(FROM THE ARTICLE: The FBI notified the Illinois Republican Party in June that some of its email accounts may have been hacked, but party officials were not told that it was part of a wide-ranging federal investigation of Russian activity in the nation’s political system, the state GOP’s executive director said Sunday. Nick Klitzing said the state GOP on its own found 18 of its emails on the website DCLeaks.com. The New York Times reported the website was an outlet that U.S. intelligence officials and private cybersecurity companies believe was created by a unit controlled by the GRU, Russia’s military intelligence agency. Klitzing said FBI agents raised questions about emails involving the state GOP accounts during their visit. The four email accounts involved were inactive or rarely used, and the hacked emails dated to 2015, long before the 2016 contests for president and Illinois offices, Klitzing said. A review of the emails provided by the state GOP shows the messages were largely rudimentary in nature, ranging from requests for training and local party event invitations to reports and discussion that U.S. Rep. Peter Roskam of Wheaton should be considered a “dark horse” candidate to replace House Speaker John Boehner, a contest ultimately won by U.S. Rep. Paul Ryan of Wisconsin. . .The compromised Illinois GOP emails provided to the Tribune were dated from August to October of 2015 and did not involve Trump, Clinton or the presidential contest. The emails were sent to the state Republican Party. The subjects of the compromised emails included a suburban York Township Republican Women’s event; a request by McLean County GOP Chairman Chuck Erickson to attend a county training event that included Erickson’s phone number; and a notification from Mike Bigger, a member of the Illinois Republican State Central Committee, that he would be attending an event “and bringing a $1,000 check” from the Stark County party organization. Other compromised emails included a half-dozen messages from Chicago businessman Peter Smith, chairman of Corporate Venture Alliances LLC, involving the October 2015 GOP contest to replace Boehner as House speaker. Smith is a longtime Republican conservative and has been a supporter of former House Speaker Newt Gingrich. Smith’s emails were sent to what Klitzing described as an unused email account for Richard Porter, the state’s Republican national committeeman.)

Jeanne Ives (R-Wheaton) said being inclusive does not necessarily mean being productive. “This is the type of thing that you see happening across higher education everywhere,” Ives told the DuPage Policy Journal. “What they are doing is that they are segregating students based on all sorts of (criteria) such as gender, sex, race and religion. (They are saying) ‘everybody should feel good about themselves for who they are and not based on merit.’ That is completely wrong.” The university, in its goals of inclusivity, has enacted several diversity programs, including holding a “Bystander Intervention/De-Escalation Training” session, taught by a self-described “radical queer feminist activist” and creating an Office of Inclusion and Intercultural Relations (OIIR), dedicated to recruiting and retaining underrepresented students while promoting diversify education and civility, and fostering leadership skills for the global world. Ives said the OIIR contradicts itself via segregation of students, i.e. students are not judged on their merits, but on their background. “That is not very American,” Ives said. “That is not how we built this country. We built this country on hard work and people of all political stripes, all colors and all nations doing their best and succeeding and giving everybody equal opportunity and not an unequal outcome. So this is the University of Illinois along with other universities in the state just running amok.” Ives said the office does not encourage hard work, but instead promotes division. “It’s actually shameful to segregate kids this way,” Ives said. “They should be pushed, to an extent. They should be given opportunities based on their merits. This is actually divisive to do something like this. This is not inclusive.”)

I had almost completed the requirements for a master’s degree in accounting from DePaul.  I had earned an MBA from Loyola in 1976.  Virtually all of my Democrat GAO superiors, supervisors, coworkers, and subordinates were Democrats who GAO had hired straight out of college. They had little or no work experience outside of GAO.  They wanted every GAO hire to start at the bottom like they did.  They had an extremely low opinion of executive branch employees and of union members like I had been at IRS for almost 9 years.  They exhibited an extremely low opinion my knowledge of IRS that I had gained by working for IRS for almost 9 years. They stressed that GAO had required me to accept an $18,459 (21%) pay cut in today’s dollars to transfer from IRS to GAO.)

