(FROM THE ARTICLE: When U.S. Rep. Luis Gutierrez moves on from Congress to whatever is next for him, he could qualify for a federal pension of about $62,000 per year, a Washington group estimates. Federal pension details aren’t made public as they are for state officials and teachers. The estimate comes from the National Taxpayers Union, which since the late 1970s has calculated congressional pensions based on available data. Pete Sepp, the organization’s president, said the estimate assumes Gutierrez elected for his wife to be paid an annuity upon his death. His annual payout would be higher if he didn’t. Members of Congress also may receive a 401(k)-style supplement to their pensions if they made contributions, Sepp said. The calculation takes into account how long a lawmaker was in office. When Gutierrez entered Congress in 1993, the annual pay was $133,600. He has been paid $174,000 a year since 2009, when members of Congress last had a raise, according to the Congressional Research Service. In announcing he won’t run for re-election, Gutierrez said his plans included traveling the country with his wife, Soraida. Since 2010, Gutierrez has paid her a total of nearly $400,000 from his campaign war chest for help on his re-election campaigns, Federal Election Commission records show. The figure does not include reimbursements for office supplies and other expenses. During the first nine months of this year, he paid her a total of $42,000 in seven increments of $6,000 each. Reports show she has been paid for acting as his treasurer or account manager and for management and fundraising.)

— Tax reform: ‘Middle class’ is in eye of beholder – Lynn Sweet and Ashlee Rezin (DIERSEN: From what I see, outrageously, under proposed “tax reform,” the more that your itemized deductions have been, the more federal income tax that you will pay. My and my wife’s 2016 federal income tax return shows that we had $30,890 in itemized deductions. We paid $21,433 in medical and dental expenses and we were able to deduct $13,859 of that, we paid $12,835 in real estate taxes, we paid $1,468 in state income taxes, and we made $2,728 in 501(c)(3) contributions. From what I see, outrageously, the proposed “tax reform” is designed to a) punish those who have high medical and dental expenses, b) discourage homeownership, and c) discourage taking job-related graduate courses. Government should encourage homeownership. The deductibility of mortgage interest and real estate taxes a) encouraged me to buy a new town home in 1972 when I was 24 years old, a studio condo in 1974, and a one bedroom condo in 1976 and b) encouraged my wife and I to buy a home in 1978 and to have one built in 1984. Further, government should encourage getting job-related education. The deductibility of job-related education encouraged me to take job-related graduate courses 1972-1983 and 1992-1997.)

That amount — which did not include his home in his 4th Congressional District — ranked 147th among the 435 House members, the Center for Responsive Politics said. He cashed in more than $1 million of those assets in 2016, lowering his total investments to somewhere between about $662,000 and $1.56 million, according to his most recent disclosure statement, which was filed in August. Gutierrez said that money went toward the June 2016 purchase of the new house in Puerto Rico for $1.1 million. “It cost us another couple hundred thousand dollars to rehab,” he said. “I bought a house that was then under construction for all of 2016.” . . . Gutierrez — who is paid $174,000 a year as a congressman — said he’s been smart with his personal finances but always acted appropriately as an elected official. “I’ve been fighting for people, doing my job, and ain’t nobody ever questioned my integrity,” he said, predicting that this article would be a “negative story.” For years, Gutierrez invested heavily in Chicago’s residential real estate market, moving repeatedly as he made hundreds of thousands of dollars buying and selling homes in the city. Although he described himself as a “walking open book,” he added, “It’s not important to look at what somebody is doing and what they’re buying. Big deal.” Assuming Gutierrez completes this final term in Congress in January 2019, he would have served 25 years in Washington and be eligible for a full pension of about $67,860 per year. Gutierrez also is eligible for Social Security. His payment would depend on the age he decided to start drawing a Social Security check, with maximum benefits reached by waiting until the age of 70. Before becoming a congressman, Gutierrez was an alderman representing the 26th Ward, the heart of the city’s Puerto Rican community. Chicago pension fund officials wouldn’t immediately say if he’s getting retirement benefits from the city or what those payments would be. His Gutierrez for Congress political committee has paid his wife, Soraida, nearly $400,000 for fundraising and for serving as treasurer and manager for the campaign fund during the past eight years, according to Federal Election Commission records. She was paid $42,000 by the campaign between the start of this year and Sept. 30. From 2003 and 2009, Soraida Gutierrez lobbied state government. The couple’s 37-year-old daughter Omaira Figueroa worked as a staffer for the Chicago City Council and now is on the state of Illinois payroll, with a $68,208-a-year salary as a “consumer counselor” for the Illinois Commerce Commission. Gutierrez often has highlighted the long road between his humble origins and where he ended up as a political power player. “After all, I’m the Puerto Rican son of a cabdriver and a factory worker, a kid who chopped up pig innards and swept the floor of an unsuccessful restaurant, a guy who had to drive a cab on the night shift to make ends meet,” he wrote in his autobiography, “Still Dreaming: My Journey from the Barrio to Capitol Hill.”)

