(FROM THE ARTICLE: Weapons ban: House Bill 1564 Legal challenges to Illinois’ ban on the sale and purchase of assault-style weapons have mounted in recent weeks at the state and federal levels. The efforts have been led by Republicans, including three lawsuits from failed Attorney General candidate Thomas DeVore. Earlier this week, a split appellate court upheld a decision by an Effingham County judge to issue a temporary restraining order in favor of DeVore and the 886 plaintiffs he was representing. Through House Bill 1564, Republicans seek to repeal several provisions of the Protect Illinois Communities Act — signed into law as Public Act 102-1116 by Pritzker during the lame-duck session. Specifically, the bill from state Rep. Dave Severin, R-Benton, would remove the act’s language that prevents an individual’s ability to “knowingly possess an assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge,” as of Jan. 1, 2024. It would also return the firearm restraining order to six months instead of the current one-year order created by PICA. Severin is joined by nine other GOP co-sponsors in opposition to the ban passed under House Bill 5471. “The people that I represent, and indeed the people of our entire region believe the firearms ban that Governor Pritzker signed is a direct attack on Second Amendment rights, and I agree,” Severin said in a statement. “I am a pro-2nd Amendment legislator and always have been. (FROM THE ARTICLE: Illinois State Police say they took enforcement action against a business for openly advertising the sale of newly banned weapons, but no additional information was provided. In a YouTube video Friday, gun-rights advocate Todd Vandermyde revealed he’d been told that the state is taking actions to enforce the state’s ban on certain semiautomatic guns and magazines. “It appears that there was a gun shop that was selling stuff, post the enactment,” Vandermyde said after sharing an anonymous tip that state police confiscated weapons from an individual. Monday, a spokesperson for Illinois State Police confirmed in a statement to The Center Square that ISP took enforcement action earlier this month against a business for “openly advertising the sale of banned weapons.” The statement said the investigation is ongoing and additional information wasn’t immediately available. Vandermyde cautioned what he sees transpiring. Cook County Sheriff “Tom Dart and everybody can say there aren’t going to be house-to-house searches, I would beg to differ with you, sheriff,” Vandermyde said. While Dart has said they will enforce the gun ban, most of the state’s 102 sheriffs have said they won’t. ISP said Monday state police are “charged with upholding all state laws, including enforcement of businesses that openly violate current laws.” The law is being challenged in several state and federal judicial circuits. In McHenry County Monday, a motion was made to move its gun-ban challenge from state court to federal court. In several separate pending federal cases, ISP made a motion to consolidate into a Crawford County case last week. Chief U.S. District Judge Nancy Rosenstengel, an Obama appointee, reassigned two of those cases to Stephen McGlynn, a Trump-appointed judge. “The action arises out of the same facts and is closely related to [the Illinois State Rifle Association’s] Harrel, et al. v. Raoul … which was filed before this action and is assigned to District Judge Stephen P. McGlynn,” Rosenstengel said. The Crawford County case Langley v. Kelly was the first lawsuit filed against Illinois’ gun ban in state court, but it was transferred to federal court after the ISRA case was filed in federal court with a judge assigned. ISRA’s Ed Sullivan said while there are several independent cases in Illinois courts alleging individuals’ Second Amendment rights are being infringed, “we also have to keep an eye on the price elsewhere as well,” including a Second Amendment case filed in Maryland. “Because what happens elsewhere certainly can influence what happens here, so I think Maryland is the most obvious target for us to keep an eye out,” Sullivan told The Center Square. In that Maryland case, the U.S. Court of Appeals for the Fourth Circuit heard oral arguments Dec. 6. It’s unclear when a ruling would be rendered. Still pending in Illinois federal court is a ruling on a TRO in the challenge of Naperville’s gun ban. The judge in that case Monday notified the state that it is also a defendant after plaintiffs expanded their challenge last week. In a separate state challenge last week, state Rep. Dan