While this is a very small number, GAO notes that even a few cases of employee misconduct can have significant impacts on workplace morale and impede an agency’s efforts to achieve its mission. Based on data from the Office of Personnel Management, federal agencies made 10,249 suspensions, 7,411 removals, and 114 demotions for misconduct in 2016. (FROM THE ARTICLE: The federal government officially outlawed age discrimination in the workplace 50 years ago and therefore it is now nothing but a distant memory. We now pause for the laughter to die down. Unfortunately, it is still with us—as are a number of other forms of bias also outlawed around the same time, not incidentally—according to the very agency that enforces the law in the federal workplace as in other workplaces, the Equal Employment Opportunity Commission. The Age Discrimination in Employment Act was passed in 1967 but its effective date was put off until June of the following year. The law barred discrimination on grounds of age with respect to any term, condition, or privilege of employment; barred retaliation for opposing employment practices that discriminate based on age or for filing an age discrimination charge; and generally barred including age preferences in job notices. Protection against bias on the basis of advanced age was an admirable foresight in a nation awash with young baby boomers. However, “After 50 years of a federal law whose purpose is to promote the employment of older workers based on ability, age discrimination remains too common and too accepted,” says an EEOC report. “Despite decades of research finding that age does not predict ability or performance, employers often fall back on precisely the ageist stereotypes the ADEA was enacted to prohibit.” While quantifying age discrimination is difficult—in part because, like other forms of discrimination it often is not formally reported—“the perception that age discrimination exists in our workplaces is prevalent,” it said. It cited a recent survey finding that more than 6 in 10 workers age 45 and older say they have seen or experienced age discrimination in the workplace and of those, 90 percent say it is somewhat or very common. This most frequently takes the form of unlawful firing, harassment, discriminatory terms of employment and discriminatory discipline, said the assessment of the nationwide workforce whose findings should be of special concern in the generally older federal workforce. Let’s begin with a basic premise: To obtain a job, you must possess a skill set, or at least the aptitude to develop the skills needed. Employment then becomes a form of contract. The employer agrees to pay the employee money and benefits in exchange for job performance consistent with defined requirements and standards. This should be obvious. However, in today’s environment we need to add a second premise: In a rapidly changing world, jobs and organizations must continually evolve, grow, and adapt to be effective. This applies to government, not just the private sector. It should be easy, right? Unfortunately, it’s not. Achieving the following three things would go a long way toward improving the performance and accountability of federal employees.)

(FROM THE ARTICLE: Twice since 2013, voters in the Wheaton and Warrenville area have rejected referendum proposals to raise taxes for the construction of a new preschool. Despite that, the Community Unit School District 200 board is proceeding with building a new Jefferson Early Childhood Center without voter approval through a different form of financing. But now a resident who opposes that measure has sued the district in DuPage County Circuit Court, seeking to halt the plans. Those in favor of building a new childhood center call the current 26,500-square-foot building outdated and note that the district in recent years has renovated or built anew every other school building except Jefferson. Jefferson, which was constructed in 1958 and had 277 pupils as of June, offers a traditional preschool and early childhood intervention for youths with mental or physical disabilities. Voters rejected a referendum proposal for a new Jefferson school in 2013, and again said no in 2017 as part of a much larger, $132 million proposal involving other district schools as well. Board President Jim Vroman said that after the 2017 referendum proposal failed, the district surveyed voters and found that “a substantial majority” supported building a new Jefferson. “That told us that voters were against the tax increase that the referendum would have generated if we had proceeded,” he said. Instead, the board agreed with a suggestion by a district financial adviser to use lease certificates, or secured lease credit financing, to fund a new Jefferson. District 200 would oversee construction of the estimated $15.5 million, 41,544-square-foot building, while Zions Bank would own the building. . .Frequent board critic Janet Shaw, who runs a blog that scrutinizes the district’s finances, long has questioned the legality of using lease certificates and added that “my real problem is that we don’t need (the new school building).” Shaw has filed suit against District 200, demanding a halt to the current plan to finance a new Jefferson. She is seeking a judge to require District 200’s board to submit a proposal for the new school building to the public via a referendum question. “District 200 is tampering with election results right here in DuPage County,” Shaw said. “The district thinks that by using the magic word ‘lease,’ its two failed referendum efforts and the will of the community are somehow erased and it can proceed in an identical manner as if a referendum had been adopted by the community to build and finance a new school.” A district spokesperson declined to comment on the lawsuit. Dan Wagner, a parent and longtime proponent of a new Jefferson, called the existing building outmoded, with some instruction occurring in converted broom closets. He added that the building lacks air conditioning, which precludes some special needs pupils from participating in gym classes.)

