(FROM THE ARTICLE: As I, and most of America, get more nauseated by the political scene each day, something else arises. We, of Illinois, are the victims of a state with little hope. Last month, it was announced Illinois ranks 50th in the financial stability of all the states. We have no budget as I write this. We have no cooperation between the governor and the legislature. We have no money. All we have is self-righteous rich men and women running our state into utter bankruptcy. Is the general public rich or poor? I suppose that depends on the definition of rich. Obviously, this also depends on the person who is defining the term. If a person is on Social Security, public assistance, or is unemployed, someone earning $30,000 is rich. If one is a professional earning $150,000 per year, then the multimillionaire is rich. And if you are Gov. Rauner who has millions, then Bill Gates is rich. It is all in the point of view. So, let’s be fair. Let’s say the well-off person is from a family that nets after all deductions and itemizations more than $50,000. Then, let’s say the present budget impasse between Michael Madigan and Rauner is on the proposed increase in the Illinois income tax rate. The House, with the help of 15 Republicans, passed Madigan’s bill increasing the state income tax for individuals from 3.75 to 4.9 percent and the corporate tax from 5.25 to 7 percent. We are a broke state. Do we tax more or spend less to get out of debt? That is one of the major differences between the political parties today. Democrats want to tax the rich more and keep programs going. The Republicans want to “lower” everyone’s taxes (mostly theirs) and cut spending everywhere. So, who is right? Rauner wants to redo the worker’s compensation system, something that was fought over forever 50-plus years ago. Rauner wants to cut Medicaid and fees charged by doctors. He wants to leave Illinois taxes low. Remember, not that long ago, we actually paid 5 percent state income tax. Let’s look at who really gets help if we do not raise state taxes. Take a $50,000 family. If the tax stays at 3.75 percent, the family pays $1,875 in Illinois tax. If it goes to 4.9 percent, the family pays $2,450 or $575 more. But if you are in the 20 percent Federal tax bracket and itemize, you save $115 on your Federal tax because your state income tax is another deduction. So, this bill that passed the House cost this family $460. Yet, it is predicted across the state such an increase would bring the state $4.3 billion. The increase in the corporate rate from 5.25 percent to 7 percent would bring in another $460 million. So, the middle income family pays an added $460 per year. Who do you think really pays the balance of the $4.3 billion? The super-rich. The Rauners and the Pritzkers. The very people who want to run the State of Illinois.)

These workers remain unemployed for longer periods than do younger workers and are more likely to leave the workforce entirely. The rise of long-term joblessness among middle-aged Americans is straining public resources, contributing to drug use and harming economic growth. What can be done? Paradoxically, federal laws against age discrimination also discourage companies from taking a chance on older job applicants. That’s why the key to helping older workers find jobs is to reduce the costs of letting them go. The United States has been a global leader in protecting workers from employment discrimination on the basis of age. The federal Age Discrimination in Employment Act (ADEA) and similar state laws bar employers from treating older workers differently than their younger counterparts with respect to wages, benefits, and other working conditions. These laws have had a largely beneficial effect for older people who already have jobs. But they make it harder for the unemployed to find work. Companies tend to assume that older job applicants will be problematic employees. Older workers often must adjust to lower salaries than they’re accustomed to and may bristle at working for younger supervisors. Because older workers belong to a protected class under age-bias laws, employers face potential legal action if they attempt to fire disgruntled or unproductive employees. The easier route is to avoid the problem altogether — and not consider job applicants over the age of 50. There are essentially two ways to deal with this problem: sticks and carrots. The most readily available sticks are lawsuits filed by job applicants who believe they’ve been victimized by age bias. But such an approach can only go so far. The law gives employers considerable latitude when it comes to hiring decisions, and effective challenges to hiring bias are extremely rare. Job seekers are not told why their applications are unsuccessful; even when employers adopt across-the-board rules against hiring older workers, such discriminatory policies are rarely written down and thus difficult to prove. Carrots are more effective. Specifically, the government should allow for wider use of “safe harbors” – essentially administrative rules that give employers a risk-free opportunity to hire older workers and then evaluate whether the perceived drawbacks actually materialize. The agency responsible for enforcing the federal statute barring age discrimination is the Equal Employment Opportunity Commission. The EEOC has the authority to grant exemptions, also termed safe harbors, from the ADEA. Early on in the agency’s history, the EEOC promulgated safe-harbor-type guidelines to encourage affirmative action programs and careful use of aptitude tests. The U.S. Supreme Court itself announced a kind of safe harbor in its 1998 rulings telling companies when they will be held liable for sexual harassment committed by supervisors (and when they likely will not). The safe-harbor approach could be used to experiment with ways to overcome hiring barriers confronting older workers. For example, the EEOC could declare that job applicants may be hired for a two-year probationary period. Workers employed under the safe-harbor authority would be protected by all other laws, including laws against harassment and unequal benefits. But if an employer chose to terminate them during the probationary period, the employees would not be permitted to challenge the decision in court. If this safe-harbor approach proved effective in helping older workers find jobs, the EEOC could consider extending it to other groups who face obstacles in the hiring process. These might include people with certain physical disabilities, such as blindness, that are costly to accommodate, or workers with criminal or credit records. Use of the safe-harbor provision provides a way to promote anti-discrimination objectives without any serious downside. It would give older Americans left out of the labor market a chance to persuade employers they can be productive contributors to the new workplace.)

