(FROM THE ARTICLE: The second addition to Chapter 63 establishes investigative leave and notice leave by adding Section 6329b. The investigative leave is for use when an employee is under investigation. The notice leave is for use when an employee has been placed on notice of an impending adverse action. These two forms can be used independently or notice leave can follow a period of investigative leave if an adverse action is proposed at the conclusion of an investigation. To use these forms of leave, the agency must determine that the employee’s continued presence may: Pose a threat to the employee or others; Result in the destruction of evidence relevant to an investigation; Result in loss of or damage to Government property; or Otherwise jeopardize legitimate Government interests. The agency also must consider the following alternatives before using either investigative leave or notice leave: Assigning the employee to duties in which the employee no longer poses a threat described in the preceding paragraph; Allowing the employee to take another form of leave for which the employee is eligible, e.g., annual leave; Carrying the employee in absence without leave status (AWOL) if the employee is absent from duty without approved leave; and Curtailing the notice period for an employee subject to one if there is reasonable cause to believe the employee has committed a crime for which a sentence of imprisonment may be imposed; and find that none of these options is appropriate. Generally, investigative leave may be granted for a period of 30 days, but extensions for up to 90 days are possible when approved by the agency’s Chief Human Capital Officer or his designee. Extensions, in 30 day increments, beyond the 90 day total are possible if the agency submits a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives, along with any other committees of jurisdiction. Notice leave will be granted only for the duration of the prescribed notice period. Here, too, OPM will issue regulations to guide agencies in utilizing investigative and notice leave by the September date mentioned above.)

For 31 years, Roger Claar has served as Bolingbrook mayor.  He’s on the ballot again Tuesday. But he’s facing a serious challenge from Jacqueline Traynere. Claar hosted for Trump last fall.   The big money event was held at the village-owned Bolingbrook Golf Club, or as some residents call it, “Rog Mahal.” “You’re bringing in somebody who talks negatively about the minorities in our community, who disrespects the message on the Statue of Liberty, who just spews hate,” Traynere said. Bolingbrook voted overwhelmingly for Hillary Clinton and Traynere is pounding Claar for backing Trump. Today, Claar hit back. “She’s an opportunist. She’s running because of the Trump fundraiser,” he said. “I doubt she would have run otherwise.  I’ve had many people tell me, ‘I was disappointed, but I’ve forgiven you.’” The race has also turned personal. Traynere claims the mayor was unprofessional and rude to her when raised questions about violence against women. “I do believe that we have a domestic violence issue that’s pretty high profile in our community,” she said. “He requested the meeting to tell me to sit down and shut up. This is the kind of mayor that we have in this community. If he doesn’t like what you have to say he tells you to sit down and shut up. He’s a bully.” The mayor told WGN News he doesn’t recall the conversation. “I don’t bully. I’m a bully for Bolingbrook. I stand up for Bolingbrook,” he said. Traynere has also made Bolingbrook’s debt an issue in the campaign. “Two years ago, we only owed $180 million. As of June of last year, we owed $316 million,” she said. Mayor Claar admits the village is adding debt, but he says it’s being used for crucial infrastructure investments. He says Traynere  may serve on the Will County Board, but she has no municipal experience. “She’s saying nothing about what she’s going to do except for saying hate me and called me a bully. Now, is that a good platform? I guess we’ll see Tuesday.” Mayor Claar says he does not regret the Trump fundraiser.)