It turns out that this depends on the jurisdiction, and on whether the business is discriminating against clients or employees. The First Amendment doesn’t apply to such private businesses (incidentally, whether or not they take government funds, see Rendell-Baker v. Kohn (1982)), and federal law generally doesn’t ban political affiliation discrimination, so it ends up being a matter of state and local law. In New Mexico, for instance, discriminating against clients on this basis is legal — but firing employees, or threatening to fire them, based on their politics is a felony. 1. Most states ban most businesses from discriminating against clients based on the clients’ race, religion, sex or national origin. Federal law does the same, though for a narrower set of businesses (and doesn’t cover sex discrimination); it also adds a ban on disability discrimination. Many states and some cities also ban discrimination based on sexual orientation, marital status and various other attributes. But political affiliation is rarely on the list. A few cities or counties do ban such discrimination. D.C. bans discrimination based on “the state of belonging to or endorsing any political party.” Seattle bans such discrimination based on “any idea or belief, or coordinated body of ideas or beliefs, relating to the purpose, conduct, organization, function or basis of government and related institutions and activities, whether or not characteristic of any political party or group,” “includ[ing] membership in a political party or group and includ[ing] conduct, reasonably related to political ideology, which does not interfere with job performance.” There are a few other places on this list. But New Mexico doesn’t ban such discrimination in public accommodations, and neither do the city of Albuquerque or Bernalillo County. One can debate whether such discrimination should be outlawed, by analogy to various other forms of discrimination. Perhaps if wedding photographers can’t discriminate against same-sex weddings (which New Mexico courts have indeed said), Internet marketing companies shouldn’t be able to discriminate against people who have particular views. Or perhaps such antidiscrimination laws shouldn’t be expanded further, or should even be cut back, to leave people free to choose whether to refuse to do business with others, whether or not we’d approve of that choice. But, as a matter of current law, such discrimination against Trump supporters (or Hillary Clinton supporters or Communists or libertarians or whoever else) is legal. 2. Many states and some cities and counties, however, do ban discrimination against employees — or at least firing of current employees — based on their political activity (with different jurisdictions defining such activity differently). I discuss this in detail in my article “Private Employees’ Speech and Political Activity: Statutory Protection Against Employer Retaliation,” but here’s the New Mexico statute, enacted in 1912, when New Mexico became a state: Coercion of employees [a fourth degree felony] consists of … any person having under his control or in his employment persons entitled to vote at any election, directly or indirectly discharging or threatening to discharge such employee because of the employee’s political opinions or belief or because of such employee’s intention to vote or refrain from voting for any candidate, party, proposition, question or constitutional amendment. Threatening an employee with dismissal because he supports Trump is thus a felony in New Mexico (and also likely a tort, so the dismissed employee can sue even if the prosecutor chooses not to prosecute).)

(FROM THE LETTER: Now that the election is over, we need to be ever vigilant to legislative moves done quietly in veto sessions, lame-duck sessions, etc. One such bill, was passed last May in the Illinois Senate (SB 2196) on a primarily partisan vote — 30 to 19 — with the support of only two Republican state senators (Christine Radogno and Chris Nybo). This bill would provide taxpayer-funded college tuition financial aid for undocumented immigrant students. The measure would add Illinois to the five states that grant immigrant students financial aid for college education regardless of their legal status. Already, Illinois is one of 18 states that allows any status immigrants to qualify for lower in-state tuition and set up a private college fund. This bill then moved to the House, where it languished in the Rules Committee until Nov. 9 — the day after the election — when it magically appeared as “approved for consideration and placed on the calendar order for a third reading.” We need to flood our state reps with outrage over this type of maneuvering! We were just asked to agree to three additional tax increases in Peoria County due to a lack of state funding for roads, schools and veterans care … yet there seems to be plenty of money for illegal non-citizens. It just never ends in the state of Illinois. Please make some noise!)

