(FROM THE LETTER: Responding to your editorial entitled, “Not enemies, but voice of the people,” please note that Pope Francis addressed the issue of “fake news” in a message for Communications, last January. How did he describe fake news? “The term ‘fake news’ has been the object of great discussion and debate. In general, it refers to the spreading of disinformation on line or in the traditional media. It has to do with false information based on non-existent or distorted data meant to deceive and manipulate the reader. Spreading fake news can serve to advance specific goals, influence political decisions, and serve economic interests.” He goes on to say “Disinformation thus thrives on the absence of healthy confrontation with other sources of information that could effectively challenge prejudices and generate constructive dialogue …” His whole message has to do with truth. However, your editorial did not mention truth; up front, it said it is the “voice of the people.” Well, which people? Maybe on your editorial page (one of many pages), you give half time to one side of an issue, half time to the other side (maybe). But for the rest of the pages, your paper is the voice of those in your employ. What is the ratio of Democrat to Republican in your employ? What is the ratio of Trump supporters to Trump haters in your employ? Let us know, and then we can decide if your paper is an enemy of people you don’t agree with …)

(FROM THE ARTICLE: “Social Media is totally discriminating against Republican/Conservative voices,” and “the Trump Administration … won’t let that happen.” So wrote President Trump on Twitter Saturday, in a shot across the bow of increasingly Orwellian social-media companies. This comes on the heels of a Friday discrimination complaint the administration filed against Facebook alleging that “the way the company targets ads can be used to screen out people based on race, sex or other protected categories,” reports the Washington Times. While the latter complaint doesn’t relate to the censorship issue, it perhaps does signal the Trump administration’s determination to deal with social-media sleight-of-hand. As for its substance, the Times explains: The complaint goes to the heart of Facebook’s business model, which depends on being able to offer advertisers micro-targeting. “Facebook mines extensive user data and classifies its users based on protected characteristics. Facebook’s ad targeting tools then invite advertisers to express unlawful preferences by suggesting discriminatory options,” the Housing and Urban Development Department said in the complaint. Among those options are physical disabilities, parents with children and even religious practices — advertisers are allowed to show their ads only to people Facebook deems interested in “Jesus” or the “Christian Church,” for example.)

(THE ARTICLE: In 1980, when I was 31 years old, I took a $19,203 (26%) pay cut in today’s dollars to transfer from IRS to GAO – a downgrade from GS-12 Step 5 (currently $91,880) to GS-9 Step 10 (currently $72,677). According to the Office of Personnel Management, 77% of current federal employees have worked for only one agency, 15% have worked for two agencies, and only 8% have worked for three or more agencies. I worked for the Post Office 1966-1969, for IRS 1971-1980, and for GAO 1980-1997. I should write a book about transferring between federal agencies.

 

GAO audits IRS. In 1980, when I was 31 years old, my Democrat GAO superiors, supervisors, coworkers, and subordinates vehemently opposed my transferring from IRS to GAO. Instead of my taking a $19,203/year (26%) pay cut in today’s dollars, they wanted me to transfer in as an intern and take a $58,902/year (64%) pay cut in today’s dollars (a downgrade from GS-12 Step 5 to GS-4 Step 1). To justify that, they viciously demonized, viciously denigrated, and viciously condemned a) the knowledge of IRS that I had gained by working for IRS for almost 9 years, the last 5 1/2 years of which at the GS-12 Step 1-5 levels, currently $81,071-$91,880; b) my having passed the CPA examination on my first attempt in 1979; c) my having almost completed the requirements for a master’s degree in accounting from DePaul; d) my having earned an MBA from Loyola in 1976; and e) the fact that much of what GAO Analysts do is similar to what IRS Revenue Officers do.

 

They hinted/implied/argued that IRS should NOT have a) hired me in 1971, b) promoted me in 1972, 1973, or 1974, or c) let me work there for almost 9 years. They hinted/implied/argued that the Post Office should NOT have a) hired me in 1966 or b) let me work there for almost 3 years. They were disgusted, outraged, and beyond furious that I transferred in with almost 12 years of federal seniority, 30 unused vacation days, and more than 100 unused sick days. They hinted/implied/argued/shouted that legislative branch employees were far superior to executive branch employees. They stressed that I had been a union member while I worked for the Post Office and for IRS and that I had filed grievances.

 

To turn everyone at GAO against me, they stressed to GAO employees a) who were Democrats, that I was a Republican, b) who were liberal or moderate, that I was conservative, c) who were non-Protestant, that I was a Missouri Synod Lutheran, d) who had less money than my wife and I had, that my wife and I had more money than they did, e) who were non-German American, that I was 100% German American, f) who had ancestors who had not been in America for a long time, that my ancestors had been in America since 1844, and g) who were veterans, that I was a draft avoider. They would not have done any of the aforesaid if I had been a Democrat, a minority, a female, or a veteran.

