It is a key reason why Americans, age 40 and over, are fired or offered buyouts (with younger persons being hired in their place) and why they can’t find work after a period of unemployment and struggle to return to the workforce.  On Valentine’s Day, U.S. Sen. Bob Casey (D-Pa.), Ranking Member of the Special Committee on Aging, with cosponsors Sens. Chuck Grassley (R-Iowa), Patrick Leahy (D-Vt.) and Susan Collins (R-Maine) re-introduced S 485, The Protecting Older Workers Against Discrimination Act (POWADA). The bill was referred to the Senate Committee on Health, Education, Labor and Pensions. Fixing a Supreme Court Ruling Over a decade ago, a U.S. Supreme Court ruling in Gross v. FBL Financial Services weakened the Age Discrimination in Employment Act (ADEA) by imposing a significantly higher burden of proof on older workers alleging age discrimination than is required of workers alleging other forms of workplace discrimination. As a result, workers that allege age discrimination must meet an undue legal burden not faced by workers alleging discrimination based on race, sex, national origin or religion. This sent a clear signal to employers: some age discrimination is perfectly fine. Enacting the bipartisan POWADA bill would restore the pre-Gross standard, recognizing once again the legitimacy of so-called “mixed-motive” claims in which discrimination is a, if not the deciding, factor. It would also reaffirm that workers may use any type of admissible evidence to prove their claims.)

(FROM THE PRESS RELEASE: DuPage County State’s Attorney Robert Berlin and DuPage County Board Chairman Dan Cronin announced today that DuPage County has filed a lawsuit against Hot Shots Photography Studio, located at 0N758 Gary Avenue, Wheaton, alleging that the business has been operating as an adult business and not as a photography studio as advertised. This morning, the State’s Attorney’s Office filed a verified complaint for injunctive relief and zoning violations against Hot Shots, alleging violations of the DuPage County Zoning Ordinance and state statutes regarding the location of adult entertainment facilities and adult business uses. The lawsuit alleges that Hot Shots advertised on adult websites commonly used to advertise adult escort services by placing personal ads that included a telephone number to call for escort services. The suit alleges that respondents to the ad would be screened by an employee of Hot Shots and then directed to the Gary Avenue location. The lawsuit further alleges that once a respondent entered Hot Shots they were charged $100 as a cover fee and then directed to a room where the respondent would be met by an employee of Hot Shots who would discuss services and payment, with payment “ranging from $500 to $1,500.” The suit further alleges that after receiving payment, employees of Hot Shots would then engage in sexual activity with the respondent. In November, 2018, the DuPage County Sheriff’s Office began an undercover investigation into potential illegal activity and/or prostitution occurring at Hot Shots. The alleged findings of the investigation, according to the suit, “cause Hot Shots to be defined as an adult business use as defined in the DuPage County Zoning Ordinance, and thus constitutes a basis by which that use violates the ordinance.” Additionally, the suit alleges that “the business operations of Hot Shots are such that a significant or substantial portion of such operations involve an activity distinguished or characterized by its emphasis on matters depicting, describing or relating to specified sexual activities.”)

(FROM THE ARTICLE: Retirees across America consistently tell us that their annual COLAs simply are not adequate. And they have a reason to be concerned. Though the 2019 COLA is a decent 2.8%, these adjustments historically have not kept pace with seniors’ rising expenses. In fact, for three of the past 10 years there were no cost-of-living increases — zero. In 2017, the COLA was a scant 0.3% — or a meager $4 a month for the average beneficiary. Simply put, retirees need a COLA that accurately reflects the effects of inflation on their cost of living. The current index, the CPI-W, is pegged to urban wage earners’ living expenses, and tends to underestimate what seniors spend on big ticket items like housing and medical care. By the same token, retirees purchase less gasoline than working-age Americans, even though the cost of gas figures prominently into the current inflation index. As the Center for Retirement Security explains, “In 2016, retirees received no COLA specifically because the cost of oil plummeted. The low cost of gasoline offset [actual inflation] in other areas.” Fortunately, a better formula exists. It’s called the Consumer Price Index for the Elderly — or CPI-E — based on a ‘basket’ of goods and services that reflects older Americans’ spending patterns. The CPI-E just got a big boost from Congressman John Larson (D-Conn.), who included it in his bill to expand retirement benefits, The Social Security 2100 Act. “Seniors have been seeing rises in food…housing, and medical costs, without always receiving adequate increases in the COLA. We must do better and work toward a comprehensive solution,” Congressman Larson said.)