Caulkins, R-Decatur, filed a lawsuit against the state’s gun ban. Caulkins is the lead plaintiff with a new association called Law-Abiding Gun Owners of Macon County. Attorney Thomas DeVore filed to intervene, claiming he has clients that don’t want to be part of a group he said may not stand legal scrutiny. “Dan is trying to take the position that my clients are members of an association that they never heard of and they never agreed to join and that could place some risk on them,” DeVore told The Center Square. “The attorney general might want to start deposing them.” DeVore filed an Effingham County challenge on behalf of 866 named plaintiffs. It is pending an appellate court decision of a lower court’s temporary restraining order blocking the law. A ruling on a TRO is pending in a White County case where DeVore represents nearly 1,700 named plaintiffs. Caulkins’ attorney Jerry Stock labeled DeVore’s filing as a “side show.” Stock argued he doesn’t need hundreds of plaintiffs in a case to prove the law is unconstitutional. “There was no way I was going to attempt to represent hundreds of clients when the remedy sought is a judgment, not the temporary time out,” Stock told The Center Square. “While we’ll seek that on this path, the real goal was to knock this legislation out. I thought that my firm taking a fee based on the volume of clients was not something I could be comfortable with ethically.” Stock said he wasn’t casting aspersions and people can hire any attorney they want, but he “very strongly disagrees” with DeVore’s approach. “I think it’s a far more liberal way of pursuing the claims,” Stock said. “And not having to implicate every individual gun owner or to charge every individual gun owner a fee, because it just was not necessary.” A hearing in Caulkins’ case is set for Friday in Macon County.)

(FROM THE ARTICLE: In Illinois, after disappointing and humiliating midterm election losses this past November that saw Democrats once again control every statewide office; maintain a supermajority in the Illinois House and Senate; dominate Illinois Supreme Court races; and beat Republicans in winnable congressional races – Republican Party Chairman Don Tracy refuses to step down, despite overseeing a Republican party that deliberately sent mailers attacking conservative grassroots candidates in the primary. In 2002, Don Tracy ran in the Illinois primary for the 50th State Senate District as a Democrat. In 2020, during the height of the pandemic, Tracy’s family-owned business, Dot Foods – where he is an owner, donated to Democratic presidential candidate Joe Biden. And new revelations uncovered by Illinois Review show that on September 4, 2020 – just months before his election as chairman of the Republican Party of Illinois, Tracy made a personal donation to Citizens for Judge Emily Sutton – a Democrat running for Circuit Court Judge in the 9th Judicial Circuit. Just prior to Tracy’s donation, Sutton received a boost from two influential Illinois Democrats – US Sen. Dick Durbin, D-IL and US Rep. Cheri Bustos, D-IL, who at the time, was chair of the Democratic Congressional Campaign Committee and a close ally of House Speaker Nancy Pelosi. And in the 2022 Illinois governor’s primary, several Republican state party officials, including the general counsel of the Illinois Republican Party John Fogarty and RNC national committeeman Richard Porter supported and endorsed RINO governor candidate Richard Irvin’s campaign, despite Irvin pulling Democratic Primary ballots in 2014, 2016 and 2020. Irvin also spent years praising Democratic Gov. JB Pritzker – referring to him as a “great friend and a great leader.” And in 2020, Irvin attended a Black Lives Matter rally, yelling, “I can’t breathe!” To this day, Porter defends Irvin’s Republican credentials, publicly referring to him as a “great Republican!” as witnessed by over 200 grassroot conservative Republicans during an Illinois Republican State Central Committee meeting in early December. Fogarty served as an attorney representing the Irvin campaign, in addition to being the staff attorney for the IL GOP, and Porter served as “honorary” co-chairman of the campaign, despite Tracy saying the IL GOP was “strictly neutral” during the governor’s primary. In December, Tracy, Porter and Demetra DeMonte, the other RNC national committeewoman, endorsed Romney-McDaniel for re-election as RNC chair. Fox News reported in November that Porter was circulating a support letter for Romney-McDaniel’s re-election bid amongst RNC committeemen. Just recently, Illinois Review published an