(FROM THE ARTICLE: Despite a shift in public opinion toward legalizing marijuana over the past 30 years, the president’s more conservative approach to weed policy is well-known on Capitol Hill. When the Daily Beast reported late Thursday that “dozens” of young White House staffers had been suspended, asked to resign or placed in a remote work program after admitting to prior marijuana use, pro-cannabis lawmakers were dismayed Friday but hardly shocked. “It is another very vivid example of the clash between outmoded past policies, and where America is, and where America is going,” Rep. Earl Blumenauer (D-Ore.), Capitol Hill’s unofficial weed czar, said in an interview. “It’s not, probably, surprising.” Blumenauer is already putting together a letter with other lawmakers “seeking clarification” from the Biden administration on the dismissals. Many Republican and Democratic lawmakers, including Vice President Kamala Harris, have shifted their positions on cannabis legalization in recent years. But Biden — who, as a senator, shepherded the 1994 crime bill that disproportionately hit communities of color and set mandatory minimum sentences for marijuana possession — has never truly warmed to the idea. As recently as last year, Biden’s staff rejected marijuana legalization as part of the Democratic Party policy platform. It was a step backwards from 2016, when the party made history by endorsing a “pathway” to legalization. “They did not support descheduling and legalization,” said Rep. Barbara Lee (D-Calif.), a co-chair of the Congressional Cannabis Caucus who worked with the Biden campaign on the Democratic party platform last summer. She’s requesting a meeting with the administration to discuss cannabis policy, including the latest uproar about personnel. In an interview, she added that the White House’s recent actions don’t surprise her. “What this shows is the impact of those laws.” Instead of endorsing full legalization, Biden’s campaign proposed a patchwork of changes to federal drug law that would legalize, decriminalize and continue to prohibit cannabis in a variety of ways that experts say will be difficult to implement. “His approach is very piecemeal,” said John Hudak, an expert on cannabis policy and executive powers at the Brookings Institution. “It’s hard to see how that plays out.” The White House’s decision to dismiss or penalize employees for marijuana demonstrates the gap between the Biden administration and the majority of his party, who increasingly see decriminalization or outright legalization as a major criminal justice reform issue. White House press secretary Jen Psaki downplayed the Daily Beast report in a pair of tweets Friday, while saying the security screenings wouldn’t “automatically” disqualify a job candidate who had used marijuana. “The bottom line is this: of the hundreds of people hired, only five people who had started working at the White House are no longer employed as a result of this policy,” she added. Nearly all of Biden’s competitors in the 2020 Democratic presidential primary issued full-throated endorsements of federal marijuana legalization. And two years ago, angling for the White House herself, Harris, then a senator from California, joked about smoking pot. “I have … and I did inhale,” she told the hosts of The Breakfast Club about smoking in college. “It was a long time ago … I think it gives a lot of people joy and we need more joy.” On the debate stage, Biden’s primary opponents took him to task for his reluctance to embrace marijuana legalization. Criminal justice reform advocates blame the harsh drug laws championed by Biden and other lawmakers in the 1990s for locking people up on overly punitive marijuana offenses. But Biden planted himself, suggested that marijuana was a gateway drug, generating criticism that led him to walk back that statement. He also later said he did not think people should be locked up for marijuana and wanted to see marijuana records expunged — a departure from the senator who criticized Republican President George H.W. Bush’s anti-drug plan for not going far enough. “We have to join together to ensure that drug dealers are punished swiftly, surely and severely … we have to hold every drug user accountable,” Biden said at the time. Now, a third of Americans live in a state where marijuana is legal and a majority support full legalization, including 83 percent of Democrats. Congress is trending that way too: The House passed a bill to legalize marijuana in December, and the Senate plans to soon follow suit. Senate Majority Leader Chuck Schumer himself is drafting a new legalization bill and has previously promised that if Democrats led the chamber, legalization would be a priority. Sens. Bernie Sanders (I-Vt.) and Schumer have sweeping approaches to cannabis reform, while Biden’s strategy, Hudak says, is ”public policy with a scalpel rather than hatchet.” On the campaign trail, Biden touted his support for decriminalizing cannabis and moving marijuana from Schedule I to Schedule II. Marijuana is classified as a Schedule I substance, the most restrictive category alongside heroin and LSD. But his proposal suggested a lack of familiarity with federal drug laws. Attorneys, state marijuana regulators and cannabis advocates expressed confusion about his support for decriminalization and rescheduling marijuana. Cocaine and methamphetamine are Schedule II substances, and still very much criminalized. It would be difficult, though not impossible, to achieve. As the party’s nominee, Biden had new opportunities to embrace a more progressive stance on legalization, but instead dug in his heels. His attempt to bring in the progressive wing of the party through the “unity” task force with Bernie Sanders elicited compromises on policy areas like climate change, immigration and economic policy — but not on marijuana. The only concession Sanders appointees got on weed policy was to remove a budget rider preventing Washington D.C. from regulating marijuana sales. Even some of Biden’s appointees failed to move him on the issue. As head of the Democratic Party, Biden’s stance has had ripple effects. The party rejected an amendment to support legalization as an official policy plank, instead adopting a platform backing decriminalization and expungement that mirrored Biden’s stance on the issue. Harris also changed her rhetoric once she accepted the Democratic nomination as Biden’s No. 2. The lawmaker who in 2019 sponsored comprehensive legalization in the Senate suddenly shifted to touting cannabis decriminalization rather than legalization. But Biden might join his fellow Democrats in time, Brookings’ Hudak said. “We shouldn’t conflate a president who … is not a tremendous cannabis reformer, with a president who has not changed his views over time,” he said. “Biden is not where a lot of cannabis reformers would like him to be. But he’s not the Joe Biden of 1988 or 1994.”)

