(FROM THE ARTICLE: It turns out we’ve been living in a strictly enforced aristocracy — one based on where you fall in the “intersectional hierarchy” or oppression index. We’ve replaced color-blindness with merit-blindness and left ourselves utterly in the dark as to how to find competent individuals to start fixing our most serious problems. As the Asian students who just won their case at the Supreme Court found out the hard way, your ethnic heritage can indeed work against you at America’s preeminent DEI — diversity, equity, inclusion — enforcement camp, formerly known as the Ivy League. When the Supreme Court struck down affirmative action in higher education in Students for Fair Admissions v. Harvard, many cheered. Finally, our sacred meritocracy would be restored! Excellence would matter again. A student’s intellectual ability would be valued again. GPAs and SAT scores might even make a comeback! It remains to be seen if the law will have any effect on the blatantly unconstitutional practices long entrenched at college-admissions offices. Backwards job quotas But make no mistake — ugly racial quotas and unconstitutional policies are in full effect at corporate America’s HR departments. Anyone who works at a large company understands this. Less-qualified people are routinely hired and promoted over others based on shallow, literally skin-deep metrics. Hiring employees from disfavored demographic groups — men, Asians, heterosexuals, whites — won’t help boost your corporate ESG (environment, social and governance) score, so why bother? Could the new Supreme Court ruling also apply to corporate America? As 13 courageous state attorneys general recently pointed out in their letter to the Fortune 100 CEOs, it sure does. “Let there be no confusion: These principles apply equally to Title VII and other laws restricting race-based discrimination in employment and contracting. Courts routinely interpret Title VI and Title VII in conjunction with each other, adopting the same principles and interpretation for both statutes,” they wrote. “Accordingly, the Supreme Court’s recent decision should place every employer and contractor on notice of the illegality of racial quotas and race-based preferences in employment and contracting practices.” It’s thrilling to see state officials take their obligations to enforce anti-discrimination laws seriously. Kudos to the AGs from Kansas, Tennessee, Alabama, Arkansas, Indiana, Iowa, Kentucky, Mississippi, Missouri, Montana, Nebraska, South Carolina and West Virginia. Could these 13 states forge a new meritocratic alliance? A sanctuary region where skilled and talented people of any race could flourish without kneeling to the woke DEI gods? Of course, the Trump administration deserves credit for starting this pushback; its Department of Labor launched investigations into Microsoft and Wells Fargo over racial preferences and representation goals. But starting in 2020, the newly energized equity freight train plowed through the boardroom of every big company. What will the long-term consequences of this practice be in terms of competence, reputation and profit? Incredibly, even the airlines announced they would be hiring new pilots according to strict affirmative-action guidelines. In 2021, United Airlines vowed to make sure at least 50% of its new pilots are women or people of color. In 2023, Bud Light told United, “Hold my beer.” Making corporate DEI illegal is also good for the companies. If applied, this law would prevent them from making terrible business decisions — decisions that harm qualified applicants, keep talented people from achieving success, wreck valuable brands and make flyers worry about their plane crashing. As the AG letter concludes, “Social mobility is essential for the long-term viability of a democracy, and our leading institutions should continue to provide opportunities to underprivileged Americans. Race, though, is a poor proxy for what is fundamentally a class distinction. We urge you to immediately cease any unlawful race-based quotas or preferences your company has adopted for its employment and contracting practices. If you choose not to do so, know that you will be held accountable — sooner rather than later — for your decision to continue treating people differently because of the color of their skin. Federal law is now crystal clear that these corporate policies are illegal. We will see whether the Biden administration — which has so loudly claimed to support the Civil Rights Act — will enforce it.)