When asked about work complaints, students who were interviewed for this article mentioned their employers didn’t offer breaks, regularly shortened break time, disregarded previous schedule agreements and required them to work shifts less than 12 hours apart. How does this impact a student’s academic success and what can be done to help the current state of labor laws? These conditions may seem unfair or even illegal; however, these issues are completely acceptable under Texas law as Texas does not require that employers offer breaks, strictly stick to agreed work schedules or give workers fair time between shifts. The agency was originally created to ensure the effectiveness of human capital in the federal government, but it has since metastasized into an institutional nightmare that makes it almost impossible to fire any worker for any reason. Fifteen years later, a modified version of that message may help propel him into Congress. In an interview, Oberweis confirmed reports he’ll seek the 14th Congressional District seat represented by newly-elected Democrat Lauren Underwood in the next cycle. And he said he’s learned a lot about politics and cooperating across the aisle since 2004. Much of that education stems from his service as an Illinois state senator from Sugar Grove since 2013. He pointed to his support for legalizing medical marijuana and successfully raising some speed limits to 70 mph as examples of where he’s listened to both sides of an issue. Oberweis also sponsored legislation to raise the state’s minimum wage. His bill would have raised it gradually to $10 per hour, in what he believes was a more realistic increase. He sees Illinois’ new plan to gradually increase the minimum wage to $15 as a threat to the number of available jobs and the motivation for upward mobility. “A $15 minimum wage is going to create problems for people wanting to enter the workforce,” Oberweis said. “Minimum wage jobs are designed to teach people how to work and how to secure employment. They are not meant to be the end of the line, feed-my-family-of-four kind of job.” . . . “I still feel immigration is a significant problem with a potentially significant cost,” Oberweis said. “On the other hand, those kids who were brought here by their parents and only know this country? We don’t blame kids for the mistakes of their parent. I’m much more inclined to talk about a path to citizenship for those kids than their parents who broke laws.” Oberweis said he also doesn’t believe in family separation. So the compromise is a nonimmigrant visa for those parents. That visa would allow them to remain in the country but not become citizens or be eligible for government benefits.)

In high supply were bankers, lawyers, executives, investment firms, analysts, consultants, farmers, researchers, chemists, computer scientists, builders, and manufacturers trading industry know-how in hopes of successfully navigating the nascent cannabis market expected to reach nearly $17 billion globally this year, and balloon to $32 billion by 2022. The players there want front-row seats, and even seats at the tables, where state and federal cannabis regulations certain to impact their bottom line are hammered out. Cresco Labs (CL.CN) CEO Charlie Bachtell, whose Chicago-based cannabis company is a dominant player in Illinois’s medical market, has joined a transition team for the state’s newly elected governor, J.B. Pritzker. Illinois is one of several states, including New York, New Jersey, and Florida, that have been aggressively considering recreational use legislation, in addition to their medical use programs. “Illinois is maturing from being a medically focused program to an adoption of an adult use law,” Bachtell told Yahoo Finance. ‘I think it’s a large market’ Cresco’s cultivation, processing, and consumer packaged goods operations span eight states. The company is positioned to expand within the medical market, as well as into targeted recreational markets yet to be realized. Bachtell and Cresco are participating in a pilot program to widen medical marijuana access for Illinois patients seeking alternatives to opioid use. Current state law prohibits marijuana to treat general pain, making it inaccessible for some patients using prescription opioids. “We worked with the administration, the prior administration, over the last 24 months to really create a new law, utilizing data that was coming out of a lot of existing markets, showing this correlation between greater access to cannabis and reduced opioid use,” Bachtell said. “I think it’s a large market, but more importantly an important market.” According to BDS Analytics CEO Roy Bingham, U.S. medical marijuana sales are projected to increase from $4.5 billion in 2018 to $7.4 billion in 2021, though recreational use sales are expected to fuel the majority of market growth.