The last few years I worked, an additional course on the prevention of sexual assault was required. Apparently, our esteemed members of Congress were exempt from this training and now must pass a bill so that they will be required to get such training. People in such positions know how to behave in the workplace. These men know exactly what they are doing. Years ago, when I was a teenager, my mother told me that it’s a man’s world. I protested at the time, but now, sadly, I know what she meant. We must do better as a nation. Our girls deserve better.)

Clint Krislov, an attorney representing the retirees, said the decision means those retirees are entitled only to bare-bones protections outlined by lower courts. “For the city, this is a huge benefit. The amount they’re paying is dropped from $137 million a year to between $7 million and $8 million,” Krislov said Monday. “What the [lower courts] have said is that all you get is what’s in the statute. (FROM THE ARTICLE: The Capitol Hill Standing Committee of Correspondents has voted to table Breitbart News’ credential process and declined to extend the organization’s temporary credentials to cover Congress, which expire at the end of May. The committee, which permits media access to the U.S. Capitol only to outlets it considers legitimate news organizations, not political advocacy or other groups, expressed frustration over Breitbart’s inconsistent answers to questions about its masthead and office space, among other problems. Breitbart CEO Larry Solov, in correspondence with the committee since its most recent meeting, asserted that Republican megadonor Rebekah Mercer had no editorial input, that a managing editor who also had a role in an advocacy group was no longer on the masthead, and that the site was having trouble finding office space in part because of security issues. The committee said Breitbart could reapply for credentials if it addresses the concerns. Otherwise, three staff members who currently have temporary credentials (which the site has had for more than two years) will no longer have access after May 31. Breitbart reporters could still attend events on Capitol Hill that are open to the public without the credentials, but the lack of credentials would limit their access in the complex and hamper their ability to get other credentials, such as permanent White House passes. “Breitbart News is unequivocally entitled to permanent Senate Press Gallery credentials and is determined to secure them,” Chad Wilkinson, a Breitbart spokesperson, said in a statement Tuesday. Among the issues raised by the Capitol Hill committee were concerns that members of Breitbart’s masthead, provided last month by Solov, were also employed by the Mercer-funded Government Accountability Institute, which was co-founded by now-White House chief strategist (and former Breitbart chairman) Steve Bannon. The GAI and the work and advocacy it does would not be in line with the committee’s guidelines for credentialing. In a letter to the committee, Solov said that although Managing Editor Wynton Hall was listed on the masthead as of last month, he actually resigned in February and the position “has remained vacant since then.” “We have fully and fairly cooperated with your inquiries in good faith and believe that we have met and responded to the concerns you have raised,” Solov wrote. Breitbart “is an editorially independent news organization and is entitled to and deserves issuance of its permanent Senate Press Gallery credentials.” The committee also noted that Bannon’s Office of Government Ethics financial disclosure had a different date for his separation from Breitbart than what Solov had indicated in their last meeting. Solov has asserted that Breitbart is completely editorially independent, without influence from Bannon or Mercer. But the committee expressed some doubts. “I don’t know how we get Breitbart to prove that Bannon isn’t picking up the phone and talking to them,” said standing committee chairman Billy House, a reporter with Bloomberg News. Last month, the committee, composed of five journalists, also expressed frustration that Breitbart may have misled them on where the site’s offices are located. A Capitol Hill townhouse, known as the “Breitbart Embassy,” had been provided as the address of the company’s Washington office, and the committee was told that Breitbart was leasing the space as a “mixed use” place for both corporate housing (often where Bannon stayed), events and office space. But the committee last month noted that the townhouse is not technically zoned for commercial use and that the owner of the house filed taxes as the sole occupant, meaning that a commercial lease would not even be legally possible. (Most Breitbart writers work remotely.) Solov told the committee that Breitbart has yet to find a new office space and likely would not for some time, partly because of security issues. “I still want to give them the benefit of doubt on these things, that it’s misunderstandings or confusion [instead of] something more nefarious, but we still have these office space issues,” said committee secretary Joseph Morton, who works for the Omaha World-Herald. “The whole thing suggests to me that they’re just not ready for a credential.” In another letter to the committee, sent two days ago, Solov argued that individual members of Breitbart would and should qualify for credentials. But the committee said it doesn’t credential individuals but instead looks at the entire organization and leadership. Solov also insinuated in the letter that there are other organizations that deserve the same scrutiny Breitbart is getting. “Without limitation, is it the Standing Committee’s position that a news organization cannot be credentialed if it employs any editor and/or reporter who is also employed by or affiliated with any advocacy group or non-profit?” he asked. “Of course, we respectfully assert that any such rules, standards and/or criteria must be reasonable and realistic, and transparent — and applied equally and fairly to all news organizations.” During the meeting on Tuesday, the committee said it would happily look into any credentialed reporter and potentially revoke their access if they were found to also be employed or affiliated with an advocacy or nonprofit group. “This is not content driven, we aren’t singling out Breitbart either for extra scrutiny or special treatment,” House said. “This is our job as a board, and these rules have been in place long before any of us came to the board. Our job is to do the best we can and see whether the information they’ve provided meshes with the requirements.”)