Aaron Schock’s attorneys say the staffer who was wired for sound was his Peoria district office manager. Although not named in this week’s new Schock court filing, the only district manager during that time period was Bryan Rudolph, a political science and government degree-holder from Wheaton College. Prosecutors are likely to make Rudolph a key component of the government’s corruption case against former Schock, unless Schock’s lawyers can stop it. It was obvious from the time Schock was charged that federal agents had help from inside. His lawyers now claim in a new filing this week that Schock’s Peoria district manager “covertly record private conversations with and between Mr. Schock and his staff;” claiming the manager “stole” thousands of email messages and illegally took congressional office records. The manager then, whom the I-Team identified as 32-year-old Bryan Rudolph, consented to be an informant only after Schock had announced his resignation in March 2015, according to the defense filing. Rudolph, whose resume states that he began working for the federal government’s Social Security Administration in 2007, did not return messages or answer emails on Thursday concerning the undercover work or claims that evidence he gathered had been illegally obtained. Schock’s attorneys rip the government’s use of the staffer-turned-informant; in the court record they say that he broke the law by stealing information from the Illinois Republican’s files. They call it a trail of improper – if not outright illegal – acts. Schock is accused of numerous federal corruption charges including wire and mail fraud, theft of government funds and falsifying federal election filings. Prosecutors say he pocketed thousands in improper vehicle reimbursements, camera equipment and proceeds from selling tickets to the World Series and Super Bowl. Attorneys for Schock plan to ask that the case be thrown out because of how the informant evidence was gathered – or at least that the evidence collected by the office manager be barred from trial.)

Republicans later tweeted about Mendoza’s “loaded,” luxurious ride. The implication is that state government may be broke, but Mendoza’s living large on the taxpayer’s dime. Mendoza was furious, saying in a counter-tweet that the Illinois Republican Party was “creepily stalking me.” It’s the latest flap between Republican Gov. Bruce Rauner and Mendoza over who’s doing the most to look out for taxpayers. But does the GOP’s charge really hold up? Rauner’s main ride is newer, larger and more expensive. It’s a Ford Expedition XLT with extended length. It was purchased new, last December, by state police, at a cost $54,000. That is 67 percent more than Mendoza’s car. A Rauner spokesperson points out state police purchased the new vehicle – not Rauner’s office – even though the governor uses it. State police, of course, report directly to the governor.)

