(FROM THE ARTICLE: Longtime Bolingbrook Mayor Roger Claar hosted a big fundraiser for Republican presidential nominee Donald Trump last fall at the fancy village-owned golf clubhouse known locally as the “Rog Mahal.”  Barely a month later, residents of the southwest suburban village voted 66 percent for Hillary Clinton to 27 percent for Trump. Will County board member Jackie Traynere, a Democrat, hopes to use that apparent political disconnect between Claar and his constituents to bring an end to his sometimes controversial 30 years in office. Since announcing her intention to run against Claar in the April 4 municipal elections, Traynere has sought to make the race in part a referendum on Claar’s support for the new president. “Trump isn’t the reason Roger should go. It really is his management of the village,” Traynere, 54, told me recently in a phone interview from Leavenworth, Kansas, where she was traveling on business in her role as a union organizer for the American Federation of Government Employees. But she adds: “The Trump support really pushed people over the edge.” Claar, just back from Trump’s inauguration, argued Tuesday that traditional party politics don’t belong in municipal elections and that he will gladly run on the record that has made him one of the longest serving mayors in the Chicago area. “I think people are generally pretty happy with what’s going on in Bolingbrook,” said the 71-year-old Claar, who aggressively steered the village’s growth from a population of about 33,000 when he took over to more than 75,000 today. Indeed, it’s a tricky business to inject national politics into a municipal election. Candidates don’t even run under party labels. And voter turnout is usually only a small fraction of what it is in a presidential election. But the fact is that Bolingbrook, an increasingly diverse community in every sense of the word, has been trending Democratic in statewide and national elections for the past decade. That suggests an opening for a Democrat mounting a serious campaign, and Traynere seems to be doing just that. She has hired a professional campaign manager and claims the endorsements of Sen. Dick Durbin and Cook County Board President Toni Preckwinkle among others. Traynere was just re-elected to her third term on the Will County Board and served last year as a Bernie Sanders delegate to the Democratic National Convention. Claar starts the election season with a campaign fund of more than $500,000, barely half of what he once kept on hand, but says he has what he needs. “This whole thing is about power. They see this as an opportunity to take over. They want to be in charge of Bolingbrook,” said Claar, who vowed that he will not seek endorsements from any Republicans, including Trump. That doesn’t mean Claar is backing down from his support for Trump, whom he describes as a “breath of fresh air” on the political scene. “He called it like it is. That’s kind of the way I operate,” said Claar. Claar operates as a full-time mayor and pays himself commensurately with a salary of $140,102, not including a $6,000 car allowance. He emphasizes that’s less than Bolingbrook paid the village administrator whose job he eliminated. Claar also is collecting two public pensions: $55,757 from his previous life as a school administrator and $4,532 from his tenure on the Illinois Tollway Authority. His total annual taxpayer compensation of $200,000 looms as a potential campaign issue. Claar resigned from the tollway board in 2000 after the Sun-Times reported he was raising campaign funds from tollway vendors. That was just one of many minor scandals that have dogged Claar through the years, but nothing that has turned the voters of Bolingbrook against him. “I have been vetted on numerous occasions over false accusations,” Claar declared. He predicts Traynere’s emphasis on Trump could backfire. I predict it will make for a more interesting than usual municipal election season.)

(FROM THE ARTICLE: I dusted off an old idea of mine because of President Trump’s freeze on federal hiring, his tasking to create an attrition plan, and a statistic I read yesterday in a Washington Post article by Juliet Eilperin.  Eilperin reported that in the federal workforce, “there are nearly three times as many employees over age 60 as under age 30.”  Yikes.  That’s no way to run a railroad. The idea I’d roughed out gave a way to cut back the federal workforce by tempting people to retire or move on earlier than they would otherwise.  Depending on whom I’d run the idea past, I’d hear that it’s fantasy, fantastic, or the best sense of fantastical. The cliché to address what I’d like to see happen is, “You’ve got to spend money to make money.”  What if we spent a bunch of money offering departure incentives high enough to entice 750,000 feds to resign or retire?  Then, how about filling one third of the vacated positions with veterans, graduates, and the un- and underemployed?  We’d be spending billions to save billions more every year, and to get 250,000 people into careers they and the country need them to have.)