However you peddle it, this is a big diversion of resources from relatively high-tax states such as Illinois to lower-tax areas such as Texas (home to the chairman of the House Ways & Means Committee), which wants billions of our tax dollars to rebuild after yet another hurricane. Republicans used to oppose double taxation. But under these bills, money that’s already been snarfed up by local governments would be fully subject to federal income taxes. More: Interest payments on the kids’ college loans would no longer be deductible under the House bill. Many homeowners would lose out on deductions for interest on home mortgages. And to boot, to pay for corporate cuts, individual tax brackets would be adjusted for inflation differently with the effect that over the next decade, at least 20 percent of any tax cut would disappear for everyone earning under $200,000 a year, according to the Wall Street Journal.)

(FROM THE ARTICLE: Operating Engineers Union Local 150 is making good on its threat to back a Republican primary opponent against House Republican Leader Jim Durkin. The union local’s president, Jim Sweeney, told me he had about a dozen members in Durkin’s district passing nominating petitions for Burr Ridge Mayor Mickey Straub a couple of weekends ago. Straub is running against Durkin as a Republican. Sweeney said he expected to double that number the following weekend. Challenging a legislative leader in a primary is just not done. But these are not normal times. Local 150 led the fight against Bruce Rauner in the 2014 Republican primary and then backed a Libertarian Party candidate against him that fall. The union’s leadership has fumed as Rauner has pushed his anti-union agenda, and now wants some payback on Durkin for helping to kill their bill to ban the creation of “right to work” zones by local governments. The governor vetoed the bill and the union tried twice to override Rauner without success, mainly because Durkin was able to keep his caucus together. Since the union blames Durkin they’ll ally themselves with anybody, including Republican activist Dan Proft, if they have to. Proft is backing Straub against Durkin, who he claims isn’t fit to be Leader. But Proft is not exactly known for being a big union supporter. In fact, according to the Daily Law Bulletin, Proft co-founded the Liberty Justice Center, which, irony of ironies, is representing Lincolnshire against a lawsuit backed by Local 150 over the village’s creation of a local right to work zone — the very event that Local 150’s vetoed bill tried to outlaw. Don’t even try to wrap your mind around all that. You’ll go nuts. This fight is beyond ideology. Sweeney and Proft have a common cause — messing with Durkin — and they’re sticking with that.)

We paid $21,433 in medical and dental expenses and we were able to deduct $13,859 of that, we paid $12,835 in real estate taxes, we paid $1,468 in state income taxes, and we made $2,728 in 501(c)(3) contributions. To support the GOP tax bill is to say that a) you want those who take the standard deduction to pay less federal income tax and b) you want those who itemize their deductions to pay more federal income tax. Overwhelmingly, a) those who take the standard deduction are renters and younger and are more likely to vote for Democrats and b) those who itemize their deductions are homeowners and older and are more likely to vote for Republicans. From what I see, Republican leaders want those who itemize their deductions to take the biggest tax hit. I itemized 1972-1977 and my wife and I have itemized since 1978. Government should encourage homeownership and taking job-related graduate courses. The deductibility of mortgage interest, real estate taxes, and job-related education a) encouraged me to take job-related graduate courses 1972-1983 and 1992-1997, b) encouraged me to buy a new town home in 1972, a studio condo in 1974, and a one bedroom condo in 1976, and c) encouraged my wife and I to buy a home in 1978 and to have one built in 1984.)
