CHICAGO SUN-TIMES
— 76 people overdose in Connecticut park near Yale – AP (DIERSEN: What percentage of those in your precinct, in your municipality, in your township/ward, in your county, and in Illinois talk and/or act a) like they want to smoke pot, b) like they smoke pot, c) like they want to make money selling pot, and/or d) like they want government to take in lots of tax revenue from legalizing pot? Who leads the fight against pot in your municipality, in your township/ward, in your county, and in Illinois? If/when the Democrats, Libertarians, Greens, and RINOs legalize pot in Illinois, and if municipalities and counties can ban the sale of pot in their jurisdictions, I am going to lead the fight to get Wheaton and DuPage County to be the first municipality and the first county in Illinois to ban the sale of pot in their jurisdictions.)
https://chicago.suntimes.com/news/yale-new-haven-connecticut-park-overdoses-synthetic-marijuana-k2/
(FROM THE ARTICLE: The number of overdose victims linked to a suspected bad batch of synthetic marijuana has risen to 76 in New Haven, Connecticut, as officials try to determine exactly what sickened people. People on and around the historic New Haven Green near Yale University began falling ill shortly after 8 a.m. Wednesday, and the overdoses continued into Thursday morning. No deaths were reported, and most people brought to hospitals have been discharged, officials said. Symptoms varied. Many victims lost consciousness, officials said. Others vomited. Some just became nauseous or lethargic. City officials said police officers, firefighters and emergency medical personnel will staff a command post on the Green for the time being, and social workers and private health outreach workers will be on hand. Toxicology testing remained incomplete Thursday. Some victims tested positive for the powerful opioid fentanyl, but it appeared most if not all the overdoses were caused only by a potent batch of “K2” synthetic marijuana, said Dr. Kathryn Hawk, an emergency medicine physician and professor at Yale-New Haven Hospital, where many of the victims were treated.)

(FROM THE ARTICLE: Working on the Luxury Sales team has been amazing, but I think that out of all the projects I’ve done this summer my most fulfilling project has been my Maker Week project. I worked on a Diversity & Inclusion project with interns from a variety of departments to create an employee resource site. The idea came from the fact that many people were unaware of diversity initiatives throughout the company so we thought that creating a database and website to record the diversity initiatives would be a great internal resource and create visibility for the programs. First, we gathered all the information about the diversity initiatives to create the database. Second, we interviewed different people in the company like A.G. Sulzberger, Dean Baquet, Meredith Kopit Levien and other employees involved in diversity initiatives. Lastly, we formatted the website to hold the database, show diversity efforts in recruiting, the newsroom and the business side. We also added a tab for various conferences based on departments. Our showcase at Maker Week was great because employees seemed really interested in the accessibility of the website. It was one of the best projects I’ve worked on and I’m so glad to have been a part of it. I think this project really taught me to be bold in my work. I spoke to all these amazing people by just emailing them and taking a chance and it worked out which was amazing. I’ve also been a diversity advocate throughout my years in school and this project showed me how an idea from one of my passions can become a useful reality. In the fall, I’ll be heading back to Syracuse University to be a Resident Advisor for my last year. I’ll also be a peer facilitator for our first diversity-oriented freshman forum. I want to use the skills I’ve learned in this internship to create something amazing on my campus that is fueled by my passion just like I got to create at The New York Times.)

TECH REPUBLIC
— The top 10 most successful cities in the U.S. Based on median income, unemployment rate, and education rate, here are the most successful cities in the country. – Macy Bayern
https://www.techrepublic.com/article/the-top-10-most-successful-cities-in-the-us/
(FROM THE ARTICLE: Zippia, a career search engine, found the most successful city in every US state. Using Census data from the 2012-2016 American Community Survey PUMS, Zippia ranked cities based on median income, unemployment rate, and education rate (percentage of residents over 25 with a bachelor’s degree). Each city’s success was measured on a scale of 1 to the number of cities in each state, along with the three variables above, and averaged those values to determine an individual index, according to Zippia’s announcement. The lower the score, the better the rating, said Zippia. Here are Zippia’s top 10 most successful US cities in 2018: 1. Glencoe, Illinois. . .Ranked first is Glencoe, Illinois, right outside of Chicago. With a median income of $185,320, unemployment rate of 1.5%, and education rate of 86.7%, Glencoe reigns supreme. In close proximity to Chicago, residents can escape the fast pace of the Windy City, while still being in close proximity to visit.)

