(FROM THE ARTICLE: Twice since 2013, voters in the Wheaton and Warrenville area have rejected referendum proposals to raise taxes for the construction of a new preschool. Despite that, the Community Unit School District 200 board is proceeding with building a new Jefferson Early Childhood Center without voter approval through a different form of financing. But now a resident who opposes that measure has sued the district in DuPage County Circuit Court, seeking to halt the plans. Those in favor of building a new childhood center call the current 26,500-square-foot building outdated and note that the district in recent years has renovated or built anew every other school building except Jefferson. Jefferson, which was constructed in 1958 and had 277 pupils as of June, offers a traditional preschool and early childhood intervention for youths with mental or physical disabilities. Voters rejected a referendum proposal for a new Jefferson school in 2013, and again said no in 2017 as part of a much larger, $132 million proposal involving other district schools as well. Board President Jim Vroman said that after the 2017 referendum proposal failed, the district surveyed voters and found that “a substantial majority” supported building a new Jefferson. “That told us that voters were against the tax increase that the referendum would have generated if we had proceeded,” he said. Instead, the board agreed with a suggestion by a district financial adviser to use lease certificates, or secured lease credit financing, to fund a new Jefferson. District 200 would oversee construction of the estimated $15.5 million, 41,544-square-foot building, while Zions Bank would own the building. . .Frequent board critic Janet Shaw, who runs a blog that scrutinizes the district’s finances, long has questioned the legality of using lease certificates and added that “my real problem is that we don’t need (the new school building).” Shaw has filed suit against District 200, demanding a halt to the current plan to finance a new Jefferson. She is seeking a judge to require District 200’s board to submit a proposal for the new school building to the public via a referendum question. “District 200 is tampering with election results right here in DuPage County,” Shaw said. “The district thinks that by using the magic word ‘lease,’ its two failed referendum efforts and the will of the community are somehow erased and it can proceed in an identical manner as if a referendum had been adopted by the community to build and finance a new school.” A district spokesperson declined to comment on the lawsuit. Dan Wagner, a parent and longtime proponent of a new Jefferson, called the existing building outmoded, with some instruction occurring in converted broom closets. He added that the building lacks air conditioning, which precludes some special needs pupils from participating in gym classes.)

(FROM THE ARTICLE: The University of Wisconsin System violated federal law when it refused to hire a former longtime employee because of her age, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed. According to the EEOC’s lawsuit, Bambi Butzlaff Voss, who was 53 years old and subject to a layoff from her job as a Marketing and Communications Specialist at the University of Wisconsin’s Waukesha campus, applied for six different positions with the University of Wisconsin System’s central office in Madison, including an Associate Marketing and Communications Specialist position. Butzlaff Voss had 25 years of experience performing tasks similar, if not identical, to the ones in the position she applied for. But, because of Butzlaff Voss’s age, the University refused to hire her. Instead, it hired a 23-year-old candidate with less than two years of experience. Such alleged conduct violates the Age Discrimination in Employment Act of 1967 (ADEA). The EEOC sued in U.S. District Court for the Western District of Wisconsin (EEOC v. Board of Regents of the University of Wisconsin System, Civil Action No: 3:18-cv-00602) after first trying to settle through its conciliation process. The lawsuit asks the court to order the University to hire Butzlaff Voss and provide back pay as well as pay liquidated damages. The lawsuit also seeks a permanent injunction prohibiting the University from discriminating against future candidates based on their age. “The Age Discrimination in Employment Act has been on the books for five decades,” said Gregory Gochanour, regional attorney for the EEOC’s Chicago District. “The EEOC will make sure employers follow the law, even if it means going to court to get the message across.” Julianne Bowman, district director of the EEOC’s Chicago District, said, “Workers over 40 years of age should have the same opportunities as those workers less than half their age. Ignoring a candidate’s decades of experience relevant to the available job, because of her age, to hire someone with less than two years of experience is illegal discrimination.”)

(FROM THE ARTICLE: As long as reporters have covered government officials, they’ve sought greater access than the government was willing to allow. The White House excluded a CNN reporter from an international trade announcement with the president of the European Commission on July 25, in apparent retaliation after she shouted unwelcome questions at President Donald Trump during an Oval Office appearance. Many observers viewed this move as an escalation of the Trump administration’s hostility toward journalists. The Washington Post called the decision to exclude CNN’s Kaitlan Collins “highly unusual and possibly unprecedented.” Sen. Richard Blumenthal, D-Conn., called it “an offense against the First Amendment interests of all of us.” But did the White House actually violate the Constitution? As a media law professor, I regularly remind students that the First Amendment right of access to government officials, records and events is surprisingly uncertain. The First Amendment guarantees all Americans freedom to speak and publish without government interference. It has been broadly interpreted by the Supreme Court to forbid the government from restraining or punishing a speaker based on the content of the speaker’s message. While journalists have a clearly established First Amendment right to publish the news they’ve gathered — even in extreme cases, like the leak of stolen Pentagon documents — it’s much less clear that the First Amendment protects the right to gather the news in the first place. A right to publish, but not a ‘right to gather’? CNN has not indicated that it plans to take any legal action over Collins’ exclusion. In addition to being awkward — imagine a journalist taking the witness stand to testify against the White House communications director — a court case over a withdrawn invitation would face legal obstacles. The courts have refused to recognize an overarching “constitutional right of access” to government information. Instead, they have picked off cases with narrow, specific rulings. For instance, the Supreme Court recognized in Richmond Newspapers v. Virginia that there is a