(FROM THE ARTICLE: I don’t fly. When folks ask me why, the short answer is that I know too much: I’m a former FAA air traffic controller. It’s been recently reported that the FAA is now actively recruiting new trainees to work in the towers and control rooms directing airplanes and that the criteria they now utilize to screen applicants is a curiously absurd “biographical questionnaire.” Jason L. Riley in the Wall Street Journal: “A recently completed six-month investigation by Fox Business Network found that the Federal Aviation Administration has quietly moved away from merit-based hiring criteria in order to increase the number of women and minorities who staff airport control towers. The changes come despite the fact that the FAA’s own internal reports describe the evidence for changing the hiring process as “weak.” Until 2013, the FAA gave hiring preference to controller applicants who earned a degree from one of its Collegiate Training Initiative schools and scored high enough on an eight-hour screening test called the Air Traffic Selection and Training exam, or AT-SAT, which measures cognitive skills. The Obama administration, however, determined that the process excluded too many from minority groups. In May 2013, the FAA’s civil rights administrator issued “barrier analyses” of the agency’s employment procedures, which recommended “revising how the AT-SAT is used in establishing best-qualified lists.” By the start of last year, the FAA was using a biographical questionnaire (BQ) to initially vet potential hires. The questions – “How many sports did you play in high school?”, “What has been the major cause of your failures?” – seem designed to elicit stories of personal disadvantage or family hardship rather than determine success on the job.” I can tell you with absolute certainty that the FAA Air Traffic Control Division has been down with the affirmative action program for a long time. The PATCO controllers’ strike during the summer of 1981 seemingly gave the “fire whitey” gang the opening they craved. There was one problem. The air traffic system needed to get back up and running smoothly, and especially safely, so that Ronald Reagan’s mass firing would look reasonable. So they quickly hired aviation-experienced people, including pilots and experienced military air traffic controllers. I was one of them. Granted, some of these well qualified new guys were black, but no one would look upon this new controller work force and call it a model of so-called diversity. The big push for hiring other than pale males would have to wait. Safety first, as it were. A few things happened in the next few years. First, the FAA stopped reporting aviation incidents, including near mid-air collisions and runway incursions. When safety incidents are under-reported or deceitfully downgraded, the system starts to look like perfection, and the FAA will gladly report, as it frequently does, that it is “The Safest System In The World.” These people want the flying public to skate out onto the ice, even as they are lying about how thin the ice is, and while we are at it, how warm it is today.)

(FROM THE ARTICLE: President Donald Trump signed a series of executive orders Friday making it easier for federal agencies to discipline and fire employees. The unilateral moves follow the president’s vows during the 2016 election to “reduce the federal workforce through attrition” and otherwise shrink the number of government employees to their lowest level in decades. The orders will give federal managers the power to fire workers alleged to be “struggling” in their performance after “improvement periods” lasting up to a single month. Previously, workers in such a status were given from 60 to 120 days to improve, depending on the agency. The orders will likewise force government unions to negotiate labor contracts with departments at a faster rate, tie layoffs to performance instead of seniority, charge unions rent for using federal office space, and limit the amount of official time an employee can spend attending to union-related affairs. “These executive orders make it easier for agencies to remove poor-performing employees and ensure that taxpayer dollars are more efficiently used,” stated White House Director of the Domestic Policy Council Andrew Bremberg. Far from the bureaucratic behemoth that conservatives have painted it as, civilian employment within the federal workforce, numbering 2.7 million, has dropped to levels lower than during the 1960s as a result of multiple bipartisan cutbacks over the past quarter century.)

Literally 30,000 people moved out [last year].” Recalling his early years in public service, Lauzen said he’d hear from disgruntled homeowners. Now those homeowners aren’t calling him, but are leaving the state for good. “It usually was the seniors, the older folks, who used to call,” he said. “The older men would call up and they’d holler at you and the older ladies, they’d call and cried about the property tax burden. And they’re living on fixed incomes and it was a huge problem. “These days, I think many of us are finding that they don’t call anymore. It’s almost like they’ve given up and they just move so that’s a terrible thing.” Lauzen explained that change is long overdue and one of the ways to do that is to stop taxing people out of their homes. He believes he’s made a lot of progress during the past seven years. “Before I had the privilege to serve as chairman, we had a 50 percent increase in the property taxes to support the county,” he said. “In the last seven years it’s leveled out at zero increase.” That includes having to insert into the base the new construction while excluding a cost of living increase. “I’m very proud of holding the line,” he said. “But it is naturally getting harder and harder to live within our means without asking people for more.” Lauzen said that the public often complains about the spending, but that he’s doing his part to help reduce debt. “[The public] says that all you guys and ladies do is borrow and spend,” he said. “We’ve paid off approximately 65 percent of the debt in the last six to seven years.” Lauzen closed his presentation by sharing a slide of three beliefs that he referred to as “Truly Dumb Ideas.” He said that he hopes no one who attended the luncheon ever allows any of them to see the light of day. It includes combining all local pensions into one, increasing property taxes by 1 percent of the home value to pay off the state’s pensions unfunded liabilities and running the government like a business. But apparently, a large number of workers aren’t listening. In fact, one-third of Americans have less than $5,000 set aside for the future, according to new data from Northwestern Mutual. Incidentally, 21 percent of Americans have no retirement savings at all. It’s one thing to have less than $5,000 in your nest egg when you’re only in your 20s or even 30s. But if you’ve been in the workforce for quite some time, that $5,000 doesn’t paint a great picture. And if you don’t take steps to ramp up, you’ll be sorry for it later on. Social Security just won’t cut it Many workers don’t save for the future because they assume they can live on Social Security. But that’s a dangerous, misguided assumption. In a best-case scenario, Social Security will replace about 40 percent of the average earner’s pre-retirement income. Most seniors, however, need double that amount to live comfortably. Even if you’re willing to cut corners in retirement, you can only slash so many basics. You’ll still need a roof over your head, a way of getting around town, and food on the table. Therefore, a frugal lifestyle might allow you to get away with spending a bit less than 80 percent of your former earnings, but not much. That means that while your Social Security income will help cover the bills when you’re older, you still will need a nice amount of savings to avoid falling short.)

