If I had not be denied my 7th Amendment right to a jury trial in Diersen v. GAO, and if you had served on that jury, would you have sided with GAO or with me? To justify their denying me a jury trial, the judges and justices hinted/implied/argued that no jury would side with me. But the trial record showed that my Democrat superiors had illegally forced me to retire so that they could give my job and my preferred corner office to my Black subordinate who had less work experience than I had, had less education than I had, had one professional certification while I had six, and had no professional license like I had. In 1993, when I was a 45-year-old GAO employee who had 25 years of federal service, to get rid of their employees a) who they had not promoted into their Senior Executive Service, currently $197,200/year, b) who were Republican, White, male, older, and/or non-veteran, and/or c) who had 25 or more years of federal service, the Democrats who ran GAO “offered” them a $25,000 buyout if they took early retirement. Their buyout “offer” expired in 1 year and their early retirement “offer” expired in 4 years. They succeeded in forcing me to take the early retirement “offer” on September 30, 1997. Things that I had done that helped me survive those 4 years included a) my earning job-related master’s degrees in 1997, 1980, and 1976, b) my earing job-related professional certifications in 1997, 1996, 1994, 1990, 1981, and 1979, and c) my earning a job-related professional license in 1981. Under the Democrats and under the RINOs, anticipate/expect that ever-increasingly, the more of the following that you are, the less “jury appeal” that you will have, and therefore, the less “justice” that you will have in courts: conservative, Republican, non-poor, non-veteran, White, male, older, Protestant, German American, and/or have ancestors who have been in America for a long time. I am all of the aforesaid. Federal courts would not have denied me my 7th Amendment right to a jury trial in Diersen v. GAO if I had been Democrat, poor, veteran, minority, female, younger, non-Protestant, non-German American, and/or if my ancestors had not been in America for a long time. GAO hinted/implied/argued that because of my demographics, I should pay the price of Affirmative Action big time and that I could easily afford to pay that price. GAO’s forcing me to retire when I was 49 years old in 1997 cut my income by $86,042/year (56%) ($154,682/year salary minus $68,640/year pension) in today’s dollars. Off the record, GAO stressed a) that the federal government would forever pay 72% of my and my wife’s health insurance premiums, b) that my wife had a good job, c) that we had no dependents, d) that we had no debts, e) that we had substantial retirement and other savings, f) that we owned a 13-year-old home in Wheaton, g) that we owned three collector cars, h) etc. Again, if I had not been denied my 7th Amendment right to a jury trial, and if you had served on that jury, would you have sided with GAO or with me? From what I see, those who want Affirmative Action and DEI would have sided with GAO.
