(FROM THE ARTICLE: Did you know that patronage hiring is illegal in Illinois? Well, it is.  A 1972 court order prohibits political hiring for non-political state positions. It’s been ignored too often for many of the last 45 years, but it’s still in effect, and we now have a governor who wants to abide by it and thinks it should be enforced. The big problem for Bruce Rauner is that state employee rolls are already riddled with patronage hires and any attempt to identify them and weed them out is going to be resisted by the public employee unions to which they belong. In 2014, Federal Magistrate Judge Sidney Schenkier, who is overseeing ongoing proceedings in the case (Shakman) that led to the 1972 court order, appointed Noelle Brennan as a special master to investigate the hiring practices of the Illinois Department of Transportation (IDOT). On April 24 of this year, Special Master Brennan reported that state officials (including Rep. Jay Hoffman of Belleville and Sen. James Clayborne of East St. Louis) had abused a special hiring exemption to place at least dozens of friends, family, and supporters into so-called “staff assistant” positions at IDOT and other state agencies, in violation of the 1972 court order. “The governor’s office [in the previous administration] received, reviewed, forwarded, and tracked resumes,” Brennan affirmed; “most of those candidates had a political connection; and many of the politically connected candidates hired … lacked any policy or other relevant experience.” The following day, Gov. Rauner  filed a “motion for clarification” in Chicago federal court, asking for guidance as to whether state employees improperly hired through political connections can use collective bargaining agreements to remain in their positions, transfer to others, or be promoted. In other words, do the state’s collective bargaining agreements and related labor relations documents trump the court decree prohibiting patronage hiring? The abuses perpetrated by Pat Quinn, Mike Madigan, and other insubordinate public servants need to stopped.)

A recent Gallup poll found that fewer Democrats are proud to be Americans. That would have posed a “clear conflict of interest” when those government bodies had cases before him in traffic court, he says. Because of those contracts, he says it would have been “a violation of the highest order of the ethical rules governing judicial conduct if I heard traffic court cases” and also if he presided over criminal cases. Generally in such cases, Illinois Supreme Court rules say, “As soon as the judge can do so without serious financial detriment, the judge should divest himself or herself of investments and other financial interests that might require frequent disqualification.” Cooke says he tried unsuccessfully to get his partners to buy him out but doesn’t think he needed to divest himself of his business interests because that would have caused him serious financial harm. He also says his brief stint in traffic court proved difficult because he’s dyslexic. “Using acronyms or reading handwritten cursive or sloppy printing is very difficult for me,” he says. “I had tremendous difficulty reading the handwritten tickets and charges that were the basis of why the defendant were in court.” To run for judge, Cooke had moved from River Forest to an apartment he owns above his law office near the Logan Square CTA train station. That qualified him to run last year in the county’s Sixth Judicial Subcircuit.)

(FROM THE ARTICLE: President Donald Trump included a signing statement when he signed the spending bill that funds the federal government through September that effectively puts an end to affirmative action when it comes to taxpayer-funded grants. Imagine that, treating Americans equally. Pointing to the Constitution, the president said he will treat programs established by Congress that give preferences based on race and sex for grants “consistent with the requirement to afford equal protection of the laws,” the USA Today reported. Provisions described as “impermissible forms of congressional aggrandizement in the execution of the laws.” The signing statement reads: “My Administration shall treat provisions that allocate benefits on the basis of race, ethnicity, and gender in a manner consistent with the requirement to afford equal protection of the laws under the Due Process Clause of the Constitution’s Fifth Amendment.” The Daily Mail reported on programs named in the statement: “The signing statement specifically mentions a $654 million set-aside for Native American and Native Alaskan housing block grants; a $34 million appropriation for the Commerce Department’s Minority Business Development Agency; more than $20 million to guarantee loans to historically black colleges and universities; and $15 million to boost payments to ‘native Hawaiian’ defense contractors.” All of which is sure to have minority groups and women crying foul… while millions of white American males feel a little more equal today. For the record, signing statements are not exclusive to the Trump presidency. The Washington Times reported that “Presidents [Barack] Obama and George W. Bush issued dozens of ‘signing statements’ spelling out areas where they disagreed with congressional intent in various legislation, and asserting their executive authority to carry out the law as they saw fit.” Other areas addressed on Friday include weapons programs, state and local marijuana laws and Guantanamo Bay.)