I worked for the federal government 1966-1969 and 1971-1997.  My Democrat superiors, supervisors, coworkers, and subordinates in the federal government were nasty. Beginning in 1966, when I was 18 years old and started working part-time for the Park Forest Post Office, they used against me the fact that I sought and obtained student draft deferments 1966-1970 and a financial hardship draft deferment 1970-1971. They always hinted/implied/argued/shouted a) that instead of me, the Post Office should have hired a veteran in 1966, b) that the Post Office should gotten rid of me much sooner than it did so that a veteran could have my job, c) that instead of me, IRS should have hired a veteran in 1971, d) that instead of me, IRS should have promoted veterans in 1972, 1973, and 1974, e) that instead of me, GAO should have hired a veteran in 1980, f) that instead of me, GAO should have promoted a veteran in 1986, and g) that GAO should gotten rid of me much sooner than it did so that a veteran could have my job and my preferred corner office.)

Surely, in a private company that offers comparable services, effective managers could make a tangible impact on the quality of service. Alas, the solution will never be as simple for federal organizations with the current system. Lawmakers passed numerous government worker protection laws as part of the civil servant protection system to shield them from arbitrary or political terminations. Today, government employees have been afforded a staggering amount of job overprotection. An investigation by CBS News reported just how difficult it can be to fire a government employee. One official at the Environmental Protection Agency (EPA) was allowed to keep his job after being caught watching porn for several hours per day. Two managers from General Services Administration (GSA) were rehired and even received bonuses after initially being terminated for spending almost $1 million on luxury goods for a conference. There is absolutely no reason why they should be allowed to avoid proper disciplinary action for their professional shortcomings. When employees are allowed to keep their job even when watching porn, performing poorly, slacking off, and participating in other unprofessional and unethical activities, it creates a toxic culture of apathetic mediocrity. There is very little incentive for people to do their jobs adequately if they are almost certain to not be fired. This morale-killing culture is exactly why agencies like the DMV are saturated with incompetent and rude staff. These protections not only make a high-performing federal employee a rarity, but also cause a lot of taxpayer money to be wasted. New York City’s infamous rubber room exemplifies this waste. Due to tenure and union agreements, teachers who are accused of criminal conduct are sent there until they receive hearings. While they wait for their hearings for an indefinite time in the Rubber Room, they continue to receive their salaries and increase their pensions while literally doing nothing. NYC hemorrhages $22 million per year from taxpayers’ wallets, keeping these teachers in limbo because union agreements make the firing process unbearably long and complicated. Clearly, the American public suffers from these practices. However, the intricate web of bureaucratic regulations and union decrees make it anything but easy to effect change. There may only be one Scott Walker, but more people should be cracking down on unions. Making it easy for a manager to fire an employee for simply doing a bad job shouldn’t be a liberal or conservative issue—it’s a common sense issue. The term “civil servant” implies a great amount of accountability and loyalty to one’s country. Indeed, public employees like soldiers, policemen, and firefighters risk their lives every day to defend peoples’ lives. The EPA strives to sustain a better planet to live in. The Food and Drug Administration serves to protect public health. These responsibilities were handed to federal agencies because they are presumably more trustworthy than private institutions and corporations. This greater purpose though, is often completely eroded by the sheer lack of accountability of federal agencies’ employees. With ghoulish bureaucratic procedures, strong union protection, and tenure, it can be very difficult to translate an individual agency’s mission to the United States down to its employees, and this undermines the honor the job is supposed to carry. It’s time government workers are held accountable for their actions and performance.)