FED SMITH
— GAO Report Suggests Improvements for Handling Federal Employee Misconduct – Ian Smith (DIERSEN: My critics/opponents, their operatives, and their dupes have always hinted/implied/argued/shouted that my Democrat superiors in the federal government took adverse employment actions against me, that is, disciplined me, because of my misconduct and a) NOT because of political affiliation discrimination, reverse discrimination, or age discrimination, b) NOT because I complained about the aforesaid, and c) NOT because I became an active member in a class action lawsuit in 1988 when I was 40 years old that charged them with reverse discrimination, age discrimination, and retaliation.)
https://www.fedsmith.com/2018/08/15/report-suggests-improvements-handling-federal-employee-misconduct/
(FROM THE ARTICLE: GAO said that an average of less than 1 percent (17,000) of the federal government’s 2.1 million employees are formally disciplined for misconduct annually. While this is a very small number, GAO notes that even a few cases of employee misconduct can have significant impacts on workplace morale and impede an agency’s efforts to achieve its mission. Based on data from the Office of Personnel Management, federal agencies made 10,249 suspensions, 7,411 removals, and 114 demotions for misconduct in 2016. However, GAO said that because of weaknesses in OPM’s data on employee misconduct, which is provided by the agencies, OPM is unable to accurately target supervisory training to address misconduct, and decision-makers do not know the full extent or nature of this misconduct. Examples of employee misconduct can include: time and attendance infractions, intoxication, workplace violence, physical aggression toward an employee, improper use of a government-issued credit card, misuse of government equipment (such as viewing pornography or gambling), use of public position for private gain, behavior that affects national security)

FED WEEK
— Age Discrimination, 50 Years Later – Editorial (DIERSEN: For federal employees who are Republican, White, male, and/or non-veteran, age discrimination starts at age 25. The federal government wastes the careers of and gets rid its employees who are Republican, White, male, and/or non-veteran who fail to make GS-13 (currently $96,403) by age 25, GS-14 (currently $113,920) by age 30, GS-15 (currently $134,000) by age 35, and Senior Executive Service (currently $164,200) by age 40. Extremely few federal employees make the aforesaid promotions.)
https://www.fedweek.com/publishers-perspective/age-discrimination-50-years-later/
(FROM THE ARTICLE: The federal government officially outlawed age discrimination in the workplace 50 years ago and therefore it is now nothing but a distant memory. We now pause for the laughter to die down. Unfortunately, it is still with us—as are a number of other forms of bias also outlawed around the same time, not incidentally—according to the very agency that enforces the law in the federal workplace as in other workplaces, the Equal Employment Opportunity Commission. The Age Discrimination in Employment Act was passed in 1967 but its effective date was put off until June of the following year. The law barred discrimination on grounds of age with respect to any term, condition, or privilege of employment; barred retaliation for opposing employment practices that discriminate based on age or for filing an age discrimination charge; and generally barred including age preferences in job notices. Protection against bias on the basis of advanced age was an admirable foresight in a nation awash with young baby boomers. However, “After 50 years of a federal law whose purpose is to promote the employment of older workers based on ability, age discrimination remains too common and too accepted,” says an EEOC report. “Despite decades of research finding that age does not predict ability or performance, employers often fall back on precisely the ageist stereotypes the ADEA was enacted to prohibit.” While quantifying age discrimination is difficult—in part because, like other forms of discrimination it often is not formally reported—“the perception that age discrimination exists in our workplaces is prevalent,” it said. It cited a recent survey finding that more than 6 in 10 workers age 45 and older say they have seen or experienced age discrimination in the workplace and of those, 90 percent say it is somewhat or very common. This most frequently takes the form of unlawful firing, harassment, discriminatory terms of employment and discriminatory discipline, said the assessment of the nationwide workforce whose findings should be of special concern in the generally older federal workforce. For those who don’t have a job and are looking at an older age—such as in the common scenario of a federal employee who retires relatively young and wishes to continue working—things can be even worse. In another survey cited in the report, more than 3 of 4 older workers said their age was an obstacle to finding a job. It also cited studies that have documented age discrimination by employers as reflected by the share of job applicants who are called for an interview when applications contained an age, versus those that were age-neutral. Employers also have been found to be signaling a preference for younger workers by stating that “digital natives” are needed.)

