(FROM THE ARTICLE: Hinsdale officials have until April 15 to answer the complaints the U.S. Department of Justice and an agency providing housing for people recovering from addiction filed against the village, after a federal judge denied the village’s motions to dismiss the two lawsuits. Trinity Sober Living in July 2019 bought a house for up to 10 men to live and receive services as they recovered from alcoholism or drug addiction. Because the house, at 111 Grant St., was in a neighborhood zoned for single-family houses, the village claimed Trinity Sober Living violated its zoning code, which prohibits commercial uses in residential areas and limits the number of unrelated individuals who can live in a single-family home to three. In his March 18 opinion and order, U.S. District Judge Robert Gettleman wrote he considers “the crux” of Trinity’s complaint to be Hinsdale failed to make reasonable accommodations to afford Trinity’s clients equal opportunity to enjoy the use of the house, per the Fair Housing Act. Trinity argued people recovering from addiction are protected by the American with Disabilities Act and the Fair Housing Act, which prohibits discrimination against people with disabilities. Hinsdale’s zoning code allows licensed public or private agencies to operate group homes for up to six individuals in multifamily zoned area only with a special use permit.)