(FROM THE ARTICLE: During the first eight months of the year, gamblers dropped $18.9 million into video poker machines in the city of Kankakee.  Daily Journal senior reporter Lee Provost recently reported on video poker totals in his weekly business column. The numbers were sobering — and staggering. In Kankakee, $4.3 million was “lost” in the machines. Ask yourself this. Who can afford to lose $4.3 million? The totals wagered from Kankakee add up to roughly all the totals from Aroma Park, $811,751; Bradley, $8.5 million; Bourbonnais, $1.8 million; Manteno, $6.3 million; and Momence, $2 million — combined. Here’s what this tells you. A disproportionate number of the terminals, or the wagers, or both, are coming from middle class and lower middle class areas. Does it make sense that Kankakee’s wagers are 10 times those of Bourbonnais? When video gambling was legalized, the initial thought seemed to be to help out small restaurants and taverns. Instead, what has happened is the creation of mini-professional storefronts that have rows of machines. A discussion of Aroma Park’s experience indicated that is where the money is flowing now. One mainstream Aroma Park restaurant no longer operates its machines. In addition, one local mayor quoted indicated that she had not seen many cars in front of one wagering establishment. Translation: It might be that a small number of people are losing a lot of money. Moreover, the amounts wagered are escalating rapidly — up by a third or more in half a dozen communities. Now, we would not want to be Carry Nation with the ax, crusading against demon rum. It would be impossible to go back to no gambling. But a wide range of studies estimates that somewhere from 1 to 2 percent of the population can be classified as being “problem gamblers.” These are people who don’t know when to stop, and show up to follow a bad day with another long session to get even. So, in the pile of proceeds being raked in by the state, we ask a question: Is enough money being set aside to help those who will need help? Much like cigarette taxes, the government seems to need and relish the money. Unlike tobacco, are we warning people enough?)

It isn’t a trivial question. Given the Republican presidential nominee’s vulgar boasts about sexually assaulting women and trying to coerce a woman to commit adultery with him — among other things — it is hard to believe he could get past the human resources department of a Fortune 500 company. Over the last decade, much of corporate America has put in place strict policies to deal with sexual harassment and other offensive behavior, trying to make amends for an abhorrent history of letting such conduct go unchecked (remember “Mad Men”?). Hiring procedures at large companies, particularly for senior positions, include extensive background checks, which typically include interviewing former colleagues and combing through articles, court records and, yes, social media. Thousands of employees have been fired or pushed out for using far less repugnant language than Mr. Trump’s words about how he gropes women. Walmart, the nation’s largest employer, with some 2.2 million employees, has explicit policies, for example, that prohibit “sexually explicit language, off-color jokes, remarks about a person’s body” as well as “using slurs or negative stereotyping,” “verbal kidding, teasing or joking” and “intimidating acts, such as bullying or threatening.” By those definitions, it is not clear if Mr. Trump would qualify to be hired as a janitor, let alone a senior executive. A spokesman for Walmart, asked whether Mr. Trump’s comments would disqualify him from employment there, said: “We’ve got a policy of not entertaining hypotheticals.” Mr. Trump has apologized for his language, which he described as “locker room talk.” But he used the language while on the job; he was recorded on a live microphone while working to promote “The Apprentice,” his popular reality show.)

But in the second presidential debate, he confirmed that there were a number of years where he paid nothing at all. A week ago, The Times published his partial state tax returns from 1995 that show a substantial business loss that could have allowed him to avoid paying income taxes for nearly two decades. When asked by the moderator Anderson Cooper whether he indeed used the loss to get out of a tax bill, Mr. Trump replied, “Of course I do.”  But rather than attempt to convince the American people that he had paid his fair share of taxes, Mr. Trump has vociferously defended the virtue of his ways, even arguing that paying nothing makes him fit to be president. “That makes me smart,” he retorted when presented with the idea during the first presidential debate. He told the Fox host Bill O’Reilly two days later, “A lot of people say, ‘That’s the kind of thinking that I want running this nation.’ ” He’s now calling it “brilliant.” Mr. Trump’s assertion that people should pay as little as they can in taxes — because, as he told Mr. O’Reilly, the government will “waste the money” — fits with quite an old conservative ideology.