constitutional right to cover a criminal trial. Likewise, federal appeals courts agree the First Amendment guarantees the right to videotape police making arrests in a public place. At the same time, judges have found no constitutional right to obtain government documents or to enter crime scenes that are off-limits to the public. Does CNN’s White House correspondent, or any journalist, have a First Amendment “right” to a press pass or a spot at a news conference? Since the Supreme Court said in its 1972 Branzburg ruling that journalists have no right to insist on greater access than the general public, probably not. That being said, journalists do have a right not to be retaliated against, regardless of what form the retaliation takes. Retaliatory exclusions can violate the law Even if attending a White House event is not a constitutionally guaranteed right, that doesn’t mean the government is free to take it away as a punishment. The government cannot take away even a purely discretionary privilege if the motive is to penalize speech. Even though there is no entitlement to hold a government job, the Supreme Court decided in 1966 that public employment cannot be denied on the basis of viewpoint. And even though there is no entitlement to receive a discretionary government grant, the justices ruled in 2013 that a grant cannot be denied because the applicant expresses a view different from the government’s. In other words, any action by a government agency intended to punish or deter a speaker for unwanted speech can violate the Constitution. That same legal principle would apply today if a federal official denied a government “privilege” to a journalist on the basis of a disagreeable viewpoint. In the CNN situation, if Collins lost something of value, like the ability to attend a presidential appearance, because of the content of her speech, she has the essential ingredients of a First Amendment case. The White House likely would argue that it was Collins’ method of delivery — raising her voice, after being asked not to — and not the content of her message that earned her a disinvitation. That would make a First Amendment claim blurrier. overnment agencies can regulate the “time, place and manner” of speaking, the Supreme Court has ruled, as long as the restrictions are reasonable and enforced evenhandedly. (FROM THE ARTICLE: Wheaton voters will elect the city’s first new mayor in 12 years next spring, and two city council veterans already have announced bids for the post. Mayor Michael Gresk is stepping down after three terms, clearing the path for a new leader to take the city’s helm. John Prendiville and Phil Suess have emerged as the first two mayoral candidates seeking to succeed Gresk, who first was elected in 2007. Prendiville served on the council from 2007 to 2011 and again since 2013 after an unsuccessful run to unseat Gresk as mayor. His at-large seat on the council also is up for election in April 2019. Suess ran unopposed last year to retain his seat representing the North District. His fourth term on the council doesn’t expire until 2021. Councilwoman Suzanne Fitch said Wednesday she intends to seek re-election to the other at-large seat. Candidates will begin filing their nominating petitions for the city’s municipal offices in November. Prendiville is the managing director and senior managing counsel for The Bank of New York Mellon Corporation, a firm that acts as a trustee for municipal bond issues. If elected, he said his background will serve him in helping to keep the city on “very good financial footing” since Wheaton weathered the economic recession. “The type of work I’ve done in the legal world is not adversarial. I’ve always been part of transactions where people are working together toward a common goal,” he said. That consensus-building work will translate to leading city council meetings that, under Gresk, are orderly and on track, Prendiville said. “I want to be a leader of this intelligent and dedicated group,” Prendiville said of his council colleagues. In his last mayoral run as Gresk’s challenger, Prendiville said he visited “at least 80 percent of homes” of municipal election voters. But he said Gresk “deservedly” had “a tremendous amount of support.” Gresk captured 57 percent of the vote. “I wasn’t running against him. I was just running because I was a little bit ambitious there,” Prendiville said. Suess is a partner in an investment consulting firm. He said his 14-year tenure on the council makes him the best candidate for the office. “I just think it’s the consistency of positions over time,” said Suess, who has lived in Wheaton for 30 years. “I’ve been a very strong advocate of living with the money we have.” He’s also sat on the DuPage Water Commission board for the past eight years. Wheaton is the second-largest customer of the agency that supplies Lake Michigan water to most of the towns in DuPage County. “I joined that commission in August of 2010 when they were basically in the depth of their problems with respect to their debt and have been part of the team that has turned around the water commission since January of 2011,” Suess said. Fitch said she’s running for a second term to continue addressing flooding and economic development issues as the council’s liaison to the Downtown Wheaton Association, a group of shops and restaurants. An attorney, Fitch highlighted her push for a new program to install sidewalks in neighborhoods for kids to walk safely to and from school. She also was a vocal supporter of lowering the speed limit on residential streets from 30 mph to 25 mph. The new limit went into effect Aug. 1. “I’ve been responsive to resident concerns, and I’ve really taken the time to engage the residents to address their issues,” Fitch said. (FROM THE ARTICLE: Its a nearly-new fuel pump from a 2003 Harley Davidson with just 11,000 miles on it. How could that much corrosion happen on a motorcycle before it’s third oil change? According to my mechanic it’s ethanol in our gasoline. To understand how this happens you need to know how ethanol affects your fuel system. Ethanol itself is not particularly corrosive. When the oil companies first started blending ethanol in gas, it corroded some rubber and plastic gaskets on some cars and equipment. Manufacturers figured it out and substituted new materials. The unlucky consumers whose equipment was ruined or whose fuel systems had to be replaced just took it on the chin as per usual with most government programs. But that wasn’t the end of it. Ethanol attracts water. When the two get together, they create the perfect environment to grow a type of bacteria called acetobacter. After getting drunk on their EPA-sponsored kegger in your gas tank, the acetobacter excrete acetic acid. And acetic acid is very corrosive. If you’re refilling your gas tank every week or two, acetobacter don’t have time to grow a sufficient size colony to damage metal parts in your fuel system. But if your fuel sits for longer periods of time these microorganisms continue to multiply until your gas tank contains damaging levels of acetic acid.)
