(FROM THE ARTICLE: As long as reporters have covered government officials, they’ve sought greater access than the government was willing to allow. The White House excluded a CNN reporter from an international trade announcement with the president of the European Commission on July 25, in apparent retaliation after she shouted unwelcome questions at President Donald Trump during an Oval Office appearance. Many observers viewed this move as an escalation of the Trump administration’s hostility toward journalists. The Washington Post called the decision to exclude CNN’s Kaitlan Collins “highly unusual and possibly unprecedented.” Sen. Richard Blumenthal, D-Conn., called it “an offense against the First Amendment interests of all of us.” But did the White House actually violate the Constitution? As a media law professor, I regularly remind students that the First Amendment right of access to government officials, records and events is surprisingly uncertain. The First Amendment guarantees all Americans freedom to speak and publish without government interference. It has been broadly interpreted by the Supreme Court to forbid the government from restraining or punishing a speaker based on the content of the speaker’s message. While journalists have a clearly established First Amendment right to publish the news they’ve gathered — even in extreme cases, like the leak of stolen Pentagon documents — it’s much less clear that the First Amendment protects the right to gather the news in the first place. A right to publish, but not a ‘right to gather’? CNN has not indicated that it plans to take any legal action over Collins’ exclusion. In addition to being awkward — imagine a journalist taking the witness stand to testify against the White House communications director — a court case over a withdrawn invitation would face legal obstacles. The courts have refused to recognize an overarching “constitutional right of access” to government information. Instead, they have picked off cases with narrow, specific rulings. For instance, the Supreme Court recognized in Richmond Newspapers v. Virginia that there is a constitutional right to cover a criminal trial. Likewise, federal appeals courts agree the First Amendment guarantees the right to videotape police making arrests in a public place. At the same time, judges have found no constitutional right to obtain government documents or to enter crime scenes that are off-limits to the public. Does CNN’s White House correspondent, or any journalist, have a First Amendment “right” to a press pass or a spot at a news conference? Since the Supreme Court said in its 1972 Branzburg ruling that journalists have no right to insist on greater access than the general public, probably not. That being said, journalists do have a right not to be retaliated against, regardless of what form the retaliation takes. Retaliatory exclusions can violate the law Even if attending a White House event is not a constitutionally guaranteed right, that doesn’t mean the government is free to take it away as a punishment. The government cannot take away even a purely discretionary privilege if the motive is to penalize speech. Even though there is no entitlement to hold a government job, the Supreme Court decided in 1966 that public employment cannot be denied on the basis of viewpoint. And even though there is no entitlement to receive a discretionary government grant, the justices ruled in 2013 that a grant cannot be denied because the applicant expresses a view different from the government’s. In other words, any action by a government agency intended to punish or deter a speaker for unwanted speech can violate the Constitution. That same legal principle would apply today if a federal official denied a government “privilege” to a journalist on the basis of a disagreeable viewpoint. In the CNN situation, if Collins lost something of value, like the ability to attend a presidential appearance, because of the content of her speech, she has the essential ingredients of a First Amendment case. The White House likely would argue that it was Collins’ method of delivery — raising her voice, after being asked not to — and not the content of her message that earned her a disinvitation. That would make a First Amendment claim blurrier. overnment agencies can regulate the “time, place and manner” of speaking, the Supreme Court has ruled, as long as the restrictions are reasonable and enforced evenhandedly. She is facing Democrat Kwame Raoul. “I’m giving her a million dollars which is a lot of money for me,” Rauner said during an interview on a southern Illinois radio station Thursday morning. I need her to win. (Current attorney general) Lisa Madigan has defended the corruption of her dad. Erika Harold will prosecute Madigan and the corruption.” But Rauner couldn’t say what crimes he thinks the speaker has committed. Rauner again complained that Madigan’s law firm does property tax appeals work. Rauner said that is wrong when policies set by the General Assembly can affect property taxes. “He’s on both sides of that,” Rauner said. “It’s corrupt. It’s a fundamental conflict of interest.” However, it is not illegal. Rauner said it should be. Harold spokesman Aaron DeGroot said Harold “will investigate and pursue any allegation of wrongdoing or corruption at any level of government in Illinois as attorney general.” He also said Harold has called for lawmakers to give the office additional authority to crack down on public corruption, such as authority to convene a statewide grand jury and issue subpoenas. Rauner also criticized Lisa Madigan for failing to root out corruption.)