(FROM THE ARTICLE: The University of Wisconsin System violated federal law when it refused to hire a former longtime employee because of her age, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed. According to the EEOC’s lawsuit, Bambi Butzlaff Voss, who was 53 years old and subject to a layoff from her job as a Marketing and Communications Specialist at the University of Wisconsin’s Waukesha campus, applied for six different positions with the University of Wisconsin System’s central office in Madison, including an Associate Marketing and Communications Specialist position. Butzlaff Voss had 25 years of experience performing tasks similar, if not identical, to the ones in the position she applied for. But, because of Butzlaff Voss’s age, the University refused to hire her. Instead, it hired a 23-year-old candidate with less than two years of experience. Such alleged conduct violates the Age Discrimination in Employment Act of 1967 (ADEA). The EEOC sued in U.S. District Court for the Western District of Wisconsin (EEOC v. Board of Regents of the University of Wisconsin System, Civil Action No: 3:18-cv-00602) after first trying to settle through its conciliation process. The lawsuit asks the court to order the University to hire Butzlaff Voss and provide back pay as well as pay liquidated damages. The lawsuit also seeks a permanent injunction prohibiting the University from discriminating against future candidates based on their age. “The Age Discrimination in Employment Act has been on the books for five decades,” said Gregory Gochanour, regional attorney for the EEOC’s Chicago District. “The EEOC will make sure employers follow the law, even if it means going to court to get the message across.” Julianne Bowman, district director of the EEOC’s Chicago District, said, “Workers over 40 years of age should have the same opportunities as those workers less than half their age. Ignoring a candidate’s decades of experience relevant to the available job, because of her age, to hire someone with less than two years of experience is illegal discrimination.”)

(FROM THE ARTICLE: As long as reporters have covered government officials, they’ve sought greater access than the government was willing to allow. The White House excluded a CNN reporter from an international trade announcement with the president of the European Commission on July 25, in apparent retaliation after she shouted unwelcome questions at President Donald Trump during an Oval Office appearance. Many observers viewed this move as an escalation of the Trump administration’s hostility toward journalists. The Washington Post called the decision to exclude CNN’s Kaitlan Collins “highly unusual and possibly unprecedented.” Sen. Richard Blumenthal, D-Conn., called it “an offense against the First Amendment interests of all of us.” But did the White House actually violate the Constitution? As a media law professor, I regularly remind students that the First Amendment right of access to government officials, records and events is surprisingly uncertain. The First Amendment guarantees all Americans freedom to speak and publish without government interference. It has been broadly interpreted by the Supreme Court to forbid the government from restraining or punishing a speaker based on the content of the speaker’s message. While journalists have a clearly established First Amendment right to publish the news they’ve gathered — even in extreme cases, like the leak of stolen Pentagon documents — it’s much less clear that the First Amendment protects the right to gather the news in the first place. A right to publish, but not a ‘right to gather’? CNN has not indicated that it plans to take any legal action over Collins’ exclusion. In addition to being awkward — imagine a journalist taking the witness stand to testify against the White House communications director — a court case over a withdrawn invitation would face legal obstacles. The courts have refused to recognize an overarching “constitutional right of access” to government information. Instead, they have picked off cases with narrow, specific rulings. For instance, the Supreme Court recognized in Richmond Newspapers v. Virginia that there is a constitutional right to cover a criminal trial. Likewise, federal appeals courts agree the First Amendment guarantees the right to videotape police making arrests in a public place. At the same time, judges have found no constitutional right to obtain government documents or to enter crime scenes that are off-limits to the public. Does CNN’s White House correspondent, or any journalist, have a First Amendment “right” to a press pass or a spot at a news conference? Since the Supreme Court said in its 1972 Branzburg ruling that journalists have no right to insist on greater access than the general public, probably