(FROM THE ARTICLE: Age discrimination is the least profitable type of discrimination for workers. In other words, the potential amount of damages available to age discrimination victims is far lower than the amount of damages that are available to victims of other types of discrimination. This reality has terrible consequences for combating the problem, and surely contributes to the epidemic nature of age discrimination in America. Title VII of the Civil Rights Act of 1964 provides victims of discrimination based on race, sex, religion, color and national origin with a full menu of damages, including monetary, compensatory (i.e. damages for emotional distress), and punitive damages. Federal courts always award attorney fees to prevailing plaintiffs in Title VII cases. Not so the Age Discrimination in Employment Act of 1967 (ADEA). The ADEA does not treat age discrimination like a serious civil rights violation. Instead, age discrimination is accorded the same severity as an employer’s failure to pay workers’ overtime or holiday pay. The damages provision of the ADEA is taken not from Title VII but from the Fair Labor Standards Act, a federal law that regulates the payment of wages by employers. The ADEA allows age discrimination victims to recover for monetary loss only, sometimes doubled if the plaintiff can prove “willful” discrimination. Like all civil rights laws, one of the functions of the ADEA is deterrence. The very existence of the law is supposed to discourage employers from engaging in age discrimination. But the lack of potentially big-ticket damages associated with compensatory and punitive damages detracts from the deterrence value of the ADEA. Worse, the ADEA does not guarantee an award of attorney fees to a winning plaintiff.)

A recent poll by The Associated Press-NORC Center for Public Affairs Research found that workers under the age of 50 were significantly more likely to view America’s aging workforce as a negative development when compared with their older counterparts. About 4 in 10 respondents ages 18 to 49 and 44% of the youngest respondents ages 18 to 29 said they consider the trend to be a bad thing for American workers. Just 14% of those age 60 and over said the same. “I don’t think in things like IT and medicine you’re as effective a worker (at 65 years old) as you are at 50,” says Katie Otting, a 29-year-old living in Southern California. “If some 65-year-old is in a position that he’s not ready to quit because he wants a better pension and there’s someone else ready to take that job, they’re not going to replace him.” An aging population, elevated health care costs and lingering financial uncertainty following the Great Recession all are believed to be contributing to America’s steadily graying workforce. Nearly 20% of Americans over the age of 65 were employed or actively looking for work last year, up from less than 12% two decades prior, according to the Bureau of Labor Statistics.)

But, the definition of a digital native, according to Dictionary.com, is “a person born or brought up during the age of digital technology and therefore familiar with computers and the internet from an early age.” Those who are turning forty this year probably started to use the internet around 1995, when they were sophomores in high school — if they were lucky. That was in the time of the dial-up modem and America Online. Their parents were ahead of the game to have a home computer then. In all likelihood, they really began to use computers when they went to college. It should be noted that I’m omitting early Mac computers and things like Atari for the purposes of this column. I’m talking about the real-deal internet. Digital natives had the internet in elementary school or middle school. Wikipedia says digital natives “are often used to describe the digital gap in terms of the ability of technological use among people born from 1980 onward and those born before.” By this definition, a digital native would be 38 years old or younger today. Let that soak in. A job description that specifically requests that someone is 38 years old or less. Why does this happen? I don’t have the answer for you. I’d like to know this myself. I thought that the idea of a job posting was to hire someone with a certain skillset rather than a certain age. I also heard this rumor that discriminating on the basis of age when hiring is not allowed. In fact, I think there may be something called the Age Discrimination in Employment Act.)