GOVERNMENT EXECUTIVE
— Being a Federal Employee, Simplified – Steve Goodrich (DIERSEN: Good rich should write about Affirmative Action (AA), Diversity, and Inclusion. Goodrich should write about patronage, political affiliation discrimination, reverse discrimination, age discrimination, and retaliation. Goodrich should write about how Democrats use AA, Diversity, and Inclusion to not hire Republicans, to not retain Republicans, to not promote Republicans, and to get rid of Republicans.)
https://www.govexec.com/excellence/management-matters/2018/08/being-federal-employee-simplified/150553/
(FROM THE ARTICLE: The average age of a federal employee is pushing closer to the 50-year mark and less than 17 percent of workers are under age 35, pointing to the facts that people are working longer and fewer young people are entering government. Civil service reform discussions have for years focused on streamlining hiring and modernizing the approach to employee compensation, never quite getting any of it done. Some believe federal employees are underpaid, others claim they’re overpaid. Maybe there is just too much noise in the system for some to regard federal employment as a great place to work. Perhaps we need to hit the reset button and take a hard look at what is right. Let’s begin with a basic premise: To obtain a job, you must possess a skill set, or at least the aptitude to develop the skills needed. Employment then becomes a form of contract. The employer agrees to pay the employee money and benefits in exchange for job performance consistent with defined requirements and standards. This should be obvious. However, in today’s environment we need to add a second premise: In a rapidly changing world, jobs and organizations must continually evolve, grow, and adapt to be effective. This applies to government, not just the private sector. It should be easy, right? Unfortunately, it’s not. Achieving the following three things would go a long way toward improving the performance and accountability of federal employees.)
— One Quarter of Suspended Feds Have Been Suspended Before – Eric Katz (DIERSEN: Of course, my critics/opponents, their operatives, and their dupes stress the many adverse employment actions that my Democrat superiors in the federal government took against me. My Democrat GAO superiors forced me to retire in 1997 when I was 49 years old, gave me unfair performance expectations and appraisals, always ranked me in the bottom half of my coworkers for pay-for-performance purposes, did not promote me beyond GS-13, got rid of my mentor in 1987, kept me off audits of IRS for all but 3 of the almost 18 years that I worked for GAO, and forced me to take an $19,203 pay cut in today’s dollars to transfer from IRS to GAO in 1980. My Democrat IRS superiors did not promote me beyond GS-12, disallowed my education deductions in 1978, got rid of my mentor in 1975, and disallowed my partial day per diem claims in 1974. My Democrat Post Office superiors forced me resign in 1969 and disallowed my sick leave requests in 1969 and 1968.)

The master cylinder and four calipers were replaced, A/C was charged, carbonator was rebuilt and fuel pump replaced, minor electrical and mechanical problems were fixed, five new tires were installed, new battery was installed, etc. I could have avoided much if not all of the fuel system and brake problems if I had driven the car more – at least once each summer. But my excuse for not starting the car since 2009 is that since 2004, I have spent 10+ hours each and every day putting GOPUSA ILLINOIS emails together and sending them out.)

(FROM THE EDITORIAL: Ford has confirmed what Tom and Gail were hearing — that their Mustang was the first ever sold — and now the car is on display in Michigan this week as the company celebrates the sale of its 10 millionth Mustang. Not only did the Gail and Tom Wise hang on to their Mustang all these years; they also hung on to the original paperwork. By one estimate, that makes their old blue car worth as much as $450,000. We are constantly reminded to de-junk our lives. The KonMari method tells us to tidy up. Feng shui tells us to remove unneeded items. But sometimes there’s joy to be found in proper storage.)

(FROM THE ARTICLE: Peter Strzok, the anti-Trump FBI official at the center of the “deep state” allegations, opened a new social media account and posted a link asking for donations from the public after being fired Monday. Here’s how much he’s raised Strzok opened a Twitter account Monday after being fired from the bureau and posted just one message on the social media service. It was a statement explaining how the Deputy Director of the FBI had overruled the decision to punish Strzok with “a 60-day suspension and demotion from supervisory duties was the appropriate punishment.” “This decision should be deeply troubling to all Americans,” the letter continued. The statement made the claim that “the decision to terminate was taken in response to political pressure, and to punish Special Agent Strzok for political speech protected by the First Amendment, not on a fair and independent examination of the facts.” “It is a decision that produces only one winner – those who seek to harm our country and weaken our democracy,” the statement concluded. “The FBI and the American people deserve better.” Strzok included a link to a GoFundMe donation page. After only being active for 12 hours, the donation page reached its goal of $150,000, and increased its goal to $350,000. The page stated that the funds would go towards Strzok’s legal defense and his loss of income. Allies of the president have used the released texts from Strzok to his mistress and FBI lawyer Lisa Page to substantiate claims of an orchestrated effort to defeat the president and his policies. Strok denied that the texts proved anything beyond his personal contempt for the president, and the Inspector General’s report said there was no evidence his personal bias interfered with his professional conduct. Nevertheless, Trump and his supporters say that the bias in Strzok’s texts prove that the special counsel’s Russian investigation was begun under dubious circumstances and should be immediately shut down.)

