1967 (ADEA). The ADEA does not treat age
discrimination like a serious civil rights violation. Instead, age
discrimination is accorded the same severity as an employer’s failure to pay
workers’ overtime or holiday pay. The damages provision of the ADEA is taken
not from Title VII but from the Fair Labor Standards Act, a federal law that
regulates the payment of wages by employers. The ADEA allows age discrimination
victims to recover for monetary loss only, sometimes doubled if the plaintiff
can prove “willful” discrimination. Like all civil rights laws, one of the
functions of the ADEA is deterrence. The very existence of the law is supposed
