It is a key reason why Americans, age 40 and over, are fired or offered buyouts (with younger persons being hired in their place) and why they can’t find work after a period of unemployment and struggle to return to the workforce.  On Valentine’s Day, U.S. Sen. Bob Casey (D-Pa.), Ranking Member of the Special Committee on Aging, with cosponsors Sens. Chuck Grassley (R-Iowa), Patrick Leahy (D-Vt.) and Susan Collins (R-Maine) re-introduced S 485, The Protecting Older Workers Against Discrimination Act (POWADA). The bill was referred to the Senate Committee on Health, Education, Labor and Pensions. Fixing a Supreme Court Ruling Over a decade ago, a U.S. Supreme Court ruling in Gross v. FBL Financial Services weakened the Age Discrimination in Employment Act (ADEA) by imposing a significantly higher burden of proof on older workers alleging age discrimination than is required of workers alleging other forms of workplace discrimination. As a result, workers that allege age discrimination must meet an undue legal burden not faced by workers alleging discrimination based on race, sex, national origin or religion. This sent a clear signal to employers: some age discrimination is perfectly fine. Enacting the bipartisan POWADA bill would restore the pre-Gross standard, recognizing once again the legitimacy of so-called “mixed-motive” claims in which discrimination is a, if not the deciding, factor. It would also reaffirm that workers may use any type of admissible evidence to prove their claims.)

In fact, if Uncle Sam kept a list of endangered workers, folks under the old Civil Service Retirement System would be at the top. Less than six of every 100 workers still on the payroll are under the generous system that was phased out in the mid 1980s, in favor of a retirement package more like those in the private sector. It is the Federal Employees Retirement System, or FERS, and it covers those hired since 1984. Although CSRS and FERS employees work alongside each other in many offices, their situations are very different. CSRS provides a much more generous retirement annuity than FERS, while the latter group of employees are eligible for both Social Security and get a government match of up to 5 percent of their total pay to their Thrift Savings Plan accounts. The TSP is a good investment for CSRS workers and a must for FERS employees because of their smaller annuities. In a Congressional Research Service study of the two retirement plans in fiscal year 2016, the average monthly federal benefit for retiring FERS workers was $1,714 versus an average of $4,755 per month for those leaving under the CSRS plan. Because of the less generous civil service benefit and less inflation protection in retirement some people believe that those under FERS work longer than their CSRS counterparts.)

At a Feb. 17 fundraiser to formally kick off his campaign held at the DuPage County Historical Museum, Suess’ “experience, background and principles” were touted as what Wheaton now needs most. A longtime local businessman who has served on the council since 2005, the 61-year-old Seuss is credited in the campaign flyer with often being the voice of reason on the panel, especially when it came to matters such as keeping property tax rates in order. “Phil has led the city financially and focused on paying down debt and making reasonable affordable investments in core infrastructure (sewers, water, roads, sidewalks, and trees) without taking on risky projects,” detailed the invite to his Feb. 17 event. “He has literally saved the residents millions of dollars by being prudent and demanding better bids on projects. He voted against unnecessary property tax increases.“ In contrast, Prendiville is tagged in the flyer as a “big taxes and big government” legislator who has “voted for every tax increase.” The flyer adss, “As a city councilman, Prendiville advocated against Wheaton’s families and businesses and wanted the city to take on debt and incur annual subsidies to operate a private theater that was not (and is still not) able to attract sufficient private investment. Prendiville argued against private development of Mariano’s which brings in $700,000 worth of sales tax a year.