In addition to Wisconsin, the open seat races in Michigan and Iowa are possible pickup opportunities. In Illinois, GOP Gov. (FROM THE ARTICLE: Dozens of White House aides have signed NDAs in exchange for working for Trump, who has long relied on such agreements in his business career, according to current and former administration employees. But NDAs have not been widely used by past administrations outside the transition time between presidents, in part because most legal experts believe such agreements are not legally enforceable for public employees. Copies of Trump NDAs obtained by The Washington Post or described by current and former aides lay out breathtakingly broad prohibitions on behavior and appear to be drawn heavily from similar contracts used in the past by the Trump Organization, the president’s family firm. Under one agreement from the 2016 campaign, signers promised not to “demean or disparage publicly” Trump, his company or any member of his family — and also not to assist any other politician exploring a federal or state office. An agreement circulated in the White House last year barred signers from sharing any information they had learned in the building, according to several aides who signed the document. And the agreement proposed to Manigault Newman after her firing from the White House would have forbidden her from releasing derogatory information not only about Trump and his family, but about Vice President Pence and his family as well.)

(FROM THE ARTICLE: The vast majority of Americans who work into in their 50s, 60s and beyond need to keep making money as they grow older but encounter widespread age discrimination in job hunts and at the workplace, a new AARP survey has found. AARP surveyed 3,900 people age 45 and older who were working full-time or part-time or looking for work and learned that more than nine in 10 older workers see age discrimination as common. And 61% say they’ve personally seen or experienced it. Women are more likely than men to have seen or experienced age discrimination, according to the survey. More than three quarters of African-American respondents, 60% of Latinos and 59% of whites reported seeing or experiencing it. What AARP Says About Age Discrimination “Older workers want to work, they’re ready to work and they need to work,” said Susan Weinstock, AARP’s vice president of financial resilience. “They should have the opportunity to be judged on their merits, rather than their age.” But the survey results strongly suggest older job applicants routinely are denied that opportunity. Since turning 40, a striking 30% of respondents experienced at least one of these six actions and 17% experienced two or more: not getting hired for a job they applied for because of their age; heard negative remarks related to their older age from a colleague; passed up for a chance to get ahead because of their age; heard negative remarks related to their older age from a supervisor; were laid off, fired or forced out of job because of their age or were denied access to training or professional development opportunities because of their age. Among respondents who’ve applied for a new position in the past two years, 44% said they were asked for age-related information such as birth dates and graduation years. Such information is often used to discriminate against older applicants and requests for it discourage many older workers from applying, according to AARP. Fears of Getting Hired After a Job Loss About one third of the survey respondents said they doubted they’d be able to quickly land another job if theirs was eliminated. Almost half of them said the major reason would be age discrimination. Government data shows that nearly one third of workers 55 and older who lose their jobs are unemployed a financially-dangerous six months or more. By contrast, just 18% of those ages 16 to 54 are out of work similar periods. The AARP survey also suggests that most older workers don’t think they have much protection against age discrimination. While a majority reported seeing or experiencing age bias, barely 3% said they’d filed a formal complaint with an employer or government agency.)

