(FROM THE ARTICLE: Judges with backgrounds as prosecutors or corporate lawyers, who represent the majority of federal district court jurists, are significantly more likely to rule in favor of employers in workplace disputes, according to a new study of diversity on the bench. Emory University law professor Joanna Shepherd conducted the study, which she described as the first published research about whether judges from certain professional backgrounds are more likely to rule against workers. Shepherd concluded that judges appointed by former President Barack Obama with corporate backgrounds are 36% less likely to rule on behalf of employees. Obama judges who have a background as prosecutors are 50% less likely to decide in favor of employees in those cases compared with non-prosecutors, she reported. Her work received some financial support from the group Demand Justice, which advocates for progressive judicial nominees. The new findings come as advocates push for greater professional diversity among President Biden’s presumptive judicial nominees. Former prosecutors and corporate lawyers make up nearly 7 in 10 judges on the federal district courts, which consider lawsuits over employment, immigration, the environment and other topics.
“Our results suggest that expanding the professional diversity of the federal judiciary will do more than just create a judiciary that is more representative of the legal profession,” Shepherd said. “It can affect actual case outcomes and, as a result, the development of legal precedent.”)

The 111 to 5 vote (and one abstention) for censure “is meant to remind the representative who he represents: the people who elected him, not his self-interests,” said Will County Republican Chairman George Pearson, adding that Kinzinger’s decision to start a PAC that “goes against other Republicans was a betrayal.” Pearson said his next task is to find a challenger for Kinzinger’s seat. The rebuke comes a few days after the Iroquois County GOP in central Illinois voted to censure. LaSalle County’s Republican Central Committee voted to censure earlier this month. All three counties are among the 14 counties that make up Kinzinger’s 16th Congressional District. Kinzinger issued a statement criticizing GOP leaders in Will County for not doing more to elect Republicans and calling the county GOP “inept.” “Maybe if the Will County GOP spent the same amount of time and energy helping local Republicans as they do with petty censure votes to go after those that vote their conscience, they might actually win a few races,” Kinzinger said. Republican organization Chairman Jim Ruhl said the decision to host the caucus via Zoom was made so that anyone, including older people and those who fearful of going out in public because of the coronavirus pandemic, could participate. To provide more flexibility, Republicans who are not internet savvy had the option of calling in by phone, he said. “We did not want to disenfranchise any voter,” Ruhl said. “We chose Zoom for the health and well-being of everyone.” At a meeting a month before the caucus, the organization agreed to slate candidates for the two township positions held by Republicans now: the seats of Assessor Warren Dixon III and Trustee Paul Santucci, he said. Dixon plans to step down and asked Matthew Rasche to run as his replacement; Santucci is seeking reelection. Both candidates were approved during the organization’s virtual caucus Dec. 1. The other set of candidates was selected the same night in the parking lot outside the Naperville Township offices on Water Street in Naperville. They include Lynda Segneri for supervisor, Barbara Lukoff for clerk, Gary Vician for assessor, and Thomas Laz, Gabby Serna and Bill Breyne for the three open trustee seats. That slate was not certified by the township clerk nor forwarded to the county clerk so the candidates filed a lawsuit to have their names listed on the ballot. Attorney Keri-Lyn Krafthefer, who represents the plaintiffs, said 17 Republican voters showed up at the Naperville Township offices Dec. 1 for the caucus. When they were denied in-person access to the meeting, they caucused outside in the parking lot, Krafthefer said. Vician said a caucus is essentially a primary election, and elections are held in person, not virtually. In a written ruling explanation issued Friday, McCluskey said the Zoom caucus was “not properly conducted in a fair and honest manner.” The judge said he agreed with the plaintiffs’ argument that the Zoom caucus was held “in blatant contravention to the Township Code and the Governor’s Executive Order 2020-73 which exempts Township Caucuses from electronic means.” Gov. J.B. Pritzker’s Nov. 18 coronavirus mitigation order to which the judge referred was interpreted differently by the two sides. Krafthefer said the governor’s executive order “does not apply to the December 2020 township caucuses,” which means caucuses can be held in person as required by state law. (FROM THE LETTER: HB0038 is currently in committee of the Illinois House of Representatives. This bill should concern Illinoisans who aspire for a community so beautifully described by Dr. Martin Luther King Jr. as one where people “will not be judged by the color of their skin but by the content of their character.” In a departure from Dr. King’s aspirations, HB0038 calls for consideration of race in the hiring process of public-school teachers. This would seem to violate several federal and state civil rights laws. Specifically, the Illinois Civil Rights Act of 2003 which explains that a unit of the state cannot “subject a person to discrimination under any program or activity on the grounds of that person’s race, color, national origin, or gender,” as well as the language of the Illinois Human Rights Act which prohibits race-based discrimination in employment. While one component of HB0038 undermines Dr. King’s message through employment considerations, another does so through mandates of curriculum and instruction at the local level. Starting as early as elementary school, HB0038 would require students to learn curriculum based in a discipline of academia that places race as an essential and defining part of human interaction. In this model, one’s status as oppressor or oppressed is heavily determined by skin color. In one application of this curriculum, groups of third-grade students analyzed their racial and sexual identities according to “power and privilege” and then wrote reflections on their status as being either privileged or oppressed. One parent described the activities as “basically teaching racism.” Humbly, I submit, a society that places race as an essentially defining element of most human interaction is not one so admirably envisioned by Dr. King. With that in mind, Illinoisans should oppose HB0038.)

In 1997 they succeeded in forcing me to take their early retirement “offer.” They were furious that I became Certified Fraud Examiner in 1990, Certified Government Financial Manager in 1994, Certified Financial Services Auditor in 1996, and Forensic Accountant in 1997 and that I earned a job-related master’s degree in financial markets and trading from IIT in 1997 because the aforesaid frustrated their efforts to get rid of me. If I had had drinking problems like Kinzinger had, I would not have gotten jobs washing dishes 1964-1966; cleaning golf shoes, chipping slag, and pumping gasoline in 1966; delivering mail 1966-1969; working on an automobile assembly line and as a security guard in 1970; selling tires, automotive services, and major appliances 1970-1971; pumping gasoline 1971-1972; collecting delinquent taxes 1971-1980; or auditing federal agencies 1980-1997. IRS would not have promoted me in 1972, 1973, or 1974 and GAO would not have promoted me in 1986. If I had had drinking problems like Kinzinger had, Loyola might not have accepted me in 1972, DePaul might not have accepted me in 1976, and IIT might not have accepted me in 1992. If I had had drinking problems like Kinzinger had, I doubt that I would have passed CPA examination on my first attempt in 1979 or passed the Certified Internal Auditor examination on my first attempt in 1981. Kinzinger is a veteran. Starting in 1966, my Democrat superiors, Democrat supervisors, Democrat coworkers, and Democrat subordinates always used my avoiding the draft against me.)
