In McAllen, Texas, teachers tried to force a teenager to sing the Mexican national anthem and recite the Mexican pledge of allegiance.  She refused saying it was against her beliefs.  She was subsequently thrown out of the class and given a failing grade for the day. University of Hawaii professor, Huanani-Kay Trask has taught students “We need to think very, very clearly about who the enemy is.  The enemy is the United States of America and everyone who supports it.” University of Southern California professor, Darry Sragow, teaches hate in his Regulation of Elections and Political Finance class, telling them “Republicans are stupid, racist losers,” and that they are “angry old white people.” University of Rhode Island history professor, Erik Loomis, tweeted, “I want Wayne LaPierre’s (NRA President) head on a stick.”  He asked, “Can we define dues to the NRA as contributing to a terrorist organization?” Scott Compton, an English teacher at Chapin High School, Chapin, SC, was put on administrative leave after he allegedly threw an American flag on the floor and stomped on it in front of his students.  He chose to resign.  He probably teaches at a college now. A geography teacher at Lumberton High School in Texas encourages students to dress in Islamic clothing and actually instructed them to refer to the 9/11 hijackers as “freedom fighters.”  They were also taught that the Holocaust was not genocide.  John Valastro, the superintendent of the school district, told Fox News that the teacher did absolutely nothing wrong. The schools may defend themselves by saying they teach critical thinking…hogwash!  They are intolerant of any opinions contrary to their own and the student with the guts to stick to his/her values risks paying dearly in poor grades and harassment. What do the students have to say?  A new video is circulating asking college students if they prefer Castro or Donald Trump.  Every student in the video struggled with the answer.  One student said, “Well that’s a tough question.”  Another student said, “If Donald Trump’s administration is what he said it would be, then Fidel Castro would have been the better leader to the Cuban people than Donald Trump will be.”  Another student: “I feel that he really changed Cuba in so many ways that really made possibilities for the Cuban people nearly endless.” Our education system has created a multitude of young, inexperienced, poorly educated, indoctrinated minds, speaking as with authority…scary! This problem is not limited or unusual.  It has become widespread and is now a threat to the very framework of our country and society.  Jihadists and Socialists/Communists can access considerable encouragement and support from many of our young people today.  So much so that there should be concern for a growing 5th column ready to strike at our very heart.  We had better take heed.)

I had almost completed the requirements for a master’s degree in accounting from DePaul.  I had earned an MBA from Loyola in 1976.  Virtually all of my Democrat GAO superiors, supervisors, coworkers, and subordinates were Democrats who GAO had hired straight out of college. They had little or no work experience outside of GAO.  They wanted every GAO hire to start at the bottom like they did.  They had an extremely low opinion of executive branch employees and of union members like I had been at IRS for almost 9 years.  They exhibited an extremely low opinion my knowledge of IRS that I had gained by working for IRS for almost 9 years. They stressed that GAO had required me to accept an $18,459 (21%) pay cut in today’s dollars to transfer from IRS to GAO.)