CHICAGO TRIBUNE
— Despite 2 voter rejections, Wheaton-Warrenville Community Unit School District 200 plans to construct new building — and gets sued over it – Bob Goldsborough (DIERSEN: What are your connections with this issue? My wife and I have paid real estate taxes big time to District 200 since 1978. We have never attended any District 200 school and we have never sent any child to any District 200 school. The District 200 headquarters is in my precinct as well as Whittier Grade School and Edison Middle School. Janet Shaw is a fellow Milton Township Republican Precinct Committeeman. I know Dan Wagner and his wife. I understand that the lawsuit has been assigned to Judge Bonnie Wheaton.)
http://www.chicagotribune.com/suburbs/ct-met-wheaton-school-preschool-project-20180806-story.html
(FROM THE ARTICLE: Twice since 2013, voters in the Wheaton and Warrenville area have rejected referendum proposals to raise taxes for the construction of a new preschool. Despite that, the Community Unit School District 200 board is proceeding with building a new Jefferson Early Childhood Center without voter approval through a different form of financing. But now a resident who opposes that measure has sued the district in DuPage County Circuit Court, seeking to halt the plans. Those in favor of building a new childhood center call the current 26,500-square-foot building outdated and note that the district in recent years has renovated or built anew every other school building except Jefferson. Jefferson, which was constructed in 1958 and had 277 pupils as of June, offers a traditional preschool and early childhood intervention for youths with mental or physical disabilities. Voters rejected a referendum proposal for a new Jefferson school in 2013, and again said no in 2017 as part of a much larger, $132 million proposal involving other district schools as well. Board President Jim Vroman said that after the 2017 referendum proposal failed, the district surveyed voters and found that “a substantial majority” supported building a new Jefferson. “That told us that voters were against the tax increase that the referendum would have generated if we had proceeded,” he said. Instead, the board agreed with a suggestion by a district financial adviser to use lease certificates, or secured lease credit financing, to fund a new Jefferson. District 200 would oversee construction of the estimated $15.5 million, 41,544-square-foot building, while Zions Bank would own the building. . .Frequent board critic Janet Shaw, who runs a blog that scrutinizes the district’s finances, long has questioned the legality of using lease certificates and added that “my real problem is that we don’t need (the new school building).” Shaw has filed suit against District 200, demanding a halt to the current plan to finance a new Jefferson. She is seeking a judge to require District 200’s board to submit a proposal for the new school building to the public via a referendum question. “District 200 is tampering with election results right here in DuPage County,” Shaw said. “The district thinks that by using the magic word ‘lease,’ its two failed referendum efforts and the will of the community are somehow erased and it can proceed in an identical manner as if a referendum had been adopted by the community to build and finance a new school.” A district spokesperson declined to comment on the lawsuit. Dan Wagner, a parent and longtime proponent of a new Jefferson, called the existing building outmoded, with some instruction occurring in converted broom closets. He added that the building lacks air conditioning, which precludes some special needs pupils from participating in gym classes.)

(FROM THE ARTICLE: The Northwest Side (NWS) GOP Club, which touts itself as union-friendly, has added another leader with union ties to its ranks. The club recently announced Erin Jones was appointed precinct committeeman for Chicago’s 39th Ward. “Erin is a rock-star and a loyal member of the NWS GOP Club.” club officials said. “As a first-responder family, Erin and her husband serve the community both on and off-duty. We are happy to have her in a leadership role.” As a committeeman, Jones will represent the GOP voters of the precinct at the county level. “I grew up in Rogers Park and moved to the Northwest Side nine years ago,” Jones said. “I’ve been a Chicago police officer for the last 15 years, spending 10 of those years in patrol on the Westside of the City. I actually started working for the city when I was a teenager as a lifeguard in Rogers Park.” Jones is married to a Chicago firefighter and has two daughters. She was appointed by Matt Podgorski, NWS GOP Club chairman and 39th ward committeeman. The NWS GOP Club also has a party planned for Aug. 11 to welcome its card-carrying union members and encourage other union members to explore the club. Republican candidate and Chicago police sergeant Ammie Kessem is slated to attend the event. Kessem is challenging incumbent Rep. Robert Martwick (D-Chicago) for Illinois’ 19th House District seat in November’s general election.)