Rodney Davis was asked whether members of Congress should get their health care coverage under the Affordable Care Act. We do, he said. And he pays more for it than he did under a previous program, with a higher deductible and a higher out-of-pocket maximum cost. “I’m part of the only group that has to, by law, has to get their benefits through the Affordable Care Act for health care,” Davis said. “I actually follow more stringent requirements than the Obama White House did. The Obama White House didn’t have to get their health benefits through the Affordable Care Act exchange like members of Congress and members of the Senate do. They were able to join millions of federal employees through the federal employee health benefit program.” Davis didn’t say it, but the reason for the disparity is that’s the way Congress wrote the law. “For a long period of time,” said Sen. Chuck Grassley, R-Iowa, “it seemed to me that members of Congress needed to be subject to the laws they pass for the rest of the country.” Davis didn’t sound pleased about his enrollment under the ACA. “We don’t get any special benefits. We do have to follow the health care benefits of the Affordable Care Act where every other federal employee does not,” he said. Members of Congress are enrolled under the ACA’s gold tier plan offered by the DC Health Link. According to the Congressional Research Service, the average employer contribution — which comes from taxpayers — is 72 percent. Davis has family coverage under the ACA, and it’s more expensive, with a higher deductible, than what they had before the ACA under the Federal Employees Health Benefits program. Or is the 1% Jewish?” the flier questions. The university acted swiftly, issuing a statement March 15, the same day the fliers were found on campus. “Such actions do not reflect the values we hold as a community. Acts that invoke hatred or violence toward members of our community will not be tolerated on our campus,” campus officials said. “We strongly encourage all members of our university to exercise their right to free speech in a manner that recognizes these principles and avoids prejudice or stereotypes,” they added. Despite the campuswide statement, more anti-Semitic fliers were found posted on campus over the weekend. One discussed “Jewish privilege” with regard to “the special privilege when it comes to top universities.” Another linked the de-hiring of Professor Steven Salaita with then-Chancellor Phyllis Wise’s meeting with “a wealthy Jewish Donor in Chicago.” A third criticized jail time for those who deny the Holocaust. Still another flier equated Auschwitz with Gaza, claiming the “largest Concentration Camp in the world today is owned and operated by Zionists.” While the fliers did not identify the student or organization responsible, they did include various hashtags: #BlackLivesMatter, #WeAreAllMuslims, #WhitePrivilege and #StandwithPalestine. Student Eva Zeltser, who posted images of the fliers on Facebook, said her “heart is broken.” “While I try to abstain from writing personal narratives on Facebook, enough is enough,” she stated. “If you are against hate crimes against one group, you should be against these acts of violence for ALL groups. Found all over the UIC campus. Things like these posters are actively posted to catalyze anti-Semitism and increase hate toward Jews.” The incident at the University of Illinois at Chicago comes as a strong uptick in anti-Semitic incidents on campuses nationwide has been observed. UIC Levine Hillel Center’s Executive Director Rabbi Seth Winberg condemned the posters in an email to The College Fix, noting they have caused anger and sadness. But it could easily recur. Even now, an internal IRS rule singles out applicants for nonprofit status who might be tied to anything newsworthy. The genesis of the targeting scandal was Section 7.29.3 of the Internal Revenue Manual. As noted in a report my organization is issuing Wednesday, this manual dictates how IRS employees handle everything from customer service to criminal investigations. This particular section tells them to flag for further review any application for tax-exempt status that might “attract media or Congressional attention.” That’s a broad, vague and subjective command that career IRS employees are nevertheless required to follow. Emails between IRS personnel make clear that low-level employees were guided by this rule throughout the targeting scandal. They repeatedly cited “media attention” on the Tea Party as the reason to single out and delay applications from conservative groups. This rule means that IRS enforcement reflects the ideological biases of the media. Aside from a small number of groups related to the Occupy Wall Street movement and the defunct advocacy group Acorn, libertarian and free-market groups were almost exclusively targeted. These provisions of the IRS manual have nothing to do with the merits of a nonprofit application and everything to do with keeping the agency from looking bad. It is inappropriate for a group’s tax-exempt status to be deep-sixed because of negative publicity. In the targeting scandal, this approach allowed partisan concerns to overtake the application process, resulting in the unfair treatment of political viewpoints at odds with the Obama administration. Equal justice under the law demands that the IRS abandon the “newsworthy” criterion. To date, however, the agency has promised only to stop making lists of targeted groups “until further notice.” Even if the halt were permanent, it wouldn’t be enough. IRS officials are still required to follow the manual and pull high-profile applications for enhanced scrutiny. The IRS can change its employee manual today. No new law is required. The simplest explanation for why the agency has not done so lies in the nature of bureaucracies—they refuse to relinquish power even after demonstrated abuse. The procedure for newsworthy applicants provides a convenient cover to shield improper partisan decision-making.)

(FROM THE ARTICLE: Nicholas Kristof of the New York Times is having fun implying that Speaker of the House Paul Ryan’s effort to replace ObamaCare is at odds with Mr. Ryan’s Catholic faith. The column is of a piece with the “Jesus was a socialist” arguments that bounce around the left half of the social media universe. Without wrestling with any difficult questions of faith or logic, Mr. Kristof simply casts the federal bureaucracy in the role of Jesus. Then the Timesman proceeds to suggest through satire that by seeking to reduce outlays and improve incentives in federal programs, Mr. Ryan is defying the will of his God. Of course if federal agencies were ever actually given the statutory mission to do as Jesus would do, Mr. Kristof would be as horrified as anyone. But this seems to be a political season when people who spend much of the year driving religion out of public life abruptly drag it back in as they attempt to justify big government. It’s not necessarily persuasive. The ancient book has numerous admonitions to perform charity and various condemnations of greed, but it’s not easy to find a passage in which Jesus says that government is the best vehicle to provide aid, or that anyone should force others to donate. Even casual readers of the Bible may notice that Jesus doesn’t get along all that well with the political authorities of his time and (spoiler alert!) his relationship with government ends rather badly. Back then, tax collectors were not presumed to be the dedicated public servants that we appreciate so much today. And in our own time, social conservatives who think the U.S. Government has become hostile to religion—Christianity in particular—should consider what Jesus had to put up with.)