 

Have you worked in toxic workplaces? Soon after I transferred from IRS to GAO in 1980 when I was 31 years old, I learned how toxic its Chicago office was for those who shared my demographics. Nevertheless, I counted on the GAO manager who had arranged for my transfer a) to protect me from political affiliation discrimination, from reverse discrimination, and from age discrimination, b) to get me assigned to audits of IRS, c) to get me promoted to GS-11 Step 10 (currently $87,933), to GS-12 Step 5 (currently $91,880), to GS-13 Step 1 (currently $96,403), etc. However, ever-increasingly, the Democrats who ran the office did everything that they could to get rid of him. Nevertheless, in 1986, he succeeded a) in getting me assigned to audits of IRS and b) in promoting me to GS-13 Step 1 (currently $96,403). However, the Democrats succeeded a) in getting rid of him in 1987, b) in throwing me off audits of IRS in 1989, c) in keeping me off audits of IRS for the rest of my GAO career, d) in giving me unfair performance expectations and unfair performance appraisals, e) in always ranking me the bottom half of my coworkers for pay-for-performance purposes, and f) in forcing me to take their early retirement “offer” in 1997 when I was 49 years old.)

We now pause for the laughter to die down. Unfortunately, it is still with us—as are a number of other forms of bias also outlawed around the same time, not incidentally—according to the very agency that enforces the law in the federal workplace as in other workplaces, the Equal Employment Opportunity Commission. Among respondents who’ve applied for a new position in the past two years, 44% said they were asked for age-related information such as birth dates and graduation years. Such information is often used to discriminate against older applicants and requests for it discourage many older workers from applying, according to AARP. Fears of Getting Hired After a Job Loss About one third of the survey respondents said they doubted they’d be able to quickly land another job if theirs was eliminated. Almost half of them said the major reason would be age discrimination. Government data shows that nearly one third of workers 55 and older who lose their jobs are unemployed a financially-dangerous six months or more. By contrast, just 18% of those ages 16 to 54 are out of work similar periods. The AARP survey also suggests that most older workers don’t think they have much protection against age discrimination. (FROM THE ARTICLE: For one of the most punitive agencies in the federal government, the IRS sure is forgiving with its own employees. Rep. Kristi Noem, R-S.D., has proposed a bill that would prevent the IRS from rehiring employees fired for misconduct or poor performance. The bill, titled the Ensuring Integrity in the IRS Workforce Act, follows a recent Treasury inspector general report that shows the IRS rehired more than 200 fired workers in a little over a year. A previous inspector general report proves this problem dates back to at least 2009. According to the Treasury Department’s inspector general, the IRS did not provide officials responsible for hiring decisions with information about employment history, though that information is readily available. As a result, the IRS—an agency with nearly unrivaled access to citizens’ personal information and capacity to harass individual taxpayers—rehired: A fired worker with several misdemeanor theft convictions and one count of felony possession of a forgery device. 11 employees previously disciplined for unauthorized access to taxpayer accounts. An employee who was absent without leave for 270 hours—the equivalent of 33 work days. An employee fired for physically threatening co-workers. An employee fired for lying about previous criminal convictions on employment forms. 17 employees previously caught falsifying official documents. Often, these employees do not have to wait long to get their old offices back. Two IRS employees fired for poor performance were rehired within six months. Faced with these findings, the IRS was unapologetic. In a response letter to the Inspector General’s Office, the IRS’ chief human capital officer wrote that the IRS “determined its current process is more than adequate to mitigate any risks to American taxpayers, federal agencies, and its employees.” Given that the IRS refuses to change its hiring process, swift congressional action is necessary. And Noem’s bill has a good chance to pass. In fact, a previous version of this legislation passed the House, 345-78, a little more than two years ago. These inspector general reports and the IRS’ response are especially disturbing given the IRS’ extraordinary power over citizens. No department or agency should be able to rehire employees fired for misconduct or poor performance. Future legislation should make federal employees non-hirable throughout the federal government. This may sound unduly harsh. After all, like private-sector managers, federal managers sometimes may be unfairly critical toward employees that rub them the wrong way. But, unlike in the private sector, there are multiple safeguards in place to prevent wrongful terminations. Fired federal employees have four separate agencies to help them challenge a termination. In many cases, an employee can have multiple agencies review their case one after another. Thorough to the point of absurdity, this complicated process of appeals (which I describe here) can tie up managers, arbitrators, and administrative judges for years. Given the incredibly high burden of firing one employee, many managers choose to ignore problem employees as long as possible. A recent survey found only 44 percent of federal employees agree that “steps are taken to deal with a poor performer who cannot or will not improve” in their workplace. On average, the federal government fires about 10,000 employees a year out of a workforce of 2.1 million. In other words, one in every 200 federal employees is fired in a given year. Only state and local education employees have greater job security. Given their rarity, it’s safe to assume that pink slips are well earned in the federal workforce. Recipients of this dubious distinction have gotten all the second chances they deserve. When federal employees are shown the door, they should not be let back in. Noem’s legislation is a long-overdue correction to federal personnel practices tailored to fit workers, rather than meet the mission.)