(FROM THE ARTICLE: The end of affirmative action was inevitable. The only surprise was that such intentions went terribly wrong and lasted so long. First, supporters of racial preferences always pushed back the goalposts for the program’s success. Was institutionalized reverse bias to last 20 years, 60 years, or ad infinitum? Parity became defined as an absolute equality of results. If “equity” was not obtained, then only institutionalized “racism” explained disparities. And only reverse racism was deemed the cure. Second, affirmative action was imposed on the back end in adult hiring and college admissions. However, to achieve parity, remediation early at the K-12 school level would have been the only solution. Yet such intervention was made impossible by teachers’ unions, the rise of identity politics, and government entitlements. All opposed school choice, self-help programs, critiques of cultural impediments, or restrictions on those blanket entitlements. Third, class, the true barometer of privilege, was rendered meaningless. Surrealism followed. The truly privileged Barack and Michelle Obama and Meghan Markel lectured the country on its unfairness — as if they had it far rougher than the impoverished “deplorable” of East Palestine, Ohio. Fourth, affirmative action supporters could never square the circle of proving that racial prejudices didn’t violate the spirit of the Declaration of Independence and the text of the Constitution. What they were left with was the lame argument that because long ago, the 90% white majority had violated their own foundational documents, then such past bad unconstitutional bias could legitimately be rectified by present-day “good” unconstitutional bias. Fifth, supporters never adequately explained why the sins of prior generations fell on their descendants who grew up in the post-Civil Rights era. Nor could they account for why those who had never experienced institutionalized racism, much less Jim Crow apartheid or slavery, were to be compensated collectively for the suffering of long-dead individuals. No wonder 70% of the American people in many polls favored ending affirmative action, including half of African-Americans. Sixth, there never was a “rainbow” coalition of shared non-white victimhood — a concept necessary to perpetuate the premise of white privilege, supremacy, and rage, so integral to race-based reverse discrimination. More than a dozen ethnicities earn more per capita than whites. Asians have been subject to coerced internment, immigration restrictions, and zoning exclusions. Yet on average, they do better than whites economically and enjoy lower suicide rates and longer life expectancies. The arguments for affirmative action never explained why Asians and other minorities who faced discrimination outperformed the majority white population. As a result, affirmative action ended up discriminating against Asians on the premise they were too successful! Seventh, no one ever explained when affirmative action was to apply. Blacks, for example, were vastly “overrepresented” in merit-based professional football and basketball. Yet no one demanded “proportional representation” to address such “disparate impact” despite the underrepresentation of all other demographics. Yet if Blacks were “underrepresented” in baseball, then reparatory measures were supposed to address that fact — even if Latino players were “overrepresented” and whites “underrepresented” as well. No one in our race-obsessed culture, of course, objected that white males died at twice their demographics in combat in Afghanistan and Iraq. Eighth, in our increasingly intermarried mass-immigration society, few could adjudicate who was what, or much less what standard gave one racial preference. In lunatic fashion, pink, blond Massachusetts Senator Elizabeth Warren became Harvard’s first “Native American” law professor due to her “high cheekbones.” Light-skinned Latinos were considered marginalized, while some darker Italians or Greeks were not. Ninth, an odious wokeism absorbed affirmative action and changed it into something even more abhorrent — as the original spirit of the Civil Rights movement was trashed. So Americans were asked to stomach a return to distasteful segregated dorms, “separate but equal” graduation ceremonies, and racially exclusive workshops. Tenth, and finally, affirmative action was insidiously destroying meritocracy. That hallmark American value of tribally-blind inclusivity had once explained why the nation outshone the world by discarding the old class prejudices of Europe. But increasingly, this value seemed to have been abandoned. When Stockton Rush, the late captain, and inventor of the ill-fated Titan deep-sea explorer, was quoted postmortem bragging that his company had no need of “old white guys” with long military expertise in submarining, Americans realized that woke racial discrimination was not just repulsive, but could get you killed. A nation whose pilot training, medical-school admissions, and military high command promotions were increasingly adopting racial, gender, or sexual-orientation essentialism was a country headed for the sort of Third World tribalism characteristic of failed states abroad. Ultimately, the court finally stepped in to end this unconstitutional aberration, more like the old Soviet commissariat than our ideals of equality under the law. The American people concurred. And the only regret seemed to be, why not sooner?)