(FROM THE ARTICLE: James Zay had been listening for an-hour-and-half, an exasperated smile flashing intermittently across his face, before he raised his hand to speak. Zay, a DuPage County board member, was participating in a special board meeting where, one-by-one, county officials laid out the millions of extra costs they were anticipating in the coming years because of sweeping criminal justice reforms recently signed into law by Gov. JB Pritzker. “I am just sitting here astounded,” Zay said after he was called on. “I mean, this is going to have a major effect on county government and guess what, other aspects of county government are going to suffer because of this, because we don’t have the money.” The new law requires more training for officers, gives arrestees three free phone calls and makes it easier for police departments to fire bad cops. But the changes that will have the biggest impact on county budgets and court systems are the mandate that all law enforcement officers be equipped with body cameras, and the unprecedented abolition of cash bail for defendants awaiting trial starting in 2023. Zay’s fellow board member Donald Puchalski was equally worried. “Where do we go from here?” Puchalski asked. . .In DuPage, the state’s largest county outside of Cook, leaders’ early estimates are that they’re going to need dozens more prosecutors and public defenders, they’ll need to open up new courtrooms to handle pre-trial detention hearings and will need more probation officers to support the expected crush of defendants released from jail while awaiting trial. Meanwhile at the DuPage county jail, Sheriff James Mendrick estimates the number of detainees held pre-trial will drop by about a third once bail is abolished. However, he is not predicting any cost savings. That’s because the same number of people will come through and have to be processed, they just won’t be staying as long. All told, DuPage officials are predicting an additional $65 million in costs over the next five years because of the new criminal justice law. Other counties have not yet started estimating costs and savings, but many officials are expecting a big impact on their budgets. That has some county leaders worried, at a time when budgets have already been hit hard by the COVID-19 pandemic. “This is an unfunded mandate on every county in the state,” said DuPage State’s Attorney Bob Berlin. . .In DuPage, court leaders believe the impact will go well beyond budgeting. Bond funds are meant to ensure people show up for their court dates, but the money ends up being funneled into a number of different pots. Much of it goes into a county’s general fund, it’s also used to pay victim restitution and private attorneys. County leaders said the end of cash bail will result in a higher demand for public defenders, because pre-trial detention hearings will be more robust, and there may be fewer private attorneys willing to take on clients without the assurance that they can get first crack at the bond money defendants were forced to pay to win their freedom. DuPage Public Defender Jeff York said the new law will have a “profound” effect on his office, and said historically it will be the most important change since the public defender was created. ‘Does that result in a more fair system?’ State’s Attorney Bob Berlin said he is looking at changes to their training and protocols for prosecutors on how to ask a judge to deny release to defendants. He’s expecting a big increase in the number of people locked up without the possibility of release pre-trial, and an increase in the use of electronic monitoring. Berlin said he and other officials are pressing state lawmakers to pass so-called “trailer bills” to modify the language of the bail legislation and make it easier for judges to keep pre-trial defendants in jail. “We’ve accepted that we’re not going to have cash bail. But our goal, many of us are seeking just to give judges more discretion,” Berlin said. Lawmakers have said they are open to modifying language, but not willing to make any substantial changes to the legislation. With the end of cash bail, Berlin is expecting a lot more cases to go to trial because fewer defendants will feel pressured to plead guilty to get out of jail. “That means there’s a burden on victims, witnesses, police and prosecutors,” Berlin said. “Does that result in a more fair system? You know, I’m not convinced that that’s the case … I believe that most people who plead guilty plead guilty because they are guilty. I know that some believe that in certain cases, people will plead guilty just to get out of jail. I think that’s a very small percentage of people.” Berlin is asking county leaders to budget for 27 additional prosecutors because of the new law. That’s partially because of more intense pre-trial detention hearings, and the anticipation of more trials. But the biggest factor, according to Berlin, is the new requirement that all police officers be outfitted with body cameras. That means every arrest could have hours of video evidence that prosecutors will be obligated to review. Defense attorneys, including the public defender’s offices will have the same obligations. “The amount of material that we’re going to have to go through and analyze and talk about with our clients. It’s just, it’s significant,” York said. In DuPage, Berlin and Mendrick believe the elimination of cash bail will mean more missed court dates and more repeat offenders committing crimes while awaiting trial.)