not. That being said, journalists do have a right not to be retaliated against, regardless of what form the retaliation takes. Retaliatory exclusions can violate the law Even if attending a White House event is not a constitutionally guaranteed right, that doesn’t mean the government is free to take it away as a punishment. The government cannot take away even a purely discretionary privilege if the motive is to penalize speech. Even though there is no entitlement to hold a government job, the Supreme Court decided in 1966 that public employment cannot be denied on the basis of viewpoint. And even though there is no entitlement to receive a discretionary government grant, the justices ruled in 2013 that a grant cannot be denied because the applicant expresses a view different from the government’s. In other words, any action by a government agency intended to punish or deter a speaker for unwanted speech can violate the Constitution. That same legal principle would apply today if a federal official denied a government “privilege” to a journalist on the basis of a disagreeable viewpoint. In the CNN situation, if Collins lost something of value, like the ability to attend a presidential appearance, because of the content of her speech, she has the essential ingredients of a First Amendment case. The White House likely would argue that it was Collins’ method of delivery — raising her voice, after being asked not to — and not the content of her message that earned her a disinvitation. That would make a First Amendment claim blurrier. overnment agencies can regulate the “time, place and manner” of speaking, the Supreme Court has ruled, as long as the restrictions are reasonable and enforced evenhandedly. According to my mechanic it’s ethanol in our gasoline. To understand how this happens you need to know how ethanol affects your fuel system. Ethanol itself is not particularly corrosive. When the oil companies first started blending ethanol in gas, it corroded some rubber and plastic gaskets on some cars and equipment. Manufacturers figured it out and substituted new materials. The unlucky consumers whose equipment was ruined or whose fuel systems had to be replaced just took it on the chin as per usual with most government programs. But that wasn’t the end of it. Ethanol attracts water. When the two get together, they create the perfect environment to grow a type of bacteria called acetobacter. After getting drunk on their EPA-sponsored kegger in your gas tank, the acetobacter excrete acetic acid. And acetic acid is very corrosive. If you’re refilling your gas tank every week or two, acetobacter don’t have time to grow a sufficient size colony to damage metal parts in your fuel system. But if your fuel sits for longer periods of time these microorganisms continue to multiply until your gas tank contains damaging levels of acetic acid.)

(FROM THE ARTICLE: Tuesday’s primary runoff will be another test for Alabama’s crossover voting ban. The Alabama Legislature passed a law in 2017 banning crossover voting. The law specifically prohibits voters from casting a ballot for one party in a primary and then switching to the other party to cast a ballot in the runoff. Simply put: If you voted on the Democratic ballot in the primary, you can only vote in the Democratic runoff. If you voted a Republican ballot in the primary, you can only vote in the Republican runoff. If you didn’t vote in the primary, you are free to cast a ballot in whichever party runoff you choose. No matter what your vote, there are no restrictions on the Nov. 6 general election, where you can choose whichever candidate you prefer. Gov. Kay Ivey signed the crossover voting ban law in 2017. At the time, Sen. Tom Whatley, R-Auburn, said the bill “helps the Democrats choose Democratic candidate” and helps “Republicans choose Republican candidates.” Enforcing the ban In the October special U.S. Senate election to replace Jeff Sessions, Secretary of State John Merrill said his office had identified 674 cases in which people voted in the Democratic primary election on Aug. 15, 2017 and then crossed over to vote in the Republican runoff election on Sept. 26, 2017. A later review found most of the voters in question were on the wrong list. One-hundred-forty instances of crossover voting were confirmed but none were deemed necessary by local probate judges to investigate further or pursue prosecution, Merrill’s office said. Merrill has been mum on if crossover violators will be prosecuted this time, however. In an update from his office, Merrill only reminded voters of the rules and encouraged people to get out and vote. “Some candidates for both parties have already been selected, but voters are encouraged to return to the polls to make the final selections for their party representatives,” Merrill said.)