article after numerous sources confirmed that Porter was quietly whipping votes among Illinois Republican State Central Committee members to amend the Bylaws to provide Porter and DeMonte with third terms as RNC national committeeman and committeewoman. The Bylaws were amended in 2015, as Porter and DeMonte began their first term, to limit national committeeman posts to two, four-year terms. Porter denies that this story is true – telling anyone who will listen that the story is full of lies, yet he refuses to publicly acknowledge that he will not seek a third term, requiring an amendment to the Bylaws. As chairwoman of the RNC, conservative grassroots Republican Harmeet Dhillon will have significant influence over the party’s direction in 2024 and beyond – and if elected, she’ll certainly have her work cut out for her. But ridding our party of RINO’s should be one of her top priorities – and censuring state party officials who hurt the conservative cause, rather than advance it, should be one of her first acts as RNC chairwoman. And Dhillon is well prepared for the task. As President Donald Trump’s lawyer, she has taken on the RINOs — Former Representatives Liz Cheney and Adam Kinzinger — and the rest of the House January 6th Committee in its ongoing witch hunt of the 45th President. Dhillon also waged war against California Gov. Gavin Newsom’s draconian lockdown orders. In actions like these and others, Dhillon has proven that she is the Lion that Republicans need right now. It’s hard enough battling Democrats in any election – it’s even harder when conservative grassroots candidates have to go to battle with their RINO party leaders and the statewide GOP establishment. (FROM THE ARTICLE: A behind-the-scenes process of redrawing election precincts in Kane County sparked concerns Friday about election integrity and what will be one of the shortest primary election campaign seasons in recent history. Recent state legislation approved in the wake of the decennial redistricting effort requires counties to redraw election precinct boundary lines by Jan. 15. The changes will affect every race on the 2022 ballot. New rules require precincts to sit within a single congressional and state legislative district whenever possible as well as a single county board district and municipal ward. Many counties regularly split or merge precincts to avoid them becoming too large or small for Democrat and Republican Party committeemen to properly represent constituents on partisan matters. Party committeemen are the foot soldiers of local political parties. The influence of those roles carries particular intrigue for local Republicans who are loyal to former President Donald Trump and continue to support the debunked claims of fraud in the 2020 election. The 2022 elections bring an opportunity for Trump loyalists to take control of the local party. Which voters live in which precincts will be a factor in that GOP battle. Kane County hasn’t adjusted its 291 precincts in nearly 20 years. That’s created 28 precincts that contain far more registered voters than the 1,200-voter cap target suggested by state legislation. Multiple precincts contain fewer than the 500 registered voters state law suggests is too small for a stand-alone precinct. A self-appointed team of workers in the county clerk’s office, information technology department, graphics information system staff, lawyers in the state’s attorney’s office and the chairman of the county board’s public service committee have spent the past several weeks redrawing the precinct boundaries. Kane County Board Chair Corinne Pierog has also been involved. She serves as vice chair of the Kane County Democrats. Except for Kane County Clerk Jack Cunningham, who is a Republican, all the elected officials involved so far are Democrats. The public will get a look at the redrawn precincts on Tuesday. There will be a final vote on the remap Friday, one day before the state deadline. That’s not enough review or involvement in the process for several GOP members of the county board. “It’s a farce to suggest this committee has had any role or involvement in this at all,” said Ken Shepro, a county board member and chairman of the Kane County Republican Party. “No member of this committee has been asked to participate in any of these meetings or give any guidance.” Fellow Republican Tom Koppie said the process and the tight deadlines mean the county board will be “forced to accept maps generated by the bureaucracy.” “I do not believe this is what the voting public anticipated or expects,” Koppie said.