Many of the appointees will bring different policies and different styles. Most importantly, they will represent a new President who openly and frequently spoke with disdain about the federal workforce and ran on a platform of bringing change. If you’re a senior executive, you want to survive in the new administration and you want your agency to succeed.  But dealing with the arrival of an unknown entity with an unknown agenda can be daunting. Ira Goldstein, a long-time federal executive and consultant, provided some tools for both sides in this new partnership in his recent book The Federal Management Playbook. He offered some practical advice for federal workers – things that can and must be done. To begin with, Goldstein wants to put the federal workforce at ease about dealing with Trump’s declarations about “draining the swamp.” “After 46 years in and around the federal government, I discovered even through there was a lot of publicity around our nation that government doesn’t work well, what you see after a period of time is that many things really do work well. Planes fly safely over our country. Social Security checks get out on time,” Goldstein said in an interview on the Federal Drive with Tom Temin. “Government is important. It’s not going to go away and it’s enormously complex. We’ve got to do better. We need good ‘bureaucrats’ ― skilled, committed, experienced career officials. Those who are old enough should recognize the names of Witkowski’s investigative targets: Illinois Gov. Otto Kerner, powerhouse Ald. Thomas Keane, Attorney General William Scott, Judge Reginald Holzer and John Cardinal Cody. Others will recognize the lawyers who gained prominence prosecuting them: Jim Thompson, Sam Skinner, Tyrone Fahner, Jeremy Margolis and Scott Turow. But very few are familiar with the former IRS agent whose extraordinary investigative skills made those cases — and in the process made him a legend in certain circles. Witkowski died Nov. 13 from complications of multiple sclerosis. He was 74. Never one to take bows during his lifetime, Witkowski will have to suffer these accolades in silence. “Bill Witkowski was the single best investigator I have ever known,” said veteran investigative reporter Edward Pound, formerly of the Chicago Sun-Times. I’m quoting Pound here because many people regard him as the single best investigator ever to work in my business, and it takes one to know one. But everyone who spoke to me about Witkowski offered the same sort of superlative assessment without reservation. “We wouldn’t have been able to do the prosecutions we did without him,” said Fahner, the prosecutor who convicted Keane and went on to become Illinois Attorney General and later a successful lawyer with Mayer Brown. In the 1970s and 1980s, it was the IRS that did most of the heavy lifting on political corruption in Illinois. And in that circle, Witkowski gained a reputation as the alpha dog. Many recall his unassuming style. A large man with a flat top brush cut, Witkowski looked more the part of the neighborhood guy he was than anybody’s notion of an IRS agent.)

It turns out that this depends on the jurisdiction, and on whether the business is discriminating against clients or employees. The First Amendment doesn’t apply to such private businesses (incidentally, whether or not they take government funds, see Rendell-Baker v. Kohn (1982)), and federal law generally doesn’t ban political affiliation discrimination, so it ends up being a matter of state and local law. In New Mexico, for instance, discriminating against clients on this basis is legal — but firing employees, or threatening to fire them, based on their politics is a felony. 1. Most states ban most businesses from discriminating against clients based on the clients’ race, religion, sex or national origin. Federal law does the same, though for a narrower set of businesses (and doesn’t cover sex discrimination); it also adds a ban on disability discrimination. Many states and some cities also ban discrimination based on sexual orientation, marital status and various other attributes. But political affiliation is rarely on the list. A few cities or counties do ban such discrimination. D.C. bans discrimination based on “the state of belonging to or endorsing any political party.” Seattle bans such discrimination based on “any idea or belief, or coordinated body of ideas or beliefs, relating to the purpose, conduct, organization, function or basis of government and related institutions and activities, whether or not characteristic of any political party or group,” “includ[ing] membership in a political party or group and includ[ing] conduct, reasonably related to political ideology, which does not interfere with job performance.” There are a few other places on this list. But New Mexico doesn’t ban such discrimination in public accommodations, and neither do the city of Albuquerque or Bernalillo County. One can debate whether such discrimination should be outlawed, by analogy to various other forms of discrimination. Perhaps if wedding photographers can’t discriminate against same-sex weddings (which New Mexico courts have indeed said), Internet marketing companies shouldn’t be able to discriminate against people who have particular views. Or perhaps such antidiscrimination laws shouldn’t be expanded further, or should even be cut back, to leave people free to choose whether to refuse to do business with others, whether or not we’d approve of that choice. But, as a matter of current law, such discrimination against Trump supporters (or Hillary Clinton supporters or Communists or libertarians or whoever else) is legal. 2. Many states and some cities and counties, however, do ban discrimination against employees — or at least firing of current employees — based on their political activity (with different jurisdictions defining such activity differently). I discuss this in detail in my article “Private Employees’ Speech and Political Activity: Statutory Protection Against Employer Retaliation,” but here’s the New Mexico statute, enacted in 1912, when New Mexico became a state: Coercion of employees [a fourth degree felony] consists of … any person having under his control or in his employment persons entitled to vote at any election, directly or indirectly discharging or threatening to discharge such employee because of the employee’s political opinions or belief or because of such employee’s intention to vote or refrain from voting for any candidate, party, proposition, question or constitutional amendment. Threatening an employee with dismissal because he supports Trump is thus a felony in New Mexico (and also likely a tort, so the dismissed employee can sue even if the prosecutor chooses not to prosecute).)
