Members voted 5-4 Tuesday to direct staff to prepare the documentation needed to opt out of the retail sale of adult-use cannabis under the terms of the new state law, which goes into effect Jan. 1. The vote came after public comment from more than 15 people, including two businesses that want permission to sell pot in the city and representatives from behavioral health centers who are opposed to it. Council members Theresa Sullivan, Patty Gustin, Paul Hinterlong, Kevin Coyne and Patrick Kelly voted to opt out of allowing the retail sale of recreational cannabis. Those voting in favor were Benny White, Judy Brodhead, John Krummen and Mayor Steve Chirico. . .Residents and council members who spoke against the selling it in Naperville said it to approve it would be contrary to the city’s positive image, detrimental to public safety and potentially harmful to youth. “There is nothing family friendly about recreational marijuana. Family friendly is Naperville’s brand,” resident Jennifer Taylor said. . .Gustin reminded her fellow council members that while there may be benefits from a medical standpoint, the sale and use of marijuana is still against the law in the eyes of the U.S. government. “This is a federally illegal product,” Gustin said. “The federal government has not legalized marijuana because it’s a drug. Selling recreational marijuana will draw the nuisance to Naperville.” With Tuesday’s vote, city staff will prepare the necessary documents for an official council vote to opt out of the retail sale of recreational marijuana later in the year. . .Councilman Coyne said allowing recreational marijuana just because the city already sells alcohol and cigarettes doesn’t make sense. “We should allow and accept marijuana because alcohol is already here. We have one bad habit in town, so we should add another? I don’t buy into that,” Coyne said. Matt Quinn, community relations coordinator with Rosecrance, said teens perceive marijuana use as less risky than they did in the past. Quinn urged council to “not be naive” about the law requiring pot consumers to be 21 or older. Teens push boundaries, he said.)

Qualified individuals will be asked to submit resumes or applications that will be reviewed by council and made available to the public for its review. The candidates will all be interviewed in an open meeting and a vote on the new council member will take place in the open. Anyone who fills a vacant seat in the middle of a term has to establish their legitimacy as a full-fledged, creditable member of the council because they were not elected directly by the voting public. But the council’s decision to hold their deliberations in public and to let the public hear from the candidates before a candidate is chosen, will go a long way torward establishing the bona fides of the eventual appointee. With Roxboro’s council currently operating without hospitalized council member Sandy Stigall, the body is at a bare minimum. (FROM THE ARTICLE: Before the requests from Green Thumb Industries and Grassroots Cannabis can be considered, however, the Naperville City Council must decide if they will allow pot to be sold within city limits and, if yes, what kind of restrictions should be in place and what kind of tax should be charged. The discussion will start at Tuesday’s council meeting. . .While municipal officials cannot restrict the consumption of cannabis in their towns, they can opt out of allowing adult-use cannabis dispensaries or place restrictions on such things as the number allowed and where they can be located, according to city documents. The new law allows only companies with existing medical marijuana dispensaries to begin selling recreational pot Jan. 1. Those companies will be allowed to sell cannabis from their current medical locations and one additional retail location, if approved by the municipality. There are currently 55 medical cannabis dispensaries in Illinois. Future dispensary licenses are expected to be issued by the state to non-medical license holders beginning in mid-2020. Should city council members approve the sale of recreational cannabis, Naperville officials would have to amend zoning code. The city can change its existing medical cannabis ordinance so it applies to adult-use cannabis dispensaries, city documents said. The ordinance as currently written includes language on where dispensaries are permitted and how far they must be from schools and residential areas.)