LEGAL NEWS LINE
— EEOC Sues The University of Wisconsin System for Age Discrimination – EEOC (DIERSEN: Needless-to-say, EEOC should sue the federal government. The federal government wastes the careers of and gets rid of its employees who are Republican, White, male, and/or non-veteran who the federal government does not promote to GS-13 (currently $96,403) by age 25, GS-14 (currently $113,920) by age 30, GS-15 (currently $134,000) by age 35, and Senior Executive Service (currently $164,200) by age 40.)
https://legalnewsline.com/stories/511525152-u-s-equal-employment-opportunity-commission-eeoc-sues-the-university-of-wisconsin-system-for-age-discrimination
(FROM THE ARTICLE: The University of Wisconsin System violated federal law when it refused to hire a former longtime employee because of her age, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed. According to the EEOC’s lawsuit, Bambi Butzlaff Voss, who was 53 years old and subject to a layoff from her job as a Marketing and Communications Specialist at the University of Wisconsin’s Waukesha campus, applied for six different positions with the University of Wisconsin System’s central office in Madison, including an Associate Marketing and Communications Specialist position. Butzlaff Voss had 25 years of experience performing tasks similar, if not identical, to the ones in the position she applied for. But, because of Butzlaff Voss’s age, the University refused to hire her. Instead, it hired a 23-year-old candidate with less than two years of experience. Such alleged conduct violates the Age Discrimination in Employment Act of 1967 (ADEA). The EEOC sued in U.S. District Court for the Western District of Wisconsin (EEOC v. Board of Regents of the University of Wisconsin System, Civil Action No: 3:18-cv-00602) after first trying to settle through its conciliation process. The lawsuit asks the court to order the University to hire Butzlaff Voss and provide back pay as well as pay liquidated damages. The lawsuit also seeks a permanent injunction prohibiting the University from discriminating against future candidates based on their age. “The Age Discrimination in Employment Act has been on the books for five decades,” said Gregory Gochanour, regional attorney for the EEOC’s Chicago District. “The EEOC will make sure employers follow the law, even if it means going to court to get the message across.” Julianne Bowman, district director of the EEOC’s Chicago District, said, “Workers over 40 years of age should have the same opportunities as those workers less than half their age. Ignoring a candidate’s decades of experience relevant to the available job, because of her age, to hire someone with less than two years of experience is illegal discrimination.”)

At the same time, he has annoyed his own party so much with his moderate social positions and budget woes that he barely survived a primary in the spring, inspiring a third-party bid from a conservative candidate. “Bruce Rauner thought he could be Scott Walker when he got elected,” Thomas Bowen, a Democratic strategist and former political director for Mayor Rahm Emanuel of Chicago, said, referring to the Republican governor of Wisconsin. “He forgot that Walker had a supermajority in the state legislature and he did not.” “There was a playbook for how to be a Republican in Illinois that’s been replayed over and over,” Mr. Bowen said. “Be fiscally astute, compromise and don’t pick fights unnecessarily.” Mr. Rauner will face a formidable opponent in J. https://www.houstonchronicle.com/local/gray-matters/article/trump-white-house-media-kaitlan-collins-cnn-13144480.php
(FROM THE ARTICLE: As long as reporters have covered government officials, they’ve sought greater access than the government was willing to allow. The White House excluded a CNN reporter from an international trade announcement with the president of the European Commission on July 25, in apparent retaliation after she shouted unwelcome questions at President Donald Trump during an Oval Office appearance. Many observers viewed this move as an escalation of the Trump administration’s hostility toward journalists. The Washington Post called the decision to exclude CNN’s Kaitlan Collins “highly unusual and possibly unprecedented.” Sen. Richard Blumenthal, D-Conn., called it “an offense against the First Amendment interests of all of us.” But did the White House actually violate the Constitution? As a media law professor, I regularly remind students that the First Amendment right of access to government officials, records and events is surprisingly uncertain. The First Amendment guarantees all Americans freedom to speak and publish without government interference. It has been broadly interpreted by the Supreme Court to forbid the government from restraining or punishing a speaker based on the content of the speaker’s message. While journalists have a clearly established First Amendment right to publish the news they’ve gathered — even in extreme cases, like the leak of stolen Pentagon documents — it’s much less clear that the First Amendment protects the right to gather the news in the first place. A right to publish, but not a ‘right to gather’? CNN has not indicated that it plans to take any legal action over Collins’ exclusion. In addition to being awkward — imagine a journalist taking the witness stand to testify against the White House communications director — a court case over a withdrawn invitation would face legal obstacles. The courts have refused to recognize an overarching “constitutional right of access” to government information. Instead, they have picked off cases with narrow, specific rulings. For instance, the Supreme Court recognized in Richmond Newspapers v. Virginia that there is a constitutional right to cover a criminal trial. Likewise, federal appeals courts agree the First Amendment guarantees the right to videotape police making arrests in a public place. At the same time, judges have found no constitutional right to obtain government documents or to enter crime scenes that are off-limits to the public. Does CNN’s White House correspondent, or any journalist, have a First Amendment “right” to a press pass or a spot at a news conference? Since the Supreme Court said in its 1972 Branzburg ruling that journalists have no right to insist on greater access than the general public, probably not. That being said, journalists do have a right not to be retaliated against, regardless of what form the retaliation takes. Retaliatory exclusions can violate the law Even if attending a White House event is not a constitutionally guaranteed right, that doesn’t mean the government is free to take it away as a punishment. The government cannot take away even a purely discretionary privilege if the motive is to penalize speech. Even though there is no entitlement to hold a government job, the Supreme Court decided in 1966 that public employment cannot be denied on the basis of viewpoint. And even though there is no entitlement to receive a discretionary government grant, the justices ruled in 2013 that a grant cannot be denied because the applicant expresses a view different from the government’s. In other words, any action by a government agency intended to punish or deter a speaker for unwanted speech can violate the Constitution. That same legal principle would apply today if a federal official denied a government “privilege” to a journalist on the basis of a disagreeable viewpoint. In the CNN situation, if Collins lost something of value, like the ability to attend a presidential appearance, because of the content of her speech, she has the essential ingredients of a First Amendment case. The White House likely would argue that it was Collins’ method of delivery — raising her voice, after being asked not to — and not the content of her message that earned her a disinvitation. That would make a First Amendment claim blurrier. overnment agencies can regulate the “time, place and manner” of speaking, the Supreme Court has ruled, as long as the restrictions are reasonable and enforced evenhandedly. Were a case to go to court, Collins and CNN might have to demonstrate that other journalists have shouted friendlier questions without consequence. Journalists’ rights need clarifying)