(FROM THE ARTICLE: Add Illinois to the list of states that are balking at turning over massive amounts of voter data that is normally kept private to a commission chaired by Vice President Mike Pence. In an interview, Ken Menzel, general counsel to the Illinois State Board of Elections, said the board this morning finally received a written request from the Presidential Advisory Commission on Election Integrity. The commission says it’s trying to prevent voter fraud; Democrats say it is attempting to drive down voter turnout among progressive voters. The request was mistakenly sent to Secretary of State Jesse White, whose office passed it on to the board. Menzel said the matter will be researched and referred to the board for possible action. But the board doesn’t meet until Aug. 22, Menzel added, so nothing is going to be happening soon. And it’s clear that at least some requested data will not be going to the feds. “They’re certainly not going to get the last four numbers of (each registrant’s) Social Security number,” he said. “We don’t give that out to anybody.” Some other information—the commission asked for past military records, felony convictions and other data—may be possible, Menzel indicated. (FROM THE ARTICLE: A massive portion of Obamaphone recipients are receiving the benefit after lying on their applications, according to a new 90-page report from the Government Accountability Office (GAO). An undercover sting operation showed ineligible applications were approved 63 percent of the time, and a review that found that 36 to 65 percent of beneficiaries in various categories had lied in easily-detectable ways but were approved anyway. The fraud reached unheard-of proportions because the Federal Communications Commission let the task of screening for eligibility fall to phone companies that profit off of enrolling as many people as possible. GAO undercover investigators applied for free government phones 19 times using criteria that should have been rejected, and “we were approved to receive Lifeline services by 12 of the 19 Lifeline providers using fictitious eligibility documentation.” All someone has to do to apply for free cell phone service is say that they are on another welfare program, such as food stamps or disability, known as SSI. But nationwide, “only 35.5 percent of people claiming eligibility based on SSI could actually be confirmed as eligible,” the GAO found. That means 64.5 percent of people appear to have lied and may not even be poor. The rate at which GAO’s undercover applications were approved works out to a nearly identical figure as the SSI metric. The FCC took applicants at their word and did not consult intra-governmental databases to see whether they were actually on SSI. In Georgia, the percentage who appear to have lied about their SSI status to attain benefits is 79 percent. That national rate of 64.5 percent is three times higher than the next-highest fraud-ridden federal program, the Earned Income Tax Credit, at 24 percent, according to PaymentAccuracy.gov. Yet because the FCC doesn’t run data checks necessary to uncover fraud, it officially reports an improper-payment rate of 0.45 percent — a clearly implausible figure that would make it the second-cleanest program in government. Democratic Sen. Claire McCaskill of Missouri requested the audit after she received a mailer at her home encouraging her to sign up for what it assured was a “free” phone. She called for criminal charges against phone company executives. “Universal service fees” cell phone subscribers pay on their monthly bills supplies the money for the program, formally known as Lifeline, rather than funding from Congress. The Anti-deficiency Act prevents agencies from spending more than funds appropriated by Congress, so the move effectively allowed the FCC unlimited spending. Mignon Clyburn, the daughter of South Carolina Democratic Rep. Jim Clyburn, headed the FCC for much of the period scrutinized, and she remains a commissioner. “While the Anti-deficiency Act applies to appropriated funds, since 2004, Congress has exempted the USF from the Anti-deficiency Act,” GAO said. Special interests have aggressively employed a bootleggers-and-Baptists model, with companies who profit greasing the wheels of government with donations and influence-peddling and using poor people as props in marketing campaigns. When Congress considered reforms, phone companies took out daily full-page ads in publications read by Capitol Hill staffers. The wife of the CEO of TracFone, the largest beneficiary of Obamaphones, was a mega-fundraiser for former President Barack Obama. A Republican operative who later worked for President Donald Trump’s campaign took money from phone companies and set up a front group that implied that veterans would die if free phones came with more scrutiny. In an