(FROM THE ARTICLE: Wow! Sneed was surprised not to see a mention of legendary conservative maven Phyllis Schlafly when Illinois permitted ratification of the Equal Rights Amendment last week. In all due respect, Schlafly must have been turning over in her grave. Who was Schlafly? Dubbed the first lady of the conservative movement, Schlafly was credited by some historians as the reason the ERA failed to pass in Illinois! The ERA Amendment lost steam in the late 1970s because of the work of Schlafly’s “volunteer brigades,” who were known to cajole legislators with apple pies. As the nation’s most famous anti-feminist during the rebirth of the Women’s Liberation Movement decades — she was also the president of the Illinois Federation of Republican Women from 1956 to 1964. She wore her hair up, she did not burn her bra, and you just knew she wore a girdle. For a journalist in the late ’60s and ’70s, Schlafly’s name was in your Rolodex. When Schlafly died in 2016, at the age of 92, her New York Times obit described her as being one of the most polarizing figures in American public life, a self-described housewife with “a moral ferocity reminiscent of the ax-wielding prohibitionist Carry Nation.” She was a remarkable woman who, thank goodness, did not get the last word in the ongoing fight for a woman’s equal rights.)

If you think about it, even devoted democrats draw the line somewhere on ballot box access: The right to vote is generally denied to prisoners, children, noncitizens, and people judged mentally incompetent. But imagine the envy and anger that would be unleashed if voting power were based on profession or education. Who would decide how to divide the public into first-, second-, and third-class citizens? Would biology professors be certified as “highly qualified” but high school history teachers ranked “standard qualified”? What about journalists vs. carpenters vs. actors vs. the unemployed? And how much of the public would be consigned to the lowest tier of “unqualified” voters—would it be 1 percent or 10 percent or more? A civics test seems a more defensible way to implement weighted voting, but not really. It implicitly equates knowledge with good judgment, which experience tells us isn’t a sound equation. As the conservative writer William F. (FROM THE ARTICLE: The bill has bigger drawbacks. Any law to protect journalists as a special class needs to define who is a journalist, and this leaves an opening for the government to start making judgement calls about who is not a journalist. While the definition adopted in the bill is fairly broad, and would encompass freelancers and all kinds of media, there are still concerns about defining who is and who is not a reporter. This is especially true because 31 of the 44 attacks documented on the U.S. Press Freedom Tracker occurred during protests. As more livestreamers and citizen journalists show up at protests, it can be tricky, even for press freedom groups, to determine who to count as a journalist. The government is often far more conservative. In December, federal prosecutors tried photojournalist and livestreamer Alexei Wood on chargers of riot, conspiracy, and destruction of property. Even though Wood’s video footage from the day shows that he took no part in any vandalism, the prosecution tried to make the entire case about whether he was a journalist or not. The definitional issue exists with other legislation to protect reporters. A shield bill, for instance, would also require the government to define journalists. This was one of the major areas of debate in 2013 when there was serious energy to put in place a bill protecting journalists from federal subpoenas that would require them to divulge their sources. In the end legislation is always about weighing the costs versus the benefits. In the context of an attorney general who claims to have 27 open leak investigations and wants to make it easier to subpoena reporters, a shield law would at least have immediate concrete benefits to weigh against potential drawbacks. The Journalist Protection Act is an effort in the right direction, and there is an argument that it could serve as a useful global model. The diagnosis of increased hostility bleeding into physical threats is spot on, given what we’ve seen in the data. However, Swalwell’s proposed legislation would not offer journalists any material benefit, even as it would allow the federal government to define who is and who is not a journalist. In the current climate, that may not be a worthwhile tradeoff.)

Matthew Ahmann, 18, a self-described political journalist, has been outspoken against Mayor Mark Kownick in recent years through his politically driven Facebook account. In his lawsuit filed against the school board of Crystal Lake-based District 155, Ahmann said that on Sept. 26 he did as he was told by the school’s dean, James Kelly, after receiving a “threatening ultimatum” and kept quiet during the mayor’s visit to his advanced placement politics class. Ahmann, who also is seeking $50,000 in compensatory damages, said in the lawsuit that Kelly approached him after having a conversation with Kownick. Kelly told him not to “say or do anything” during Kownick’s visit “or negative consequences would follow.” According to the lawsuit, “Mayor Kownick and Dean Kelly, working in concert and prior to the mayor’s speech, conspired to stifle Matt’s continued political journalism by having Dean Kelly threaten and intimidate Matt.” Ahmann did however record the session on his cellphone and weeks later posted it on his politically charged Facebook page. He said the district in retaliation punished him by placing him on a one-day in-school suspension. Ahmann said in the lawsuit he wants this expunged from his record because having this “permanent academic record of suspension” hurts his future chances of being accepted into colleges and earning scholarships.)