(FROM THE ARTICLE: The ordinance would require Chicago employers to post work schedules for their employees at least two weeks in advance. Employers would be required to pay their employees for at least one hour extra if the schedule changed or work was added or subtracted. Companies also could face fines of $500 for each employee affected in each pay period if they fail to comply. If employers make changes with 24 hours’ notice or less to on-call workers, the workers would have to be compensated. Companies with hourly employees or salaried workers earning less than $50,000 annually would be affected. That would sweep thousands of Chicago businesses under the new rules, the Chicagoland Chamber of Commerce says. There’s a lot more heavy-handedness in the 17-page ordinance affecting hiring, part-time workers and flexibility. Before they begin work, for example, new hires must be given in writing the median number of hours they can expect to work and a list of days and times they will not be expected to work.)

PHILADELPHIA INQUIRER
— DIERSEN HEADLINE: Fox News host Laura Ingraham slammed by anti-Trumps over immigration comments involving Philadelphia.
http://www.philly.com/philly/news/nation_world/laura-ingraham-fox-news-immigration-sanctuary-cities-demographic-changes-20180809.html
(FROM THE ARTICLE: Controversial Fox News host Laura Ingraham is once again the target of criticism, this time over comments she made about the country’s changing demographic landscape, which she blamed on illegal — and legal — immigration. “Massive demographic changes have been foisted upon the American people, and they are changes that none of us ever voted for, and most of us don’t like,” Ingraham said on The Ingraham Angle on Wednesday night, noting that “it does seem like the America that we know and love doesn’t exist anymore.” “From Virginia to California, we see stark examples of how radically, in some ways, the country has changed,” Ingraham continued. “Now, much of this is related to both illegal, and in some cases legal, immigration that, of course, progressives love.”)

CHICAGO TRIBUNE
— Roskam releases new ad
http://www.chicagotribune.com/news/local/politics/ct-met-morning-spin-thursday-20180808-story.html
(FROM THE ARTICLE: Republican U.S. Rep. Peter Roskam released an ad Wednesday questioning his 6th Congressional District Democratic opponent Sean Casten’s business background. Among other things, a narrator in the 30-second ad says Casten “brags about his business credentials” but “inherited millions and worked for his family’s business.” The ad also references a 2015 business-related lawsuit filed in Delaware that Casten was involved in. The ad says that if he’s elected Casten would “make things worse.” Casten’s campaign released a statement saying the lawsuit referenced in the ad was related to “an attempted hostile takeover” that was “amicably resolved.” Casten’s campaign manager Greg Bales said Roskam “wants to muddy up Sean’s record as a successful green-energy entrepreneur because it contrasts so sharply with his own record of rubber-stamp partisanship.” Roskam, of Wheaton, is a veteran of state and national politics seeking a sixth term in Congress. Casten is a clean-energy entrepreneur from Downers Grove and political newcomer who emerged from a crowded Democratic primary field in March.)
