The controversy centers on accusations from 17 township residents who say the Republican caucus held virtually Dec. 1 via the internet-based platform Zoom was neither fair nor honest, which is why they held their own caucus instead. Republican organization Chairman Jim Ruhl said the decision to host the caucus via Zoom was made so that anyone, including older people and those who fearful of going out in public because of the coronavirus pandemic, could participate. To provide more flexibility, Republicans who are not internet savvy had the option of calling in by phone, he said. “We did not want to disenfranchise any voter,” Ruhl said. “We chose Zoom for the health and well-being of everyone.” At a meeting a month before the caucus, the organization agreed to slate candidates for the two township positions held by Republicans now: the seats of Assessor Warren Dixon III and Trustee Paul Santucci, he said. Dixon plans to step down and asked Matthew Rasche to run as his replacement; Santucci is seeking reelection. Both candidates were approved during the organization’s virtual caucus Dec. 1. The other set of candidates was selected the same night in the parking lot outside the Naperville Township offices on Water Street in Naperville. They include Lynda Segneri for supervisor, Barbara Lukoff for clerk, Gary Vician for assessor, and Thomas Laz, Gabby Serna and Bill Breyne for the three open trustee seats. That slate was not certified by the township clerk nor forwarded to the county clerk so the candidates filed a lawsuit to have their names listed on the ballot. Attorney Keri-Lyn Krafthefer, who represents the plaintiffs, said 17 Republican voters showed up at the Naperville Township offices Dec. 1 for the caucus. When they were denied in-person access to the meeting, they caucused outside in the parking lot, Krafthefer said. Their lawsuit contends there is no provision in state law that permits a caucus election to be conducted electronically. Vician said a caucus is essentially a primary election, and elections are held in person, not virtually. Caucusing in person allows everyone to have a voice and speak freely, he said. “You really can’t do that on a Zoom call,” Vician said. “In a Zoom meeting, you can be silenced (through muting or ignoring someone who raises their hand).” Rather than decide which slate of candidates should be on the April 6 ballot, DuPage Judge James McCluskey ruled everyone would be listed for the consolidated election. In a written ruling explanation issued Friday, McCluskey said the Zoom caucus was “not properly conducted in a fair and honest manner.” The judge said he agreed with the plaintiffs’ argument that the Zoom caucus was held “in blatant contravention to the Township Code and the Governor’s Executive Order 2020-73 which exempts Township Caucuses from electronic means.” Gov. J.B. Pritzker’s Nov. 18 coronavirus mitigation order to which the judge referred was interpreted differently by the two sides. Krafthefer said the governor’s executive order “does not apply to the December 2020 township caucuses,” which means caucuses can be held in person as required by state law. But Ruhl said the Republican organization was following the governor’s directive. The same order a few sentences later says, “Nothing in this Executive Order prohibits caucuses from being held virtually, and caucus organizers are encouraged to facilitate virtual attendance, to convene outdoors, and must adhere to all Social Distancing Requirements.” Ruhl said he’s not sure when the appellate court will rule, though he expects a decision will be made before April 6 when votes are counted.)