ProPublica estimates that in the past five years alone, IBM has eliminated more than 20,000 American employees ages 40 and over, about 60 percent of its estimated total U.S. job cuts during those years. In making these cuts, IBM has flouted or outflanked U.S. laws and regulations intended to protect later-career workers from age discrimination, according to a ProPublica review of internal company documents, legal filings and public records, as well as information provided via interviews and questionnaires filled out by more than 1,000 former IBM employees. The entire report is distressing and makes for very sobering reading. Documents the ProPublica reporters obtained describe internal decisions to replace older Boomer-aged workers with younger ones viewed as better able to meet the company’s agenda, all while using gambits to reduce their risk of age-discrimination lawsuits. At the same time, readers who have watched the history of retirement plans will recall that IBM was a pioneer in the move away from traditional pension plans. In 1999, the company froze accruals in its traditional pension plan and moved to a cash balance pension plan for new accruals (that is, a hybrid plan which functions like a 401(k) plan with semi-guaranteed returns), in 2005, it switched to a 401(k) plan for new employees, and in 2008 it froze its cash balance and moved all employees to a 401(k) plan for all future accruals.)

(FROM THE ARTICLE: A recent federal appeals court decision could make it easier for federal retirees to succeed in a claim that they were forced into retirement, by holding that the evidence they cite in support of their argument should be viewed as a whole. The Court of Appeals for the Federal Circuit noted that federal retirements (and resignations) are presumed to be voluntary, but that presumption can be overcome if the employee proves that he or she “had no realistic alternative but to resign or retire, and the employee’s resignation or retirement was the result of improper acts by the agency.” That should be determined by examining “the surrounding circumstances to test the ability of the employee to exercise free choice.” The court sent back to the MSPB a case in which a retiree argued that his retirement was involuntary, saying that the MSPB improperly viewed his evidence as a series of separate developments, none of which it found was sufficient to support that claim. The court cited the employee’s evidence that he was afraid to meet personally with certain supervisors after “multiple instances of hostility” from them, his request to be transferred away from them, and the worsening of a health problem. The court said that they should have been considered “as a series of escalating incidents” and viewing them “collectively, rather than dismissing them one by one, as the Board did, we find that a person in like circumstances could reasonably feel unable to exercise free choice and compelled to retire.”)

(FROM THE ARTICLE: OPM has told agencies to record in the official personnel file of an employee who resigns during an investigation that could lead to disciplinary the results of that investigation if the agency concludes that action would have been warranted. The guidance carries out a 2016 change in law resulting from concerns that by resigning, those employees could later return to the government without consequences because their personnel records would not reflect it. That same law also required agencies to review those records when considering hiring a former federal employee. OPM’s memo says that before putting that information in an individual’s official personnel file, an agency must provide notice of the adverse finding and an opportunity to respond and receive a final agency decision. That could be appealed to the MSPB. “While the statute prescribes the process for making the required permanent notation, an agency may use its own discretion for determining the format for making the notation. Agencies may wish to consult with their legal counsel,” OPM said. The guidance includes a sample for documenting the notation, and further recommends that agencies place the document and any supporting materials on the permanent side of the employee’s OPF, subject to removal if the employee prevails in an appeal at the MSPB.)

This condition will exist for approximately two and a half hours (9:30 a.m. until 12:00 p.m.). Mike Turner, R-Ohio, wrote to Office of Personnel Management Director Jeff Pon May 9, 2018, to express “strong opposition” to a recent letter in which the director proposed sweeping cuts and increased contributions to federal employee retirement. “Federal employees are the cornerstone of an effective and efficient federal government. Our country relies on these talented men and women to perform critical duties across all sectors of government, from national security and healthcare to economic expansion and infrastructure development,” Turner wrote. Turner’s opposition as a Republican is notable, as Democrats have traditionally held a strong line against cutting federal employee benefits in order to balance the budget. Pon’s legislative proposals would likely require fairly unified Republican support to pass into actual legislation. According to a news release on the letter of opposition, Turner’s district contains 30,000 federal employees that would likely be impacted by the proposed changes. Turner took particular issue with aspects of OPM’s proposals that would impact current employees and retirees, such as increases in retirement contributions for current employees and the elimination of cost-of-living adjustments for all current and future retirees under the Federal Employee Retirement System. “This breaks a promise to current federal employees and retirees. We should not arbitrarily make changes to policies that families have planned their lives around, particularly when it affects current retirees with limited ability to make up for unanticipated reductions in estimated income,” wrote Turner. Pon justified the proposed changes as bringing the government more in line with private sector practices, though some have argued that prospective employees are attracted to the government over the private sector due to more generous retirement packages. “In order to ‘recruit, retain and honor a world-class workforce to serve the American people’ as OPM seeks, the federal government must maintain a competitive benefits package befitting such a workforce. With the United States’ growing economy and a tightening labor market, we cannot afford to make the federal government a less attractive place to work by diminishing the very benefits that help the government keep pace with jobs in the (often higher-paying) private sector,” Turner wrote.)