(FROM THE ARTICLE: There’s one graphic that perfectly captures the absurdity of Illinois pensions over the past three decades. It’s what Justice Samuel Alito described as Illinois’ “generous public-employee retirement packages” when writing for the majority in the Janus v. AFSCME decision. Alito didn’t use this graphic but he could have, because it makes his point. In 1987, pension promises made to active workers and retirees in the state’s five state-run pension plans totaled just $18 billion. By 2016, they had ballooned to $208 billion. That’s a cumulative 1,067 percent increase. Contrast that to the state’s budget (general fund revenues) which was up just 236 percent over the same time period. Or household incomes, which were up just 127 percent. Or inflation, up just 111 percent. (FROM THE ARTICLE: During an era of ever-evolving and newly discovered rights, we forget that sovereignty, both federal and state, is an absolute right that is being ignored in the immigration debate. We have the right, both as residents of states, particularly at the border, and as citizens of this federal republic, to be governed by our consent and to admit people to this country only through the consent of our laws. We’ve already explained that it is a founding principle that a president has the power and the responsibility to repel a large-scale incursion into our country. A state has a similar responsibility when it is experiencing an invasion and the federal government refuses to act. The entire purpose of a federal government What if our own federal government is impotent in protecting our border states from violent drug cartels and the crime, social ills, and public cost drain of mass migration from across the border, while the federal courts are downright preventing the states from protecting themselves? The Constitution is clear as to the responsibilities of the federal government and why we have one in the first place. The federal government exists not to impose more regulations on the people, but to protect their rights and security where states are inherently incapable of doing so effectively — namely, in repelling an invasion. Ironically, it is the one act of war a president can pursue without the consent of Congress, yet the invasion at our border is the only one we refuse to address. Article IV, §4 of the Constitution tasks the federal government with guaranteeing states’ protection against invasion. That is because, in the words of Madison (Federalist #45), the “few and defined” powers of the federal government were to be applied “principally on external objects, as war, peace, negotiation, and foreign commerce.” State governments, on the other hand, deal with “the internal order, improvement, and prosperity of the State.” This is war But what if an outside force buttressed by the most dangerous paramilitary organizations in the world invades a border state and disrupts its internal order, improvement, and prosperity – and the federal government doesn’t stop it? Well, the Constitution is not a suicide pact. Article I, § 10, cl. 3 (the Compact Clause) states: “No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.” The Constitution is clear that, all things equal, states shouldn’t engage in warfare with other countries. But all things are not equal in this case, and the Constitution made an exception for those times when states are invaded and in imminent danger. Well, is this really an invasion or imminent danger, you might ask? Andy McCarthy wrote an incisive column yesterday reminding us that we are looking at the immigration issue through the wrong lens. We view it as a legal problem, when in essence it’s a national security problem. Just consider the crime statistics in Texas alone since 2011: According to the DHS and the Texas Department of Public Safety, over 251,000 criminal aliens have been booked into local Texas jails between June 1, 2011, and April 30, 2018. They have been charged for a total of 663,000 offenses, including: . . . And those numbers only include those illegals verified by federal authorities through fingerprints. Roughly 50 percent, and often the most dangerous ones, are never interdicted by federal authorities before they commit murder and mayhem in Texas. Where is this coming from? It’s not a natural disaster. It’s coming from a concerted and organized massed migration completely orchestrated by the drug cartels, often with the help of the Mexican government. As these quotes show, this is not some sort of legal problem with immigration loopholes, but our biggest current threat to our national security and homeland. These are often former Mexican military, in the case of the Zetas cartel, who now hold territory on Texas soil and use military tactics to divert the border patrol with bogus asylum seekers and bring in drugs, crime, and gangs. If this