In my defense, what about my peers who lacked job qualifications? In my defense, the Democrats who ran GAO in 1980 would not have hired me if I had not earned an MBA in 1976 and passed the CPA examination on my first attempt in 1979. Extremely few of my peers earned MBAs and/or took the CPA examination, let alone passed it on their first attempt. Further, back in 1980s, GAO’s reputation was much stronger than it is now. Further, the Democrats who ran IRS in 1971 would not have hired me if had not earned a bachelor’s degree in business and passed the Federal Service Entrance Examination (FSEE). They would not have done that if I had been a Democrat, minority, female, or veteran. My Democrat GAO superiors, supervisors, coworkers, and subordinate used my having to take a pay cut to transfer against me viciously. Qualified minorities and females could get better paying jobs in the private sector. Consequently, to retain and promote their minority and female employees, my Democrat superiors a) gave them tremendous preference and b) wasted the careers of and got rid of their Republican employees who were White and/or male. All my coworkers who they promoted over me were Democrats who were minority, female, younger than me, and/or veteran. — Why do people use pot? From what I see, overwhelmingly, it is because they have problems, because they have trouble dealing with reality, and/or because they want immediate pleasure. But pot drags you down and causes you more problems. If I had used pot, I would not have been able to a) get an ACT score of 24, b) graduate in the upper 20% of my high school class, b) earn a job-related bachelor’s degree and three job-related master’s degrees, c) pass the CPA and Certified Internal Auditor examinations on my first attempt, d) earn four more job-related professional certifications, or e) earn a job-related professional license (CPA).  I would not have been able to get jobs that enabled me to a) buy a 6-year old car when I was 16, b) buy new cars when I was 17, 19, 20, 23, 25, 29, etc., c) buy real estate when I was 24, 25, 27, 29, and 35, d) or get married when I was 29. – Dave Diersen

I took only one graduate evening business course at a time while I worked for Firestone Stores in 1971 and for IRS 1972-1976. I took only one graduate evening accounting course at a time while I worked for IRS 1976-1980 and GAO in 1980. I took only one graduate evening finance course at a time while I worked for GAO 1992-1997. I did that because of the tuition and book expenses and because wanted to keep my jobs my top priority. But consequently, I did not earn an MBA until I was 27. I did not take and pass the CPA examination on my first attempt until I was 30. I did not earn a master’s degree in accounting until I was 31. I did not take and pass the Certified Internal Auditor examination until I was 32. I did not earn a master’s degree in finance until I was 48. I did not become a licensed CPA until I was 32. But consequently, I did not earn an MBA until I was 27. I did not take and pass the CPA examination on my first attempt until I was 30. I did not earn a master’s degree in accounting until I was 31. I did not take and pass the Certified Internal Auditor examination until I was 32. I did not earn a master’s degree in finance until I was 48. I did not become a licensed CPA until I was 32. By then, it was too late.

DD: There were more than enough facts to make the Chicago Car Exchange (CCE) suspicious of the car’s claimed mileage, and therefore, to verify its claimed milage. The court left out many of those facts in its written decision. Further, CCE refused to offer to pay me the car’s loss in value because of the odometer discrepancy or the thousands of dollars of improvements that I had made to the car. The odometer exemption decision was rendered moot when the BIG THREE had Congress modify the Federal Odometer Act. I appealed the rest of the decision to the Supreme Court, but Supreme Court refused to hear it.

In a unanimous decision, the three-judge panel in Chicago ruled that Congress did not authorize the secretary of transportation to exclude older vehicles from the disclosure provisions of the Vehicle Information and Cost Savings Act, also known as the Odometer Act. Unless overturned on further appeal, the decision binds sellers of vehicles in Illinois, Wisconsin and Indiana, the three states covered by the 7th U.S. Circuit Court of Appeals. Liz Neblett, a NHTSA public affairs officer in Washington, said, ‘We are aware of the case but were not named in the suit. We are looking at the situation to see what, if anything, should be done in the future.’ The decision means a seller must provide an odometer disclosure statement to the purchaser of any car or truck, regardless of age, according to Christopher Langone, who argued the appeal for Chicago Car Exchange. His client specializes in classic and antique vehicles. ‘Dealerships, whether new or used, should give a disclosure statement with every transaction,’ Langone said. In the same decision, however, the appeals court said plaintiff David Diersen cannot press his odometer fraud claim against Chicago Car Exchange. In 1984, he paid $16,790 for a 1968 Dodge Charger R/T. He failed to present evidence that the dealership deliberately misrepresented the car’s mileage, the 7th Circuit panel said. Diersen, an auditor for the federal government, contended the disclosure statement he received falsely listed about 22,600 original miles. Instead, he asserted, the actual mileage was about 75,000. The dealership denied that the statement was inaccurate and said it had no reason to disbelieve the sworn statement of the seller. Diersen turned down the dealership’s offer to refund the full purchase price. A judge dismissed the lawsuit without trial. Diersen, representing himself, appealed. In the new decision, Appeals Judge John Coffey rejected the dealership’s argument that the Odometer Act doesn’t cover vehicles more than 10 years old. The 1988 NHTSA regulation purporting to exempt such vehicles is invalid, according to the court. ‘The text of the law does not, either explicitly or implicitly, exempt any class of motor vehicles from its odometer disclosure requirements,’ the appeals court said. Diersen has asked the appeals court for a new hearing on the fraud issue. If he loses there, ‘I’m going to the Supreme Court.’)
