After a brief discussion, Village Board members voted unanimously Monday to ban recreational marijuana growers, cultivation centers, and dispensing, processing and transporting facilities that could have set up shop in Morton after the passage last week of a new law legalizing recreational marijuana within Illinois. “This is the tip of the spear,” village attorney Pat McGrath told board members. “I’ll be bringing more ordinances to you before Jan. 1, 2020, that deal with other issues caused by the state law, like public possession of marijuana.” Just recently, the General Assembly approved and Gov. JB Pritzker signed into law a bill that legalized the use of recreational marijuana. The measure allows ordinances that can not only ban such businesses but also to create to “reasonable” zoning restrictions for cultivation centers, craft growers, processing organizations and dispensaries. On-site consumption may also be regulated by local governments, according to summaries provided by the governor’s office. Trustee Rod Blunier asked McGrath if businesses that sell products with CBD oil are included in Morton’s ban. They are not, the village attorney said, as long as they’re selling products that contain less than the federal legal limit of THC, the psychoactive ingredient in marijuana. Mayor Jeff Kaufman said the recreational pot ban in Morton was his idea. “I asked Pat (McGrath) to write the ordinance that was presented (Monday) to the trustees,” he said. “These businesses are not something Morton residents want. Just like video gambling.” Trustees voted 5-0 in 2009 and 4-3 in 2013 — with then-Mayor Ron Rainson casting the deciding vote — to ban state-approved video gambling in Morton. The 2013 vote followed two months of heated debate at Village Board meetings and on social media. An audience of about 150, mostly video gambling supporters, gasped when Rainson announced his vote. There were about a half-dozen audience members Monday, and no public comments on the recreational marijuana business ban. . .Illinois has 55 medical marijuana dispensaries, none in Morton. (FROM THE ARTICLE: Interim City Manager Martin Shanahan meets the job description to become the permanent city manager, the city council was advised last week. Interim City Attorney Chris Regis provided the opinion because the matter had been raised by at least one council member. Interestingly enough, Regis delivered the opinion moments before Mayor Bob O’Dekirk declared that city staff should not be involved in any application process or candidate search for a permanent city manager because it would be a conflict of interest. The theory is that since all city staff falls under the supervision of Shanahan as interim city manager, they have a conflict of interest in the selection of a new city manager. Therefore, city employees who normally would be involved in a city hiring process cannot be called upon to provide staff support for the council in a candidate search or even in a simple posting of the job. Apparently, no conflict of interest applied to Regis, however, in determining that Shanahan met the job qualifications, although Regis is a city employee who was advising the council on whether they could hire Shanahan for the job.)

They stood across the street from Mark’s Deli, whose owner along with two other plaintiffs has challenged the city’s decision to allow the opening of a pot shop in the now-vacant quarters of the Sons of Italy at 124 Washington St. The lawsuit alleges that allowing the shop violates the constitutional rights of nearby property owners, violates federal narcotics laws and is detrimental to Haverhill. “I believe strongly we need to get the underground economy into the mainstream,” said Douglas Edison, a longtime community activist who is running for City Council. “Why are we stopping it? You can’t just say ‘no’ to everything,” he said. Edison pointed out the shop will pay taxes to the city. “We need money for schools,” Edison added. Caroline Pineau, who already owns and operates the Yoga Tree at 90 Washington St., hopes to open the recreational marijuana store. “I’ve been fighting for this for 15 years,” said Michael Crawford of Marblehead. He called the lawsuit “frivolous.” A friend of his who suffered from mental health problems and addiction had a very positive outcome after he started using medicinal marijuana, Crawford said. “It turned his life around,” he said. Crawford wore a shirt bearing the message, “more weed, less greed.” Another City Council candidate, Nick Golden, said Pineau is being “unfairly targeted” by the lawsuit. “She represents the type of person and entrepreneur that we’re trying to attract,” said Golden, who is on the staff of state Rep. Lori Ehrlich, D-Marblehead. “I think it’s really important to support small business owners,” Christina Barbieri, a former Haverhill resident, said. She and others noted that possession of marijuana is now legal in Massachusetts and that Haverhill voters supported this change. The protesters held signs with messages such as “drop the lawsuit.” Many motorists driving by honked in support of the cause. A few people voiced their objection to having a pot shop in the city, Crawford said. One man confronted the protesters and called them “immature.” As he walked away from the group, he extended his two middle fingers. Two police officers were assigned to the demonstration, which remained orderly. Officer James Keenan advised the man who made the obscene gestures to not cause a disturbance. Pritzker is expected to sign the bill, but marijuana remains illegal at the federal level. The council will meet at 3 p.m. Thursday, June 6, in the council chambers at Clearlake City Hall, 14050 Olympic Drive. On May 9, Mayor Nick Bennett resigned as he prepared to move to South Dakota, as Lake County News has reported. At a May 13 special meeting, the council directed City Clerk Melissa Swanson to advertise the vacancy for appointment and accept applications with a June 4 deadline. The city has received six applications for the seat, which has a term ending in November 2020. Applicants are Cristina Azanza, the founder of a nonprofit, Azanza Inc.; David Claffey, a marketing and communications professional who serves on the city’s marketing committee; Desserrie Shaw, who has experience as a board member and president of the Konocti County Water District; Erin McCarrick, who owns cannabis companies Clearlake Ventures and Cara Farms and a consulting business, Madrone Strategies; Russell Perdock, the city’s former mayor who resigned last year to pursue the police chief’s job and now is director of community integration for Adventist Health Clear Lake; and Pattie Duke, a registered nurse case manager.
