(FROM THE ARTICLE: The federal government officially outlawed age discrimination in the workplace 50 years ago and therefore it is now nothing but a distant memory. We now pause for the laughter to die down. Unfortunately, it is still with us—as are a number of other forms of bias also outlawed around the same time, not incidentally—according to the very agency that enforces the law in the federal workplace as in other workplaces, the Equal Employment Opportunity Commission. The Age Discrimination in Employment Act was passed in 1967 but its effective date was put off until June of the following year. The law barred discrimination on grounds of age with respect to any term, condition, or privilege of employment; barred retaliation for opposing employment practices that discriminate based on age or for filing an age discrimination charge; and generally barred including age preferences in job notices. Protection against bias on the basis of advanced age was an admirable foresight in a nation awash with young baby boomers. However, “After 50 years of a federal law whose purpose is to promote the employment of older workers based on ability, age discrimination remains too common and too accepted,” says an EEOC report. “Despite decades of research finding that age does not predict ability or performance, employers often fall back on precisely the ageist stereotypes the ADEA was enacted to prohibit.” While quantifying age discrimination is difficult—in part because, like other forms of discrimination it often is not formally reported—“the perception that age discrimination exists in our workplaces is prevalent,” it said. It cited a recent survey finding that more than 6 in 10 workers age 45 and older say they have seen or experienced age discrimination in the workplace and of those, 90 percent say it is somewhat or very common. This most frequently takes the form of unlawful firing, harassment, discriminatory terms of employment and discriminatory discipline, said the assessment of the nationwide workforce whose findings should be of special concern in the generally older federal workforce. Let’s begin with a basic premise: To obtain a job, you must possess a skill set, or at least the aptitude to develop the skills needed. Employment then becomes a form of contract. However, in today’s environment we need to add a second premise: In a rapidly changing world, jobs and organizations must continually evolve, grow, and adapt to be effective. This applies to government, not just the private sector. It should be easy, right? Unfortunately, it’s not. Achieving the following three things would go a long way toward improving the performance and accountability of federal employees.)

(FROM THE ARTICLE: As long as reporters have covered government officials, they’ve sought greater access than the government was willing to allow. The White House excluded a CNN reporter from an international trade announcement with the president of the European Commission on July 25, in apparent retaliation after she shouted unwelcome questions at President Donald Trump during an Oval Office appearance. Many observers viewed this move as an escalation of the Trump administration’s hostility toward journalists. The Washington Post called the decision to exclude CNN’s Kaitlan Collins “highly unusual and possibly unprecedented.” Sen. Richard Blumenthal, D-Conn., called it “an offense against the First Amendment interests of all of us.” But did the White House actually violate the Constitution? As a media law professor, I regularly remind students that the First Amendment right of access to government officials, records and events is surprisingly uncertain. The First Amendment guarantees all Americans freedom to speak and publish without government interference. It has been broadly interpreted by the Supreme Court to forbid the government from restraining or punishing a speaker based on the content of the speaker’s message. While journalists have a clearly established First Amendment right to publish the news they’ve gathered — even in extreme cases, like the leak of stolen Pentagon documents — it’s much less clear that the First Amendment protects the right to gather the news in the first place. A right to publish, but not a ‘right to gather’? CNN has not indicated that it plans to take any legal action over Collins’ exclusion. In addition to being awkward — imagine a journalist taking the witness stand to testify against the White House communications director — a court case over a withdrawn invitation would face legal obstacles. The courts have refused to recognize an overarching “constitutional right of access” to government information. Instead, they have picked off cases with narrow, specific rulings. For instance, the Supreme Court recognized in Richmond Newspapers v. Virginia that there is a constitutional right to cover a criminal trial. Likewise, federal appeals courts agree the First Amendment guarantees the right to videotape police making arrests in a public place. At the same time, judges have found no constitutional right to obtain government documents or to enter crime scenes that are off-limits to the public. Does CNN’s White House correspondent, or any journalist, have a First Amendment “right” to a press pass or a spot at a news conference? Since the Supreme Court said in its 1972 Branzburg ruling that journalists have no right to insist on greater access than the general public, probably not. That being said, journalists do have a right not to be retaliated against, regardless of what form the retaliation takes. Retaliatory exclusions can violate the law Even if attending a White House event is not a constitutionally guaranteed right, that doesn’t mean the government is free to take it away as a punishment. The government cannot take away even a purely discretionary privilege if the motive is to penalize speech. Even though there is no entitlement to hold a government job, the Supreme Court decided in 1966 that public employment cannot be denied on the basis of viewpoint. And even though there is no entitlement to receive a discretionary government grant, the justices ruled in 2013 that a grant cannot be denied because the applicant expresses a view different from the government’s. In other words, any action by a government agency intended to punish or deter a speaker for unwanted speech can violate the Constitution. That same legal principle would apply today if a federal official denied a government “privilege” to a journalist on the basis of a disagreeable viewpoint. In the CNN situation, if Collins lost something of value, like the ability to attend a presidential appearance, because of the content of her speech, she has the essential ingredients of a First Amendment case. The White House likely would argue that it was Collins’ method of delivery — raising her voice, after being asked not to — and not the content of her message that earned her a disinvitation. That would make a First Amendment claim blurrier. overnment agencies can regulate the “time, place and manner” of speaking, the Supreme Court has ruled, as long as the restrictions are reasonable and enforced evenhandedly. (FROM THE ARTICLE: Its a nearly-new fuel pump from a 2003 Harley Davidson with just 11,000 miles on it. How could that much corrosion happen on a motorcycle before it’s third oil change? According to my mechanic it’s ethanol in our gasoline. To understand how this happens you need to know how ethanol affects your fuel system. Ethanol itself is not particularly corrosive. When the oil companies first started blending ethanol in gas, it corroded some rubber and plastic gaskets on some cars and equipment. Manufacturers figured it out and substituted new materials. The unlucky consumers whose equipment was ruined or whose fuel systems had to be replaced just took it on the chin as per usual with most government programs. But that wasn’t the end of it. Ethanol attracts water. When the two get together, they create the perfect environment to grow a type of bacteria called acetobacter. After getting drunk on their EPA-sponsored kegger in your gas tank, the acetobacter excrete acetic acid. And acetic acid is very corrosive. If you’re refilling your gas tank every week or two, acetobacter don’t have time to grow a sufficient size colony to damage metal parts in your fuel system. But if your fuel sits for longer periods of time these microorganisms continue to multiply until your gas tank contains damaging levels of acetic acid.)

For a two-person household, it was $16,072, and for a four-person household, it was $24,755. To beat those poverty thresholds is fairly simple.