Sadly, if not tragically for me, that directly resulted in my accepting a job offer from IRS. Especially after 1974, my Democrat IRS superiors used AA to promote over me my coworkers who were minority, female, and/or veteran and a) who had less job-related work experience than I had, b) who had less job-related education than I had, and/or c) who had not taken the CPA examination, let alone passed it. I earned an MBA from Loyola in 1976 and I passed the CPA examination on my first attempt in 1979. In 1980, because I was not a Democrat, minority, female, veteran. and/or younger, GAO forced me to suffer a $21,863/year (21%) pay cut in today’s dollars to transfer from IRS to GAO. My Democrat GAO superiors gave me unfair job assignments, performance expectations, and performance appraisals. They assigned me to supervised all their most problematic employees. The kept me off audits of IRS for all but 3 of the almost 18 years that I worked for GAO. They delayed my promotions and never promoted me beyond GS-13. They used AA to promote over me my coworkers who were minority, female, and/or veteran and a) who had less job-related work experience than I had, b) who had less job-related education than I had, and/or c) who had not taken the CPA or Certified Internal Auditor (CIA) examinations, let alone passed them. I earned a master’s degree in accounting from DePaul in 1980, I passed the CIA examination on my first attempt in 1981, I became a licensed CPA in 1981, I became a Certified Fraud Examiner in 1990, Government Financial Manager in 1994, Financial Services Auditor in 1996, and Forensic Accountant in 1997, and I earned a master’s degree in financial markets and trading from IIT in 1997. They always ranked me in the bottom half of my coworkers for pay-for-performance purposes. They forced me to take their early retirement “offer” in 1997 and gave my job and my preferred corner office to my Black subordinate. The Milton Township Republican Organization, DuPage County Republican Central Committee, Illinois Republican Party, Wheaton, Wheaton Park District, Wheaton Chamber of Commerce, Milton Township, DuPage County, Illinois, TAPROOT Republicans of Illinois, Illinois Center Right Coalition, American Association of Political Consultants Midwest Chapter, etc. have all taken many big adverse actions against me that they would never had taken against me if I was a minority, female, veteran, and/or younger.

In 1971, when I was 22 years old, Oldsmobile withdrew a job offer that I had accepted saying that it had just agreed to stop hiring Whites to settle an EEOC complaint. Sadly, if not tragically for me, that directly resulted in my accepting a job offer from IRS. Especially after 1974, my Democrat IRS superiors used AA to promote over me my coworkers who were minority, female, and/or veteran and a) who had less job-related work experience than I had, b) who had less job-related education than I had, and/or c) who had not taken the CPA examination, let alone passed it. I earned an MBA from Loyola in 1976 and I passed the CPA examination on my first attempt in 1979. In 1980, because I was not a Democrat, minority, female, veteran. and/or younger, GAO forced me to suffer a $21,863/year (21%) pay cut in today’s dollars to transfer from IRS to GAO. My Democrat GAO superiors gave me unfair job assignments, performance expectations, and performance appraisals. They assigned me to supervised all their most problematic employees. The kept me off audits of IRS for all but 3 of the almost 18 years that I worked for GAO. They delayed my promotions and never promoted me beyond GS-13. They used AA to promote over me my coworkers who were minority, female, and/or veteran and a) who had less job-related work experience than I had, b) who had less job-related education than I had, and/or c) who had not taken the CPA or Certified Internal Auditor (CIA) examinations, let alone passed them. I earned a master’s degree in accounting from DePaul in 1980, I passed the CIA examination on my first attempt in 1981, I became a licensed CPA in 1981, I became a Certified Fraud Examiner in 1990, Government Financial Manager in 1994, Financial Services Auditor in 1996, and Forensic Accountant in 1997, and I earned a master’s degree in financial markets and trading from IIT in 1997. They always ranked me in the bottom half of my coworkers for pay-for-performance purposes. They forced me to take their early retirement “offer” in 1997 and gave my job and my preferred corner office to my Black subordinate. The Milton Township Republican Organization, DuPage County Republican Central Committee, Illinois Republican Party, Wheaton, Wheaton Park District, Wheaton Chamber of Commerce, Milton Township, DuPage County, Illinois, TAPROOT Republicans of Illinois, Illinois Center Right Coalition, American Association of Political Consultants Midwest Chapter, etc. have all taken many big adverse actions against me that they would never had taken against me if I was a minority, female, veteran, and/or younger.