(FROM THE ARTICLE: People in the private sector do not take an oath of office when they get a job. They get an offer, report to work, and that’s it. For federal employees it is different. Reading so many articles about the inauguration that refer to the president-elect taking the oath of office on Jan. 20 got me thinking about oaths and what they mean. I have taken that oath of office as a civil service employee. Raising your right hand and swearing to “support and defend the Constitution of the United States” is not something most people take lightly. It is a solemn oath and it means something to most people who take it. . .The oath is relatively straightforward, but what does it mean? I see the oath as having three important aspects. First, the employee swears to support and defend the Constitution against enemies. Second, s/he swears allegiance to the Constitution. Finally, the employee promises to do his/her job well. How does the oath manifest itself in day-to-day work? Does it provide any protection for an employee who refuses an order s/he believes would be a violation of the oath? That question is far more complex than the oath itself. Federal employees are required to follow lawful orders, even if they disagree with them. 5 USC 2302(b)(9)(D) gives employees the “right to refuse” with respect to unlawful orders. But what happens when an order violates a regulation or rule, but is not technically illegal? A 2015 Merit Systems Protection Board decision directly answered that question. MSPB outlined the issues in the case, writing “Specifically, the appellant asserted that the agency violated 5 U.S.C. § 2302(b)(9)(D), which protects employees from retaliation “for refusing to obey an order that would require the individual to violate a law.” 5 U.S.C. § 2302(b)(9)(D). He alleged that the agency improperly stripped him of particular job duties and gave him a subpar performance rating for disobeying an order that would have required that he violate (1) a Federal Acquisition Regulation that limits the authority of a contracting officer’s representative (COR), and (2) “PA296: How to be a COR,” the agency’s training course for COR certification, which further clarifies the limitations to this authority.” MSPB’s final decision said “… we hold that the right-to-disobey provision at section 2302(b)(9)(D) extends only to orders that would require the individual to take an action barred by statute. Because the appellant in this case contends that he disobeyed an order that would have required him to violate an agency rule or regulation, his claim falls outside of the scope of section 2302(b)(9)(D).” The oath of office does not grant any protection for deciding that an order is a bad idea, bad policy, or morally or ethically wrong. In fact, the oath does not grant any protection from anything. It is an oath of allegiance and a promise to do good work. Employees who believe they are being ordered to act in a manner inconsistent with their oath of office may pursue other options, such as whistleblower complaints or any other avenue provided by law or regulation, but disobeying direct orders is generally not one of the available options. That means an employee who wants to argue that s/he is adhering to the oath of office by disobeying orders has a very tough hill to climb. There is also the option of going to the press, but that can bring its own set of risks.)

Roosevelt Road to become a facility for new and expectant single mothers. The Clarendon Hills-based company Love From Above plans to offer a two-year transitional housing program for women 18 to 26 years old that will serve single mothers in DuPage County. The facility would serve as many as 12 women at any given time who find themselves in “crisis pregnancies,” Love From Above President and founder Yvonne Florczak-Seeman previously said. City Council members approved the plans contingent on the installation of landscaping for the property and the replacement of any required landscaping that has died or is dying. In addition, the facility will only be able to serve a maximum of 12 women at any given time. While Wheaton Mayor Michael Gresk said he would have preferred to have seen a commercial use for the building, “it’s good to see that building occupied.” “It’s an appropriate use,” he said. Council members previously asked if the facility would have to be licensed or regulated by the state. Greg Dose, attorney for the applicant, wrote a letter to the city stating the facility is not subject to regulation or licensing by the Department of Children and Family Services under the Illinois Child Care Act. In the letter, Dose said the facility will be the primary residence of the women. “While they reside there, it will be their home and the home of their infant and toddler children,” Dose said in the letter. “There will be no children on the premises other than those of the moms. Thus all child care that occurs on the premises will be home-based child care.” Dose said the facility is exempt from DCFS licensing and regulation because the children will not be apart from their parents. Wheaton’s city attorney has agreed with Dose’s opinion. As proposed, the women staying at the facility would have to be enrolled in college to participate in the program. This would be the company’s first facility, which will be called The Butterfly Garden…A Place for Healing and Transformation. The Wheaton Inn originally was built in 1987 and most recently was used as office space by an investment company that relocated to Downers Grove a few years ago.