is not an invasion or an imminent danger, I’m not sure what is. I don’t think our Founders could have imagined such a colossal human and monetary toll from massive migration. Even without the military and drug cartel side of this, just the sheer wave of impoverished and often troubled migrants, of which over 90 percent turn out to be invalid asylum claims, should be enough to constitute an invasion. As Andy McCarthy rightfully observes, “If you look at federal asylum law, it addresses the individual migrant, not a systemic incursion. … It does not address what could happen if thousands of migrants simultaneously seek asylum.” States retain their sovereignty over violent incursions Amazingly, the political class questions even the president’s ability to repel the invasion without lawfare, but in reality, even a state, particularly Texas, should be able to do so. I’m not suggesting that the governor direct the Texas Air National Guard to drop bombs on the cartels, but the state would be well within its rights to start returning some of the migrants across the border. Joseph Story in his commentary on the Compact Clause writes that while the prohibition on states making war is obviously necessary, it was “wisely guarded by exceptions sufficient for the safety of the states, and not justly open to the objection of being dangerous to the Union.” Still, a state may be so situated, that it may become indispensable to possess military forces, to resist an expected invasion, or insurrection. The danger may be too imminent for delay; and under such circumstances, a state will have a right to raise troops for its own safety, even without the consent of Congress. Haven’t the border states (the ones that still care) waited long enough with too much delay? Some might suggest that this is not a declared war. But if you look at the original language of Article IV’s guarantee clause protecting states from invasion, Madison originally drafted its language to be read as protecting against “foreign violence.” It’s clear that this was not necessarily referring to formal warfare with a nation-state, but repelling violent incursions from Indian tribes. When the drug cartels use families and children to distract from the core of the invasion, the cartels are no different from Hamas using human shields at the Gaza-Israel border. Israel rightfully treats this as a military issue, and our government should too. If it fails to do so, the drug cartels should be on the receiving end of what happens when you mess with Texas. As Scalia asked: “Are the sovereign States at the mercy of the Federal Executive’s refusal to enforce the Nation’s immigration laws? A good way of answering that question is to ask: Would the States conceivably have entered into the Union if the Constitution itself contained the Court’s holding?”)

The financial crisis of 2008 was partially fueled by origination bonuses paid to bank loan officers who were incented to approve bad loans. (FROM THE ARTICLE: Last week, with a high-stakes summit with North Korean dictator Kim Jong Un on the horizon and plenty of news coverage in the Daily Herald and elsewhere about an “Impeach Trump” yard sign in Elgin, Ernest Lasse decided that someone ought to show some support for the president. Lasse installed in front of his Mount Prospect home a roughly 15-square-foot plywood sign reading “TRUMP” in big red letters, surrounded by the words “Make America Great Again.” Not being naive, Lasse knew the sign wouldn’t be popular with everyone. He set up a camera in his front window to capture video of anyone who would do the sign harm. Sure enough, footage shows that a pair of young men came along about 9:30 p.m. Friday and stole the sign from the yard. Lasse found pieces of it the next morning on the bank of nearby Weller Creek. Police were called, reports were written and charges are possible. But before he pursues a formal complaint, Lasse has an offer he hopes the vandals can’t refuse.)

Denise Rotheimer said Monday she filed a complaint with Illinois’ Attorney Registration and Disciplinary Commission against several high-ranking lawmakers, including state Senate President John Cullerton, D-Chicago, and House Speaker Michael Madigan, D-Chicago. Rotheimer also filed complaints against lawmakers who are attorneys on the Legislative Ethics Commission and against the special legislative inspector general. The ARDC was established by the Illinois Supreme Court to “promote and protect the integrity of the legal profession.” The Illinois Supreme Court has the authority to disbar attorneys. The complaints stem from the nearly three year vacancy for the legislative inspector general position. The inspector general is responsible for investigating allegations of lawmaker wrongdoing. While the post was vacant, complaints forwarded to the office sat untouched.)