infamous YouTube video during the 2012 presidential campaign, a woman said she would vote for Obama because “he gave us a phone,” adding that “everybody in Cleveland low minority got an Obamaphone.” The cause of the fraud rates, shocking even by federal government standards, was always clear: The FCC allowed companies with a profit motive to sign up as many people as possible to determine eligibility. Phone companies swooped into housing projects in vans with neon flashing lights to register users. A woman approached by one such representative outside of a welfare office told The Daily Caller News Foundation Investigative Group the man encouraged her to enroll her two-year-old. The companies weren’t checking eligibility, and the FCC wasn’t ensuring they did or punishing those who didn’t. Additionally, the FCC failed to provide many companies with the intra-government databases that would give them the ability to perform some checks, the GAO found. The program “relies on a ‘pay-and-chase’ model of oversight. ‘Pay-and-chase’ refers to making disbursements on the front end and relying on audits or reviews after the funds have been disbursed to check for any noncompliance,” GAO said. Only no one was doing much checking. “These reviews are fairly limited,” GAO said. “FCC awarded a contract to … improve the oversight and operation of universal service programs. However, FCC officials told us that FCC subsequently terminated the contract and the study was not conducted.” When GAO focused on the program and analyzed data, investigators quickly found numerous red flags, any one of which could have been used to deny eligibility, but no one used them. “We found a total of 5,510 potential internal duplicates whereby the last name, first name, date of birth, and last four digits of the SSN of one record matched another record exactly,” GAO wrote. More than 6,300 recipients were in government databases that showed the phone recipient as being dead. The only available evidence was that the poor didn’t need the program, and it might not have been fulfilling its stated mission. The FCC has declined to assess whether the program actually provides phones to low income citizens even in the face of previous negative audits. For a time, there were more Obamaphones in Maryland than there are poor people in the state. And a Pew Research Center report found that the problem of lack of access to technology is far less than it once was, the GAO noted. The FCC’s own data shows that “millions of Lifeline-eligible households are obtaining voice service without Lifeline,” while the fraud rates show that many of the people who do sign up are wealthier than those who don’t. “While some academic studies have raised questions whether Lifeline is a costly and inefficient means of achieving universal service, FCC has not evaluated the program to determine whether it is efficiently and effectively meeting its goals, as we recommended in our March 2015 report,” GAO chided. Instead, the program is being expanded to include free internet.)

Even before her announcement, behind-the-scenes efforts to replace Radogno were being made by state Sen. Besides the political battles, Radogno also had some personal tragedies during her tenure, including the June 2014 death of her 31-year-old daughter, Lisa. In a stunning—but not wholly unexpected—development, Sen. Christine Radogno of Lemont said she will step down as a senator and the Senate GOP leader on the same day the state’s new fiscal year will begin, quite likely without a budget in hand. “I have done everything I can do to resolve the state’s budget crisis,” Radogno said in a statement after meeting with her caucus. “I will continue to do so for the coming days. But if the solution will not come on my watch, I hope and pray that the governor, other legislative leaders, Democrats and Republicans in the Senate and House can find a path to solve the state’s problems.” She added: “Though I leave political office with a sense of sadness and some disappointment, I leave with no regrets. I did my best; that’s all I could do.” There was no immediate word on a replacement. Her departure clearly will not help resolve a heavily bitter and personal fight between two strong-willed men at the center of the budget battle: Gov. Bruce Rauner and House Speaker Mike Madigan. Along with Senate Democratic Leader John Cullerton, who has denied rumors about his impending resignation, Radogno crafted a “grand bargain” package that represented the only forward movement in years on a budget. While it never did come to a vote, it formed the basis of the budget and tax-hike plan that Cullerton sent to the Senate, and which now is pending in the House. Perhaps Radogno’s announcement will kick something into high gear in the hours that remain before July 1. But the signs at the moment aren’t great.)
